Ezell Bank Parcel Mitigation Credit Changes
Dear Mr. Rinker:
On August 9, 2013, the Division of Water Resources (DWR) issued a memo to the North Carolina
Ecosystem Enhancement Program (NCEEP) titled "DWR responses to the EEP document "Reforms
needed immediately in the regulation of riparian buffer mitigation". On October 10, 2013, DWR
received a letter from Environmental Banc & Exchange, LLC, requesting approval to convert
approximately 5.88 acres of nutrient offset credits to riparian buffer mitigation credits in the Ezell
Mitigation Bank,
On October 23, 2013, DWR received a signed and sealed survey of the subject site showing the new areas
of nutrient offset and riparian buffer mitigation. A comparison of the mitigation provided in the As -Built
survey with the revised survey signed on September 25, 2013 is provided in the table below:

As of the date of this letter, DWR has released 55% of the total nutrient offset and riparian buffer
mitigation credits to EBX as provided in the As -Built Survey. Therefore, by copy of this correspondence
DWR approves the following:

Please note that nutrient offset credits generated at this site must be used for impacts in HUC
03020201 of the Neuse River Basin which includes only the Lower Falls Watershed as defined in
15A NCAC 02B.0276 and provided in 15A NCAC 02B.0282. Additionally, the riparian buffer
credits must be used for impacts in the Neuse River Basin according to guidelines in 15A NCAC
02B .0242.
