Charlotte - Mecklenburg Storrn Water Services (CMSWS) is hereby submitting to the U.S.
Army Corps of Engineers (USACE) and North Carolina Division of Water Resources
( NCDWR) a notification of design modification for the Parkwood Storm Drainage
Improvement Project. The Department of the Army Individual Permit authorization
(USACE Action ID 2012 - 01562) was issued on May 6, 2013 and the NCDWR Individual
Water Quality Certification (DWQ# 12 -1146) was issued on March 15, 2013.
The plan revision occurs on Sheet 5 of the previously submitted plan set, which is now
Sheet 6 of the modified plan set (app. STA. 24 +50 to STA. 25 +70). The revision entails
installing a retaining wall along the right bank, from the endwall of the Davidson Street
culvert to the approximate location of the existing slab bridge (to be removed). The
original plans called for laying back and planting the right bank along this reach. This
would adversely affect the wrecker /garage business at this location, which uses the
parking lot in this area to access the rear of the property and to provide room to access the
adjacent garage bays (see Area of Concern Map, enclosed). The revised plan proposes to
grade a bankfull bench, lay back the upper bank, and install a retaining wall at the top of
bank. The banks inside the retaining wall will be planted with native woody vegetation.
Please note that the retaining wall is located at the approximate location of the edge of the
existing parking lot. In addition, the proposed retaining wall is located approximately 15-

20 feet (laterally) away from the bankfull bench and 2 -4 feet (horizontally) above the
elevation of the bankfull bench.
Given all of these factors, CMSWS contends that the wall is not located within the
ordinary high water mark (OHWM) and therefore does not constitute additional
impacts to the stream channel. Furthermore, the original cross section
improvements and bioengineering measures are being maintained from the original
plan submittal, and therefore, activities along this reach should still meet the
definition of stream enhancement and meet the requirements and conditions of the
existing approvals. For comparison, the Original and Modified Plan Sheets depicting
the plan view, profile, and channel cross sections have been included with this submittal
(enclosed).
