1.0 Introduction
The Bells Bridge Nutrient Offset Parcel ("Parcel" or "Site") is proposed under the terms and conditions of
the proposed Roseneath Nutrient Offset Umbrella Banking Instrument jUBlj, which will be made and
entered into by Restoration Systems, LLC (RS), acting as Bank Sponsor (Sponsor), and the North Carolina
Department of Environmental Quality (NCDEQ), Division of Water Resources (DWR). The Parcel shall be
planned and designed according to the UBI, 15A NCAC 02B .0703, and the Consolidated Buffer Mitigation
Rule 15A NCAC 02B .0295.
Located in Halifax County North Carolina, the land within the Parcel encompasses 44.71 acres of riparian
buffers and other riparian areas that are actively utilized for row crop production. The project will restore
the riparian areas along two (2) unnamed tributaries and one (1) surface water conveyance (ditch) with a
direct hydrologic connection to Deep Creek, a tributary to the Tar River. The primary purpose of the Parcel
is to provide nutrient offset credits for stormwater and wastewater requirements within the United States
Geological Survey (USGS) Cataloging Unit 03020102.
The Parcel is located between Scotland Neck and Hobgood, approximately 1.5 miles east of the town of
Roseneath in Halifax County, INC (Figure 1, Appendix A). Two sisters, whose maiden names are Janet and
Mary Pat White along with their spouses are the current fee -simple owners of a single tract of land
associated with the Bank Parcel, which has been historically and is currently used as agricultural fields
with minimal areas currently existing as forested wetlands and riparian buffers. The Parcel is within the
Tar -Pamlico River Basin 14-digit U5G5 Cataloging Unit 03020102070030 of the Middle Atlantic Coastal
Plain (North Carolina Division of Water Quality [NCDWQj 5ub-basin Number 03-03-04j (Figure 1, Appendix
A).
2.0 Nutrient Offset Project Summary
2.1 Project Goals
The major goals of the proposed nutrient offset project are to provide ecological and water quality
enhancements to the Tar-PamIic❑ River Basin by restoring the riparian area to create a functional riparian
corridor. Specific enhancements to water quality and ecological processes are outlined in Table 1.

2.2 Existing Parcel Conditions
The proposed nutrient offset project includes approximately 44.71 acres of forested and open agricultural
fields along unnamed tributaries to Deep Creek. The agricultural fields are currently being used for row
crop production including cotton, corn, and peanuts. The farmer regularly applies fertilizers and herbicides
to the fields (Figure 3, Appendix A).
Site features predominantly originate on site and all drain to Deep Creek less than 1 mile downstream.
Review of historic aerials show the property has been historically and consistently utilized for row crop
production.

DWR performed an onsite visit to the Parcel to determine applicability to the Tar -Pamlico Buffer Rules
(15A NCAC 02B .0734) and viability to provide nutrient offset credits on December 2, 2020. A stream
determination letter for the Parcel was provided on January 22, 2021 and a site viability for buffer &
nutrient offset letter was provided on February 12, 2021. A copy of the letters is provided in appendix B.
A Summary of their determinations, specific to Parcel Features, is shown in Table 3, and correlated with
stream segments as labelled in Figure 3, Appendix A. There have been no changes to land use in the project
area since DWR's site visit.

2.3 Watershed Characterization
The Parcel is located within USGS HUC 03020102 and DWR Subbasin 03-03-04. Features drain to Deep
Creek which is classified as C and NSW by DWR. Class C waters are designated for recreational use,
agriculture, fishing and fish consumption, and the maintenance of biological integrity for wildlife. The NSW
designation applies to surface waters that are experiencing excessive growths of microscopic or
macroscopic vegetation.
The Parcel topography, as indicated on the Hobgood, NC USGS 7.5-minute topographic quadrangle, shows
gently sloped areas throughout the Parcel (Figure 4). Land uses draining to the project reaches are
primarily agriculture with some forested use.
2.4 Soils
The Parcel is mapped by the Halifax County Soil Survey. Project soils are described in Table 4. An image of
the paper copy of the 2006 Soil Survey of Halifax County is provided in Figure 5, Appendix A. A custom soil
report is provided in Appendix C.

2.5 Geology
The Parcel is in the Inner Coastal Plain physiographic province. The landscape is characterized by flat lands
to gently rolling hills and valleys. Parcel elevations range from 74 to 96 feet above sea level. The Coastal
Plain largely consists of marine sedimentary rocks comprised of sand, clay, and limestone that formed
through the deposition of estuarine and marine sediments within the last 140 million years. According to
the Geologic Map of North Carolina (1985), the underlying geology of the proposed mitigation site is
mapped as the Yorktown and Duplin Formations. The Yorktown Formation is described as fossiliferous
clay with varying amounts of fine-grained sand, bluish gray shell material commonly concentrated in
lenses, mainly in areas north of the Neuse River. The Duplin Formation is she Ily, medium to coarse grained
sand and sandy marl.
2.6 Existing Vegetative Communities
Existing vegetation within the Parcel is primarily comprised of active row crop fields of cotton with narrow
streamside thickets as shown in the attached site photos taken March 16, 2021.
2.7 Threatened and Endangered Species
The NC Natural Heritage Program (NHP) database and the U5 Fish and Wildlife Service (USFWS) database
were searched for federally listed threatened and endangered plant and animal species in Halifax County,
NC. Five species, the Neuse River Waterdog, Carolina Madtom, Atlantic Pigtoe, Tar River Spinymussel, and
Bells Bridge Bank Parcel Development Plan (DWR ID#: 2020-1664v2) Pg.3

Yellow Lance are listed or proposed for listing as federally endangered or threatened species. Restoration
Systems performed pedestrian surveys of the Parcel in December 2020 and determined there was no
suitable habitat for the species. The USFWS Self -Certification Letter and USFWS concurrence is included
in Appendix E.
The presence of conditions or characteristics that have the potential to hinder restoration activities on
the Parcel were evaluated. The evaluation focused primarily on the presence of hazardous materials,
utilities and restrictive easements, rare/threatened/endangered species or critical habitats, the potential
for hydrologic trespass, and existing utility easements. Existing information regarding Parcel constraints
was acquired and reviewed including an Environmental Records Report developed by Environmental Data
Resources Inc. which located no evidence of environmental risk associated with the Parcel (Appendix D).
In addition, any Parcel conditions that have the potential to restrict the restoration and implementation
were documented during the field investigation. As a result of our review and field surveys, no known
Parcel constraints exist that may hinder proposed restoration activities. Potential constraints reviewed
include the following;
2.8 Cultural Resources and Significant Natural Heritage Areas
There are no existing structures in the project area or on the larger tract of land. SHPO was contacted with
request for review and comment on February 25, 2021 an replied on March 31, 2021 with no comment.
All communication with SHPO is included in Appendix F.
2.9 FEMA Floodplain Compliance
No grading activities are proposed in the floodplain, so a floodplain development permit will not be
required. No hydraulic modeling is proposed for this project. A FEMA Map of the project is provided in
Appendix G.
2.10 Parcel Location, Parcel Constraints, and Access
The Parcel is in rural Halifax County, near the town of Hobgood (Figure 2). The Parcel is accessible for
construction, monitoring, and long-term stewardship from Bells Bridge Road (Figure 3). An access road
and associated access easement will be detailed in the final conservation easement survey and recorded
at the Halifax County Register of Deeds. DOT right of ways, powerlines, and associated easements will be
excluded from the conservation easement.
2.11 Other Environmental Conditions
An Environmental Data Resources, Inc (EDR) Radius Map Report with Geocheck was ordered for the Parcel
on February 25, 2021. Neither the target property not the adjacent properties were listed in any of the
Federal, State, or Tribal environmental data bases searched by EDR. The executive summary of the EDR
report is included in the Appendix D.
3.0 Site Protection Instrument
The land required for planting, management, and stewardship of the mitigation project includes portions
of the larger tract of land listed in Table 5. The Parcel will remain in private ownership, protected in its
entirety by an approved DWR long term steward and will be managed under the terms detailed in an
approved DWR conservation easement.

4.0 Nutrient Offset Work Plan
The project will restore agriculturally impacted land in the Parcel footprint to a forested riparian corridor,
protected in perpetuity, improving the ecological function of the area. The project design will ensure that
no adverse impacts to wetlands or existing riparian buffers occur. Figure 6, Appendix A, illustrates the
conceptual design for the Parcel. The width of riparian restoration areas used to generate nutrient offset
credits will be a minimum of 50ft and maximum of 200ft from the top of bank on either side of streams
and/or ditches.
4.1 Parcel Preparation
The land use within 200 feet from the top of bank of the project features is either forested and will not
be impacted or has been maintained and cleared for row crops. There is a soil path along Feature Ea and
Eb that will be removed. Site preparation will include ripping the entire site (including soil path) to break
up soil compaction and the application of select herbicide treatments and/or limited mechanical clearing
to remove undesirable vegetation. Where needed, invasive species will be selectively removed and/or
spot treated by a licensed pesticide applicator. Any drain tiles found in the conservation easement area
during survey and/or planting of the project will be sealed.
4.2 Riparian Area Restoration Activities
Riparian area restoration will involve planting appropriate native tree species along the 200-foot-wide
riparian corridor of streams and hydrologically connected ditches at a density of 680 stems per acre on
8ft x 8ft spacing. Vegetation management and herbicide applications may be needed over the first few
years of tree establishment in the riparian restoration areas to prevent encroachment of undesirable
species that may out -compete the planted native vegetation. Tree species planted across the riparian
areas of the Parcel will include those listed in Table 6. Stems will be mixed prior to planting to ensure
diversity of bare roots across the planted area. A seed mix including the species listed in Table 7 will aIs❑
be applied to provide temporary and permanent ground cover for soil stabilization and reduction of
sediment loss during rain events in areas without existing herbaceous cover. Planting is tentatively
scheduled for February 2022.

Trees will be planted at a density sufficient to meet the performance standards outlined in Rule 15A NCAC
02B .0295 of 250 planted trees per acre at the end of five years of monitoring. No one tree species will be
greater than 50% of the established stems. Planting is tentatively scheduled for February 2022.
5.0 Monitoring and Maintenance Plan
5.1 Monitoring Protocol
Permanent vegetation monitoring plots will be installed and evaluated within the riparian restoration area
to measure the survival of the planted trees. The plots will be randomly placed throughout the planted
riparian area and will be representative of the Nutrient Offset Credit areas. A total of 29 plots (2% of the

planted area) will be established within the riparian restoration areas (Figures 6, 6A, and 6B, Appendix A).
The size of individual quadrants will be 100 square meters.
Qualitative and quantitative vegetation assessments will be conducted and follow the Carolina Vegetation
Survey (CVS) Level 2 Protocol for Recording Vegetation (2008). A reference photo will be taken from the
southwestern corner of each of the 29 plots. Photos will be taken from all photo points each monitoring
year and provided in the annual reports. All planted stems will be marked with flagging tape and recorded.
Planting is scheduled for February 2022. The first annual monitoring activities will commence at the end
of the first growing season, at least five months after planting has been completed and no earlier than the
fall season. Species composition, height, and survival rates will be evaluated on an annual basis by plot.
The total number of volunteer woody stems will also be documented and reported. The measure of
vegetative success for the parcel will be the survival of at least four native hardwood tree species, where
no one species is greater than 50% of the established planted stems, and an established density of at least
260 planted trees per acre at the end of monitoring year five. Appropriate and desirable native volunteer
species may be included in the ParceI's density to meet the performance standards with DWR approval.
Restoration Systems shall submit the annual monitoring report to DWR by December 315L of each year far
five consecutive years and will follow the terms and conditions of Roseneath Nutrient Offset Umbrella
Banking Instrument (UBI).
5.2 Parcel Maintenance
If the Parcel or a specific component of the Parcel fails to achieve the success criteria outlined in Section
5.1, adaptive measures will be developed and/or appropriate remedial actions will be implemented. Site
maintenance will be performed to correct any identified problems on the Parcel that have a high likelihood
of affecting the project success. Such items include, but are not limited to, fire, flooding, drought, or
insects that cause excess tree mortality. Any actions implemented will be designed to achieve the success
criteria and will include a work schedule and updated monitoring criteria. Any parcel maintenance
performed will be included in the monitoring report for that year. A rigorous herbicide schedule may need
to be implemented in the first few years of tree establishment in the restoration areas to prevent
establishment of invasive species that may out -compete the planted native vegetation. The only
herbicides used on the Parcel will be aquatic approved herbicides that will be applied in accordance with
North Carolina Department of Agriculture rules and regulations.
The easement boundary will be checked annually as part of monitoring activities. Easement boundary
conditions as well as any maintenance performed will be reported in the annual monitoring reports to
DWR. If mowing is deemed necessary by the Sponsor during the monitoring period, the Sponsor must
receive approval from DWR prior to conducting any mowing activities within Tar -Pamlico Buffer Zones 1
and 2 to ensure that no buffer violations have occurred.
5.3 Parcel Protection & Easement Boundaries
Easement boundaries will be identified in the field to ensure clear distinction between the Parcel and
adjacent properties. Boundaries may be identified by fence, marker, post, tree -blazing, or other means as
allowed by site conditions and/or conservation easement and will be clearly marked prior to the Task 2
site visit by DWR. Boundary markers that have been disturbed, damaged, or destroyed will be repaired
and/or replaced on an as needed basis. Contact information for the conservation easement holder will be
included on easement markers. A complete and detailed survey of the easement boundaries will be
included in the As -Built Report.

6.0 Financial Assurances and Long -Term Management
6.1 Financial Assurances
IRS will secure all financial assurances according to the approved UBI. No bond shall be less than $150,000
to cover costs of construction and no less than $100,000 initially, to cover monitoring expenses.
Performance bonds for monitoring shall be renewed at least annually to cover the next years monitoring
period, with confirmation of renewal provided to DWR with each annual monitoring report when
applicable. DWR reserves the right to alter the credit release schedule if monitoring reports are submitted
without proof of bond renewals when applicable.
6.2 Long Term Management Plan
The Parcel will remain in private ownership, protected in its entirety by an approved DWR long term
steward, and will be managed under the terms detailed in an approved DWR conservation easement. The
long-term manager will be responsible for periodic inspection of the Parcel to ensure that the restrictions
documented in the recorded easement are upheld in perpetuity.
7.0 Nutrient Offset Potential
Of the approximately 44.71 acres protected under the conservation easement 1,539,311 square feet are
anticipated to provide Nutrient Offset Credits (Figure 6, 6A, and 6B). Riparian area restoration from the
top of bank on Parcel ditches and streams to a minimum of 50-feet and maximum width of 200-feet
from top of bank of Parcel streams and ditches will generate Nutrient Offset Credit and will not be
transferable to Riparian Buffer Credit per the approved UBI. Nitrogen and Phosphorous offset credits
will be generated from the site and shown on separate ledgers. The complete DWR Mitigation Credit

on -site review of features located on the subject property at the request of Restoration Systems,
LLC to determine the applicability to the Tar -Pamlico Riparian Area Protection Rules (15A NCAC 02B
.0734).
The enclosed map(s) depict the feature(s) evaluated. This information is also summarized in the
table below. Streams that are considered "Subject" have been located on the most recently
published NRCS Soil Survey of Halifax County and/or the most recent copy of the USGS Topographic
(at 1:24,000 scale) map(s), have been located on the ground at the site, and possess characteristics
that qualify them to be at least intermittent streams. Features that are considered "Not Subject"
have been determined to not be at least intermittent or not present on the property or not
depicted on the required maps.
This determination only addresses the applicability to the buffer rules and does not approve any
activity within buffers or within waters of the state. There may be other streams or features
located on the property that do not appear on the maps referenced above. Any of the features
on the site may be considered jurisdictional according to the US Army Corps of Engineers and
subject to the Clean Water Act.

On November 3, 2020, Katie Merritt, with the Division of Water Resources (DWR), received a
request from you on behalf of Restoration Systems, LLC (RS) for a site visit near the above -
referenced site in the Tar -Pamlico River Basin within the 8-digit Hydrologic Unit Code 03020102.
The site visit was to determine the potential for riparian buffer mitigation and nutrient offset within a
proposed Easement Boundary, which is more accurately shown in the attached maps labeled "Bells
Bridge Overview" (Figure 1) prepared by RS and edited by DWR. On December 2, 2020, Ms.
Merritt performed a site assessment of the subject site. Staff with RS were also present.
Ms. Merritt's evaluation of the features onsite and their associated mitigation determination for the
riparian areas are provided in the table below. This evaluation was made from Top of Bank (TOB)
and landward 200' from each feature for buffer mitigation pursuant to 15A NCAC 02B .0295
(effective November 1, 2015) and for nutrient Offset credits pursuant to 15A NCAC 02B .0703.

Determinations provided in the table above were trade using a proposed easement boundary showing
proposed mitigation areas shown in Figure 1. Maps representing the proposal for the site are
attached to this letter and are initialed by Ms. Merritt on February 16, 2021. Substantial changes to
the proposed easement boundary could affect the Site's potential to generate buffer and nutrient
offset credits.
This letter does not constitute an approval of this Site to generate buffer and nutrient offset credits.
Pursuant to 15A NCAC 02B .0295, a mitigation proposal and a mitigation plan shall be submitted to
DWR for written approval prior to conducting any mitigation activities in riparian areas and/or
surface waters for buffer mitigation credit. Pursuant to 15A NCAC 02B .0703, a proposal regarding a
proposed nutrient load -reducing measure for nutrient offset credit shall be submitted to DWR for
approval prior to any mitigation activities in riparian areas and/or surface waters.
All vegetative plantings, performance criteria and other mitigation requirements for riparian
restoration, enhancement and preservation must follow the requirements in 15A NCAC 02B .0295 to
be eligible for buffer and/or nutrient offset mitigation credits. For any areas depicted as not being
viable for nutrient offset credit above, one could propose a different measure, along with supporting
calculations and sufficient detail to support estimates of load reduction, for review by the DWR to
determine viability for nutrient offset in accordance with 15A NCAC 02B .0703.
This viability assessment will expire on February 16, 2023 or upon approval of a mitigation
plan by the DWR, whichever comes first. This letter should be provided in any nutrient offset,
buffer, stream or wetland mitigation plan for this Site.

The EPA has set ambitious goals for the RCRA Corrective Action program by creating the 2020 Corrective Action
Universe. This RCRA cleanup baseline includes facilities expected to need corrective action. The 2020 universe
contains a wide variety of sites. Some properties are heavily contaminated while others were contaminated but
have since been cleaned up. Still others have not been fully investigated yet, and may require little or no remediation.

When Congress passed the Clean Air Act Amendments of 1990. it required EPA to publish regulations and guidance
for chemical accident prevention at facilities using extremely hazardous substances. The Risk Management Program
Rule (RMP Rule) was written to implement Section 112(r) of these amendments. The rule, which built upon existing
industry codes and standards, requires companies of all sizes that use certain flammable and toxic substances
to develop a Risk Management Program, which includes a(n): Hazard assessment that details the potential effects
of an accidental release, an accident history of the last five years, and an evaluation of worst -case and alternative
accidental releases; Prevention program that includes safety precautions and maintenance, monitoring, and employee
training measures; and Emergency response program that spells out emergency health care, employee training measures

Uranium ore was mined by private companies for federal government use in national defense programs. When the mills

The EDR Proprietary Manufactured Gas Plant Database includes records of coal gas plants (manufactured gas plants)
compiled by EDR's researchers. Manufactured gas sites were used in the United States from the 1800's to 1950's
to produce a gas that could be distributed and used as fuel. These plants used whale oil, rosin, coal, or a mixture
of coal, oil, and water that also produced a significant amount of waste. Many of the byproducts of the gas production,
such as coal tar (oily waste containing volatile and non-volatile chemicals), sludges, oils and other compounds
are potentially hazardous to human health and the environment. The byproduct from this process was frequently
disposed of directly at the plant site and can remain or spread slowly, serving as a continuous source of soil
and groundwater contamination.

The species list generated pursuant to the information you provided identifies threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by
your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife
Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended
(16 U.S.C. 1531 et seq.).
New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could change this list. Please feel free to
contact us if you need more current information or assistance regarding the potential impacts to
federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the
Act, the accuracy of this species list should be verified after 90 days. This verification can be
completed formally or informally as desired. The Service recommends that verification be
completed by visiting the ECOS-IPaC website at regular intervals during project planning and
implementation for updates to species lists and information. An updated list may be requested
through the ECOS-IPaC system by completing the same process used to receive the enclosed list.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally -listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally -protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

web site often for updated information or changes
If your project contains suitable habitat for any of the federally -listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
I€ you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally -protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require
development of an eagle conservation plan (bttp:llwww.fws.gov/windenergy/
eagle_guidance.html). Additionally, wind energy projects should follow the wind energy
guidelines(http://www.fws.gov/windenergy/) for minimizing impacts to migratory birds and
bats.

(SHPO) for the Bell's Bridge Mitigation Project in Edgecombe County, a Nutrient Off -set Mitigation Bank
servicing the Tar -Pamlico River Basin. Please review and comment on any possible issuesthat might emerge
with respect to SHPO from a potential stream restoration project depicted on the attached mapping.

Project Description: The project has been identified for the purpose of providing in -kind mitigation for
unavoidable nutrient loading impacts. Permits from the NC DWR will be obtained to restore riparian buffer
areas that drain into waters of the U5. Soil and erosion control permits will also be obtained. The project
encompasses 45.35 acres of agricultural fields, currently used for row crops. All 45.35 acres of riparian buffer
area will be replanted in native hardwoods.
The term "cultural resources" refers to prehistoric or historic archaeological sites, structures, or artifact
deposits aver 50 years old. "Significant" cultural resources are those that are eligible or potentially
eligible for inclusion in the National Register of Historic Places. Evaluations of site significance are made
with reference to the eligibility criteria of the National Register (36 CFR 60) and in consultation with the
North Carolina State Historic Preservation Office (SHP0).
Field visits were conducted in the fall of 2020 to conduct evaluations for presence of structures or
features that may be eligible for the National Register of Historic Places. No structures were identified
within the parcel boundaries. In addition to field reviews for historically relevant structures, a records
search was conducted at the SHPO office to determine if documented occurrences of historic structures
or artifacts occur within, or adjacent to the Site. The SHP❑ records identify no features within the parcel
boundaries and four features within a 1.0-mile radius of the Site.
