Please find attached a Mitigation Credit Transfer Certificate and the corresponding credit ledger for 2 projects under
John and Lindsay Bayer, 1) Bayer Fire Truck Turnaround and 2) 526 Oakland Drive. It is the same applicant for both
projects, so both projects are on one Transfer Certificate, but it is shown as two projects on the credit ledger. Let me

EZELL BUFFER BANK SITE
TO: NORTH CAROLINA DIVISION OF WATER RESOURCES
The undersigned, EBX -Neese I, LLC, the Sponsor of the Ezell Nutrient Bank (the "Bank ")
(DWQ 42011- 07200), located in Granville County, NC, hereby certifies the following:
1. John and Lindsay Bayer have deposited monies with the Sponsor sufficient to acquire
1,250.00 Buffer Credits (square feet) from the Bank for use on its Bayer Fire Trick
Turnaround project (DWR Project Number 13 -1096) and 6,940.50 Buffer Credits (square
feet) from the Bank for use on its 526 Oakland Drive (DWQ Project Number 12- 0387v2)
project in Raleigh, NC.
2. The Bayer Fire Trick Turnaround project requires a total of 1,250.00 Riparian Buffer
Mitigation Credits and the 526 Oakland Drive project requires a total of 6,940.50
Riparian Buffer Mitigation Credits in HUC 03020201 as part of its mitigation. Of this
amount 1,250.00 and 6,940.50 Buffer Credits are being provided by the Ezell Nutrient
and Buffer Bank Site.
3. The Sponsor has deducted 1,250.00 and 6,940.50 Buffer Credits from the Bank's credit
ledger from the Ezell Nutrient Bank Site.
A copy of the Ezell Nutrient Mitigation Site credit ledger reflecting the above transaction is
attached to this Affidavit.
