The subdivision was previously permitted in 2008 and mitigation approved for the Cary Branch crossing. The USACE agreed to 1:1 mitigation with on-
site preservation (see attached preservation maps). The EEP mitigation invoiced, but not paid since the impacts did not occur. The applicant proposes
the same mitigation approach for this renewal (2:1 via 1:1 on -site preservation 81:1 EEP payment). An updated EEP acceptance letter is attached
along with a revised "Preservation Area' map. The "Preservation Area" includes over 9 acres of riparian buffers (a minimum of 30 ft. wide and larger,
up to 50 ft., where possible) 8 5,486 ft. of streams. This results in approximately an 18:1 ratio of preservation to impact, more than approved in 2008.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above refferenced project as indicated in the table below. Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved. You must also comply with all other state federal or local government permits. regulations or authorizations associated
with the proposed activity including SL 2009 -337• An Act to Promote the Use of Compensatory Mitigation Banks as amended by
S.L. 2011 -343.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certitication/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the penmit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In-
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you in your request to use the NCEEP, the impacts that may require compensatory mitigation are
summarized in the following table. The amount of mitigation required and assigned to NCEEP for this impact is determined by
pe itting agmenc ies and may exceed the impact amounts shown below.

remaining streams as shown in the Preservation Map for IPG/Stonemont LLC (dated 10/112M (see permit

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
conditions and your submitted plans. Any violation of the attached conditions or deviation from your submitted plans may subject the
permittee to a stop work order, a restoration order and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified,
suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or
modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of
the modified nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the
activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are
under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the
activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Quality (telephone [phone]) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA),
prior to beginning work you must contact the N.C. Division of Coastal Management.
This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required Federal,
State or local approvaWpermits.

Permit Condition: In order to compensate for impacts to 149 linear feet of warm water stream the permittee shall make payment
to the North Carolina Ecosystem Enhancement Program (NC EEP) in the amount determined by the NC EEP, sufficient to perform the
restoration of IMinear feet of warm water strearrr in the Cape Fear River Basin, Cataloging Unit 03030004

Construction within jurisdictional areas on the property shall begin only after the permittee has made full payment to the NC EEP and
provided a copy of the payment documentation to the Corps, and the NC EEP has provided written confirmation to the Corps that it
agrees to accept responsibility for the mitigation work required, in compliance with the MOU between the North Carolina Department
of Environment and Natural Resources and the United States Army Corps of Engineers, Wilmington District, dated November 4,
1998.
In addition to payment to EEP, the pernrittee shall execute and cause to be recorded in the Wake County Register of Deeds restrictive
covenants acceptable to the Corps of Engineers for the purpose of maintaining the conservation areas, as shown on the plat
(Preservation Map For IMStonemont, LLC, 101112008), in their natural state in perpetuity, prior to the sale or conveyance of any
lots or other property within the subdivision. The permittee shall enforce the terms of the restrictive covenants and prior to
conveyance of the property, shall take no action on the property described in the covenants inconsistent with the terms thereof. The
permittee shall provide a copy of the recorded restrictive covenants to the Corps of Engineers within 15 days of recording

adjacent to or upstream and down stream of the above structures. All sediment and erosion
control devices shall be removed and the nataral grade restored within two (2) months of the date
that the Division of Land Resources or locally delegated program has released the project.
6. Written Stormwater Management Plan
The final, written stormwater management plans received by DWQ on July 9, 2008 with revisions
received on July 23, 2008 and July 25, 2008 (including a signed aid notarized Operation and
Maintenance Agreement dated July 9, 2008), must be impledented end the stormwater
management facilities shall be constructed and operational before any permanad building is
occupied at the subjex site. The structural stormwater pragUees as approved by this Office as well
as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater
practices shall be made without written authorization from the Division of Water Quality.
Additionally, stormwater easements shall be recorded for it distance of at lease 10 feet on each
side of all stormwater conveyances on d)1 lots containing these structures including fature access
for maintenance.
7. Culvert Instalhition
All work in or adjacent to stream'wateis shall be conducted in a dry work area. Approved BMP
measures from the most current version of NCDOT Construction and Maintenow Activities manual
Qtttn:MMtncdoLgMMoh1oRKAons1BMP mimialAmallonsiffibg Mr anual � such as sandbags,
rock berms, cofferdams and other diversion structures shall be used to prevent excavation in flowing
water.
Culverts required for this project shall be installed in 'such a manner that the original stream
profiles are not altered. Existing stream dimensions (including the cross section dimensions,
pattern, and longitudinal profile) must be maintained above and below locations of each culvert.
Culverts shall be designed and installed to allow for aquatic Gib movement as well as to prevent
head cutting of the streams. If any of the existing pipes are or become perched, the appropriate
stream grade shall be re-established or, if the pipes installed in a perched manner, the pipes shall
be removed and re- installed correctly.
Placement of culverts and other structures in waters, streaats, and wetlands must be placed below
the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches,
and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow
low flow passage of water and aquatic lire. Design and placement of culverts and other structures
including temporary erosion control mo4sum shall not be conducted in a manner that may result
in dis- equilibrium of wetlands or stream or banks, adjacent to or upstream and down stream
of the above structures. The applicant is requited to provide evidence that the equilibrium shall be
maintained if requested in writing by DWQ. t
S. if concrete is used during the construction, then a dry work area should be maintained to prevent
direct contact prevent direct contact between curing concrete and stream water. Water that
inadvertently contacts uncured concrete should net be discharged to surface waters due to the
potential for elevated pH and possible aquatic 1Wfish kills.
9. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and airy subsequent modifications, the applicant is required to return the atttached

certificate of completion to the 401 OversighdE.xpress Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27698 -1650.
10. Protective Fencing
The outside bufFer, wetland or water boundary and along the construction corridor within these
boundaries approved under this authorization shag be clearly marlod with orange warning fencing
(or similar high' visibility material) for the areas that have been approved to infringe within the
buffer, wetland or water�prior to any land disturbing activities to ensure compliance with OC 3705.
11. Deed Notifications
Deed notifications or similar mechanisms shall be placed on all retAhM jurisdictional wedands,
waters and riparian buffers in order to amu re compliance for firture wetland, water and riparian
buffer impact. Than mechanisms shall be put in place prior to impacting any wetlands and/or
waters approved for impact under this Certification Approval.
12. Notification of Construction
The applicant and/or authorized agent shall contact the DWQ Express Review Program in writing
at the tettediesd address within ten (10) days of the commencement of construction.
The applicant/permittee and their authorized agents shall conduct all activities in a manner consistent with
State water quality standards (including any requh meats resulting them compliance with 1303(d) of the
Clean Water Actj, and any other appropriate requirements of Stubs and Federal Law. If the Division
determines that such standards or laws are not being met, including failure to sustain a designated or
achieved use, or that State or- Federal law is being violated. or that flatter conditions are necessary to
assure compliance, then the Division may reevaluate and troth$► this General Wader Quality Certification.
Violations of any condition herein MA !111`111 may result in revocation of this Certification and may result in
criminal and/or civil penalties. The au *orezetkm to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program ( NCEEP) is willing to accept
payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will
be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these
agencies to determine if payment to the NCEEP will be approved.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 PermW401 CertiBcation/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work The amount of the in
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following
table.
Upon receipt of payment, REP will take responsibility for providing the compensatory mitigation. If the regulatory agencies require
mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the
