The stream is identified as Feature B, which is subject to the Tar - Pamlico 50' buffer requirements. PROJECT INFORMATION The site consists of two contiguous parcels which total approximately 57 acres of a larger 77.5 acre parent property. According to the Nash County GIS Online database, the Parcel Identification Numbers are: 00831 (36.46 acres) and 009668 (43.04 acres). The site consists of undeveloped wooded land and agricultural fields. Rockwool Street transects the western portion of the site. Rockwool Street turns into a dirt road that transects the western and central portions of the site. Remnants of an old barn structure and residence are located on the western portion of the site. Seaboard Coast Railroad borders the northern site boundary. According to the USGS Topographic Map, Sapony Creek transects the central portion of the site, oriented north to south. The creek expands into swamp areas throughout the central portion of the site. ECS would like to reevaluate the stream call made on July 19, 2013 by Mr. Dave Parnell and Mr. Chris Pullinger with the NCDWR. The feature in question, Feature B, does not have a well defined bed or banks. Characteristics of the feature include shallow pools, approximately two to four inches deep. Base flow has been minimal to absent during our site visits. The width of the feature varies from approximately one to three feet. A large portion of this feature is straight with zero to minimal sinuosity. The gradient of the feature is relatively flat and the bottom is primarily composed of sand and silt. The feature has ephemeral characteristics and was not flagged in the field by ECS. ECS provided a wetland /stream report to Strata Solar, our client, for the above mentioned site on September 24, 2013. Information regarding the stream determination made by NCDWR on- site has not been communicated to the property owner, Mr. A.L. Honeycutt, Jr. Because the affected party was not notified of the buffer determination letter issued on July 19, 2013, ECS believes the 60 day appeal request date should not be adhered to. Additionally, at the time the wetland delineation report was issued, ECS was not provided a proposed development plan for the subject site. As such, ECS and the affected property owner were unaware of the ramifications of the determination call and unable to move forward more diligently in the appeal process. 9W ONrMGW ALA.
