In order to stay under the 1501f threshold, the engineer designed a larger headwall that would have likely caused NCDOT reviewers to raise some questions. In light of the mitigation requirement, are you comfortable with us revising the permit and requesting slightly more linear footage in order to comply with NCDOT standards? I was given a permit a number of years ago by Steve Chapin and mitigation wasn't an issue. I'll just need something in order to explain to my project manager and the client why additional fees are necessary. We've consistently required mitigation for permanent impacts/losses to waters of the U.S. for road widening/extension related projects where impacts are<150 linear feet of stream channel and/or>0.10 acre of wetlands. We've also notified CDOT/E&PM of this requirement but it doesn't appear that this is being passed down to the consultants that they are using to submit their permit applications. I will work on remedying this issue in the near future. With that said,we will require mitigation for the permanent impacts associated with this project (150 linear feet). Given the poor quality of the stream channel, a 1:1 ratio is acceptable. Please provide information as to how the applicant will mitigate for the impacts (i.e. NCEEP and/or City of Charlotte Umbrella Bank). I will need an acceptance letter from either stating that they have credit available before I can issue the permit. Until we receive this information,the application is on hold.
