PROJECT SUMMARY: The applicant is proposing to maintenance excavate a 30'X1796' access channel to serve an existing NCWRC boat ramp currently permitted under Major Permit 41-19. Field Investigation Report: NCWRC Page 02 9. NARRATIVE DESCRIPTION: The NCWRC project is located at 200 Wildlife Rd. in Sea level adjacent Salters Creek. Salters Creek connects to Nelson Bay which opens up into Core Sound. The project will serve an existing boat ramp under the Hwy. 70 bridge. This property is 2.1 ac in its entirety and has 1,125' of shoreline. Existing on the property is a parking lot, boat ramp and bulkhead. A fringe of high and low marsh exists along the unstabilized portions of the shoreline. No Coastal Wetlands exist in the ramp or bulkhead area or shoreline. No SAV was observed during the site visit. Substrate in this area is sand and silt. The channel leading to the boat ramp has been previously excavated but DCM staff could not locate a permit on file for such excavation as it may have been historically excavated by the extensive use of commercial fishing vessels. Water depths around the boat ramp are -2' to -5' at NLW. The Division of Water Resources classifies this area of Core Sound as SA waters. This is not a Primary Nursery Area but is a productive Special Secondary. This portion of Salters Creek is closed to harvesting shellfish. The parcel is classified in the Carteret Co. LUP as Rural/Conservation. 10 PROJECT DESCRIPTION: NCWRC is proposing to excavate an existing navigation channel that serves an existing boat ramp. The proposed channel would be 1,796' long and 30' wide. Water depths in the channel would go from -2.75' at NLW to -4' at NLW. A total of 1,607 cubic yards would be excavated. Excavation would be bucket to barge and spoils would be offloaded at the existing ramp before being transferred to an approved high ground location. 11. ANTICIPATED IMPACTS: Excavation will result in the disturbance of 53,880ft2 of shallow bottom habitat. Temporary turbidity impacts can be expected during the removal of the 2,847 cubic yards of material. Final bottom soundings would be -4' NLW. This project would improve and make public access safer to Public Trust Waters. Periodic maintenance excavation would be required to maintain the proposed water depths. The existing boat ramp at Salters Creek BAA provides boating access to Salters Creek and the surrounding areas. The existing channel from the existing ramp to Nelsons Bay has steadily seen its depth decrease, making boat navigation hazardous for the public. NCWRC and Carteret County have received numerous complaints from boaters utilizing the existing channel in regard to shoaling in the channel,particularly the area South of the HWY 70 bridge. Increasingthe channel l n h would facilitate an increase overall depth which should length o a1 p lessen future maintenance dredges and therefore lessen habitat impacts. The North Carolina Wildlife Resources Commission (WRC) is requesting a modification to Permit #41-19. A recent survey performed along the existing channel indicates a required modification to the previously permitted dredge area is necessary. The revised dredge area adds approximately 150 linear feet(If)of additional dredge area(-F/- 10%)to the previously permitted area. The revised dredge area will be roughly 30' wide with a depth of four(-4')feet(NA'VD88) and follow the existing channel. Total excavation will be approximately 1,607 cubic yards(CY) and cover approximately 53,855 square feet. Dredged material will be moved offsite to an approved disposal area. The project proponent herby certifies that all information contained herein is true, accurate, and complete to the best of my knowledge. Spoil Disposal 5) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. 6) No spoil material shall be placed within 30 feet of the normal high water line. 7) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 8) The permittee and/or his contractor shall take all necessary precautions to ensure that the spoil material is properly contained during transport to the disposal site,and that all the proper coordination has taken place with the local or state governments to ensure that any damage to public streets caused by transport of the_spoil_materiaLhas be_en_addressed. 9) In order to protect waters adjacent to the designated dredge spoil disposal site,the permittee shall provide the Division of Marine Fisheries—Shellfish Sanitation Section the dredge plan and the location of the spoil disposal site prior to any dredging activity, so a swimming advisory or shellfish closure determination can be made,and documentation of this coordination provided to the Division of Coastal Management. Maintenance Clause 10) The Division of Coastal Management shall be notified in writing at least two(2)weeks in advance of any maintenance excavation work authorized by this permit,and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross-hatching indicating the area to be maintained,the area to be used for spoil disposal,and the estimated amount of material to be removed. The location,design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. USACE Conditions 11)In order to further protect the endangered West Indian Manatee,Trichechus manatus,the applicant must implement the U.S. Fish&Wildlife Service's Guidelines,and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/nc-es/mammal/manatee_guidelines.pdf. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S.Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2010-01959) issued 6/6/19. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-0434. NOTE: Future development of the permittee's property may require a modification of this Kermit. Contact a representative of the Division at(252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of$475 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources.
