The applicant retained the services of SBEC to delineate all jurisdictional waters on the property. The apply revised their plans such that the only Impacts on the property are associated with road crossings to access upland areas and temporary utility crossings to access sewer lines. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The project engineer has reduced the slopes of the roads and shorten the length of the culverts to avoid direct stream impacts. Multiple culverts are proposed, but are aligned such that only one culvert is set in alignment with and below the stream beds and the others are set above the OHWM elevation. 2. The EEP mitigation invoiced, but not paid since the impacts did not occur. The applicant proposes the same mitigation approach for this renewal (2:1 via 1:1 on -site preservation 81:1 EEP payment). An updated EEP acceptance letter is attached along with a revised "Preservation Area' map. The "Preservation Area" includes over 9 acres of riparian buffers (a minimum of 30 ft. wide and larger, up to 50 ft., where possible) 8 5,486 ft. of streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes installed in a perched manner, the pipes shall be removed and re- installed correctly. Placement of culverts and other structures in waters, streaats, and wetlands must be placed below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow low flow passage of water and aquatic lire.
