The State has come up with methodology to determine the quality of a stream or wetland. Like previously stated, the
Corps will assume the impacted aquatic feature as high quality until the applicant provides a quality assessment such as
North Carolina Wetland Assessment Methodology or North Carolina Stream Assessment Methodology. To date, the
applicant has failed to provide this assessment methodology to the Corps.

Thank you for coming out to visit the Alexander Farms site and conveying me your concern on Monday. I believe we
both agreed that the wetland in question is of poor quality and the result from the adjacent property retention pond
outfall. I spoken with my Client and he is going to get the riprap information to me from his engineer that you
requested. I was hoping it was on some of the plans that they provided me but they were only schematic drawings of
the design, without the specific quantities or profiles. I am hoping to get them soon.

Dear Mr. Perez:
Below are my Client's mitigation efforts and clarification for their site planning to avoid and minimized impacts to the
delineated aquatic features to the extent practical.

• Avoided the majority of the higher quality delineated stream and wetland areas. The proposed parking lot is
impacting the low quality wetland aquatic areas that are predominantly vegetated by the invasive species,
Microstegium vimineum (Japanese silt Grass), which is listed on the NC Invasive Plant Council; (see attached
pictures), but maintained the downstream hydrology of the stream by rerouting the water flow through a storm
water drainage system (bypass);
• The impacted wetland area is the result of runoff created by adjacent property retention pond and storm water
system North of the proposed project, in addition to roadside ditches runoff along the western property
boundary, See attached survey circled areas;
• The present proposed parking lot location was selected to minimize impacts to a higher quality aquatic features
to the East, downstream of the location;
• The proposed parking lot dimension is to accommodate the parking requirements per the City of Cornelius
zoning and building regulations and code ordinances for the Active Adult building;
• The proposed project construction plans will be utilizing retaining walls and are located in several areas to
minimize and to completely avoid sensitive resource impacts. See attached.
• A sixty foot buffer(30' in each direction from the centerline of the stream) is being utilized to mitigate protection
to the existing downstream stream channel and wetland features; and
• Construction design plans will implement the installation of a bottomless culvert to avoid disruption of any other
stream and wetland areas impacts further downstream where Road E crosses.
I would gladly meet with you for a site visit, if you feel it is warranted. I am available on Monday, October 4, 2021. Your

Ms. Nayda-St. Clair,
As far as avoidance and minimization, I am finding issues with paving over the wetland for a parking lot. Would a
retaining wall not work better for reducing the impact to the stream? Also, the wetland appears to be the headwaters of
the channel. Any BMP that is put in, should be as close to the top as possible. Similarly, any rip -rap apron should be
included in the impacts, if it hasn't been already. I feel that the stormwater BMP's and building spacing could be re-
worked to reduce the impacts to the wetlands and stream.
As far as mitigation goes, while the Corps might only require mitigation for the wetlands, we will require it for both the
wetlands and the stream.

In accordance with 15A NCAC 02H .0506(c) and 15A NCAC 02H .1305(c), the DWR requires compensatory mitigation for
losses of streams and wetlands (404jurisdictional wetlands as well as isolated and other non-404jurisdictional
wetlands) as follows:
• For linear public transportation projects, mitigation shall be required for impacts equal to or exceeding 300
linear feet per perennial stream or 0.10 acre of wetlands.
• For all other projects, mitigation shall be required for impacts equal to or exceeding 300 linear feet of perennial
streams or impacts equal to or exceeding 0.10 acre of wetlands.
All this being said, I feel that a site visit might be in order to assess the wetlands and the stream. I have availability on
Monday (10/6), Tuesday (10/5), Monday (10/11), Tuesday (10/12), or Wednesday (10/13). Let me know you availability.

Hello Mr. Perez:
I have inherited this project from Patrick Korn prior to his departure. I work in Terracon's Columbia, South Carolina
office. Unfortunately, the information pertaining to the mitigation was not conveyed to me. I am preparing the
migration request and form to be sent to Ms. Kelly Williams.
As for the impacts, the 0.18 acres of wetlands (W1 and W2) and 347 LF of original stream bed (P1) will be filled to allow
development of a proposed parking lot and for the "by-pass storm drainage pipe network" . Therefore, the proposed
"by-pass storm drainage pipe network" is to rerouted Stream (P1) downstream flow through the bypass network to
allow for fill to develop the proposed parking lot and impacts to Stream P1's original channel. This bypass storm
drainage network will maintained the Stream (P1) hydrological connection to the its original channel east of the eastern
outlet storm drainage connection. I have attached the proposed site plans layout with the Stream P1 original stream bed
impact location highlighted in red.
Based on the USACE comments, mitigation is only needed for the Wetlands 1 (.02 ac) and 2 (0.16 ac) located west of the
original stream bed (P1) with a total fill of 0.18 acre of permanent impact.

Mr. Roden -Reynolds been addressed? If so, I need to see the documentation for it and attach it to your file. Similarly, I
see no attached letter from DMS for mitigation for us (DWR) for both the 0.18 acres of proposed wetlands impact as
well as the 347 linear feet of permanent perennial stream impact. Also, if you could explain why the "bypass storm
drainage pipe network" needs to go where it has been proposed as well as why the wetlands need to be filled exactly,
that would be most appreciated.
