Dear Mr. McMillan,
Attached please find the Pre Construction Notification for the Nationwide Permit #12 for the above noted
project, a copy of the 404 Permit from the US Army Corps of Engineers, a letter form the Town of
Harrisburg ensuring control of storm water and sediment during construction and a check for $200.00. I am

Impacts to Wetlands:
There are no wetlands within this ~ 0.510 acre project site; therefore no impacts to wetlands exist.
Impacts to Stream:
This project will cross Rocky River one time. At the time of this permit application it is unknown if boring
under the river is feasible therefore we wish to obtain the proper permits for open trenching to be on the
safe side. During construction a coffer dam will be installed and the flow will be piped through the coffer
dam to create a dry area for the actual construction to take place within. It is anticipated that construction
will take place within a 5 day period. All efforts will be taken to ensure construction takes place when
stream flow is at its lowest point. After construction the banks of the river will be returned to existing
topography, no greater than a 10 foot wide section of rip rap will be added to the banks as toe protection
and the banks will then be re-vegetated with native woody plant material. Depending upon the season at
time of completion either live stakes of native vegetation or bare root material will be utilized to stabilize the
disturbance.
Threatened and Endangered Species and Species of Concern.
A Threatened and Endangered species study was performed along the entire length of the project and no
species of concern were found.

Historic or Archeological Sites:
A review of Historic Inventories of Cabarrus County reveals no historic resources located win the project
area.
A request has been made to the North Carolina Office of State Archeology, accompanied by a site map
requesting review to determine if archeologically significant sites are within the project easement. As this
project is in an existing sub division it is unlikely that a significant site(s) will be found. If a significant
archeological site is determined to be present within the permanent or construction easement the
appropriate steps will be taken to avoid that area.

conditions and your submitted plans. Any violation of the attached conditions or deviation from your submitted plans may subject the
permittee to a stop work order, a restoration order and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified,
suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or
modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of
the modified nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the
activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are

Attach a vicinity map clearly showing the location of the property with respect to local
Landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

consists of abandoning, an existing_~ump station and replacing it with 700 linear feet of
rg avity~sewer line that will tie into existing ~4" V~'SACC Interceptor -Permit # V6'Q 0012798.
The new gravity sewer will cross Rocky River 3~d 20' 7" N 80d 39' 13" W' The pump station
and all eYistina infrastructure will be demolished and the area will be returned to grade, and
re-vegetated If at all possible the sewer line will be bored under Rocky River. If this
proves to be impossible then a coffer dam will be installed as a temporary crossing and to
allow the flow of the river to~ass through the coffer dam to allow the area of construction to
stay dry during construction Lion completion (estimated construction time ~ ~ days) the

VI. Proposed Impacts to Waters of the Lnited States/Waters of the State

riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts,
permanent and temporary, must be listed, and must be labeled and clearly identifiable on an
accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial)
should be shown on a delineation map, whether or not impacts are proposed to these systems.

Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, Lower-impact
site layouts, and explain why these design options were not feasible- Also discuss how impacts
were minimized once the desired site plan w-as developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts. At the time of this permit it is
not known if boring under the Rocky River is~ossible. If boring under the river is possible there
will be no impacts to the stream If boring is not possible one crossing which is unavoidable will
be necessary as the receiving ~4" sewer is on the opposite side of the stream there is no other
way- to con-nect the new gravity sewer to the existing interceptor The gravity sewer route chosen
is the shortest & most direct routes for connection to the existing sewer system. River impacts
durinz construction will be minimized to the fullest extent possible with sediment and erosion
control devices and a coffer dam Upon completion the banks of the Rocky River will be
returned to preconstruction topo~raphv protected with rip rap and the upper banks will be re-
vegetated with silky willow and silky dogwood trees.
VIII. Mitigation
DWQ - In accordance with 1~A NCAC 2H .000, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
tSACE - In accordance with the Final Notice of Issuance and :Modification of Nationwide
Permits, published in the Federal Register on January 1 ~, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and,~or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for liSACE or DWQ to consider the application complete for processing. :any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.

Provide a brief description of the proposed mitigation plan. The description should provide

Biological Assessment -Harrisburg Pump Station Project
Harrisburg, NC
The Town of Harrisburg proposes to abandon a pump station in the Rocky River
Crossing community on the east side of Roberta Rd. at the Rocky River. The pump
station is on the south bank of the river. The proposal is to extend a 12 in. gravity line
east along the floodplain of the river for approximately 620 l.f., crossing the river and
connecting to the existing Rocky River interceptor, on the north bank of the river. The
total of the project is 741 l.f.
The 620 l.f. section of the project is in an urban floodplain forest directly behind homes.
The existing interceptor is in an open field. Prior to the field work, the database of the
NC Natural Heritage Program for the Harrisburg USGS Quad was downloaded to provide
a basis for the field work, which was preformed on April 17, 2007 The printout is
attached to the end of this report. There are no communities of concern, except for a
Wading Bird site, which is not in this area. The list of species of concern is relatively
long, although the habitats for these species are not present, as will be noted below.
The forest is dominated by a mixture of hardwood species, including: American beech
(Fagus grandifolia) 28 in. diameter breast height (dbh), Water oak (Ouercus nigra) 24 in.
(dbh), Sweetgum (Liquidambar styrac~ua) 24 in. dbh, Shumard oak (Q. shumardii) 20
in. dbh, Sugarberry (Celtis laevigata) 14 in. dbh, American elm (Ulmus americana} 12 in.
dbh, and Southern Sugar maple (Ater floridanum) 11 in. dbh. The shrub layer consists
primarily of Wafer ash (Ptelea trifoliata} and seedlings of the Sugar maple. However,
included are Horse chestnut (Aesculus sylvatica), Arrowwood (Viburnum dentatum),
American elm, Privet (Ligustrum sinense), Cane (Arundinaria gigantea), Japanese
honeysuckle (Lonicera japonica), and Poison ivy (Toxicodendron radicans).
Although some trees will be removed during the construction, the ROW was placed as
effectively as passible. There is one recommendation, regarding the largest Beech tree
(28 in. dbh) in the ROW. The plans call for impacting this tree, but a meeting in the field
allows for adjustment of a manhole placement about 10-12 ft. to the south to miss the
tree.
The NHP species list consists of two invertebrates: Carolina heelsplitter (Lasmigona
decorata), which is listed as historic in this quad. The Carolina creekshell (Villosa
vaughaniana) has been reported from Back Creek and Mallard Creek, but not from the
Rocky River. Two animals, Timber rattlesnake (Crotalus horridus) has been reported
from the northern part of this quad and the Loggerhead shrike (Lanius ludovicianus)
prefers open fields with some trees, again not present in this project area. Two vascular

plants, Schweinitz's sunflower (Helianthus schweinitzii) and Georgia aster
(Symphyotrichum georgiarrum) are on the federal list. The habitat is not that of these
species, and no specimens were noted. The remaining vascular plants, 11 species, are
usually found in wetlands or open field habitats, which are not included within this
project area. One exception may be the Crested Coral-root orchid (Hexalectris spicata)
which blooms in late summer and would not be visible at this time.
There are no wetlands associated with the project, other than the river itself.
There are no recommendations regarding communities or species of concern for this
project.
