(Permittee), Timmons Group is requesting a modification of previously authorized permits (USACE SAW-2018-00240 & DWR 20190289) for the Publix Distribution Center (Site). Please accept this letter and supporting documentation as a Minor Modification Request. The purpose of this Notification is to provide updated impacts proposed within the Publix Distribution Center Site. Previously unforeseen restraints necessitate modification of the permits associated with the western sewer outfall portion of the Publix Distribution Center project. The proposed change is due to previously unforeseen difficulties encountered by the contractor. Currently, underground jack and bore trenchless sewer construction is proposed for the western sewer outfall in order to avoid any jurisdictional impacts to the stream channel. However, multiple bores attempts have resulted in the bore being redirected off course due to hitting premature weathered rock. Extreme care was taken to avoid any disturbance to the stream channel and boring was ceased immediately upon any indication of the bore direction changing. The Permittee has determined that open cut trenching, in lieu of underground jack and bore, is required for construction of the western sewer outfall and its associated temporary stream crossing. Details of the proposed temporary stream crossing are included as Attachment 1: Select Plan Sheets. Upon completion of construction, all temporary dams, filter fabric, and corrugated metal pipes will be removed. Temporary dam bottoms will be depressed into the stream bed until top of riprap is level with stream bottom so as to not obstruct stream flow. The proposed temporary earthen berm, silt bag, and dewatering basin will be removed upon the stabilization of the cleared area. In order to accomplish the construction of the western sewer outfall via open cut trenching, 10 linear feet of permanent stream impacts are proposed for the placement of riprap. Although the proposed riprap is considered a permanent impact, it will be installed in accordance with USACE and DWR guidance to ensure it will not be considered a "loss of water" and therefore will not trigger mitigation. Additionally, the LOD is proposed to expand slightly surrounding the western sewer outfall. This expansion will include 839 square feet of additional temporary impacts to Zone 1 and 445 square feet of additional temporary impacts to Zone 2 stream buffers. These impacts are required to provide construction access, excavation areas, and sufficient equipment maneuverability required for the open cut trench. Additional buffer impacts have been coordinated with Guilford County and will be repaired per methods previously approved by Guilford County. For your use and review, enclosed with this Notice are revised exhibits (Attachment 2: Revised Publix Distribution Center Impact Maps) The proposed modification would result in a net increase of 10 linear feet of permanent - no loss - stream impacts, 839 square feet of temporary Zone 1 stream buffer impacts, and 445 square feet of Zone 2 stream buffer impacts. A narrative of each of the proposed changes is provided below: Impact S11: Results in an additional 10 L.F. of permanent - no loss - stream channel impacts due to the installation of riprap associated with the temporary stream crossing. Upon completion of construction all temporary dams, filter fabric, and corrugated metal pipes will be removed. Temporary dam bottoms will be depressed into the stream bed until top of riprap is level with stream bottom so as to not obstruct stream flow and ensure no loss of water. The proposed temporary earthen berm, silt bag, and dewatering basin will be removed upon the stabilization of the cleared area Impact B6-Z1: Results in an additional of 839 square feet of temporary impacts to Zone 1 stream buffers. Previously approved impact of 675 S.F. brings the cumulative impact for B6-Z1 to 1,514 S.F. This impact is required for construction access, excavation areas, and sufficient equipment maneuverability required for the open cut trench. Impact B6-Z2: Results in an additional of 445 square feet of temporary impacts to Zone 2 stream buffers. Previously approved impact of 245 S.F. brings the cumulative impact for B6-Z2 to 690 S.F. This impact is required for construction access, excavation areas, and sufficient equipment maneuverability required for the open cut trench. Compensatory mitigation is not proposed for the additional 10 linear feet of permanent stream impacts. As proposed riprap will be installed and subsequently depressed into the stream bed until top of riprap is level with stream bottom so as to not obstruct stream flow, this impact will be considered permanent but not a "loss of water". The proposed modifications are consistent with previously authorized work and are not anticipated to have an adverse impact on state or federal listed Threatened & Endangered Species.
