However, the final 4(d) rule (effective as of February 16, 2016), exempts incidental take of northern long-eared bat associated with activities that occur greater than 0.25 miles from a known hibernation site, and greater than 150 feet from a known, occupied maternity roost during the pup season (June 1 — July 31). Based on the information provided, the project would occur at a location where any incidental take that may result from associated activities is exempt under the 4(d) rule. Characteristics of jurisdictional streams in the study area ........................... 6 Natural Resources Technical Report TIP B-5979, Watauga, N.C. 1 December 2019 1.0 INTRODUCTION The North Carolina Department of Transportation (NCDOT) proposes to replace the Hunting Hills Bridge (#346) on Hunting Hills Lane (SR1644) over the South Fork of the New River (SFNR) with two lanes of bridge and 590 linear feet of road improvement (including the bridge) (TIP B-5979) in Watauga County (Figures 1-3). The following Natural Resources Technical Report (NRTR) has been prepared to assist in the preparation of a document for the purposes of the National Environmental Policy Act (NEPA). 2.0 METHODOLOGY All work was conducted in accordance with the NCDOT Environmental Coordination and Permitting’s Preparing Natural Resources Technical Reports Procedure and the latest NRTR Template November 2017. Field work was conducted on September 4-5, 2019 and November 15th, 2019. One jurisdictional feature, the SFNR was identified in the Project Area (Figures 2 and 3), and the jurisdictional boundary of the feature was flagged for survey and mapping. No field verification meetings were held; a JD package will be submitted with the project’s 404 permit application. Documentation of this jurisdictional determination is provided in Appendix D. The principal personnel contributing to the field work and document is provided in Appendix B. 3.0 TERRESTRIAL COMMUNITIES Two terrestrial communities were identified in the study area, excluding the jurisdictional feature identified within the study area (Figure 4), the South Fork New River (SFNR). Figure 4 shows the location and extent of these terrestrial communities. Terrestrial community data are presented in the context of total coverage of each type within the study area (Table 1). Gray Bat USFWS optimal survey window: May 15 – August 15 (summer); January 15 – February 15 winter Biological Conclusion: No Effect This species lives in colonies in caves, utilizing different caves for summer roosting and winter hibernating. This habitat does not occur within the Project Area. The underside of the existing bridge structure was inspected on September 5th, 2019 in mid-morning. No bat sign or roosting individuals were observed. Furthermore, a review of NHP records on or updated April 2019 indicates no known occurrences within 1.0 mile of the study area. Northern Long-eared Bat USFWS optimal survey window: June 1 – August 15 Biological Conclusion: Not Required, meets 4(d) rule The study area is not in an area with known hibernacula or maternity roosts. The project has met the criteria for the 4(d) rule and no further action is required. A site review was completed on September 5th, 2019 in mid-morning. No bat sign or roosting individuals were observed. Furthermore, a review of the NCNHP database, updated April 2019, revealed no occurrences within 1.0 mile of the study area. Virginia Big-eared Bat USFWS optimal survey window: May 15 – August 15 (summer); January 15 – February 15 winter Biological Conclusion: No Effect This species occupies caves in the summer and winter. This habitat does not occur within the Project Area. The underside of the existing bridge structure was inspected on September 5th, 2019 in mid-morning. No roosting individuals or colonies of bats were observed. Furthermore, a review of NHP records on or updated April 2019 indicates no known occurrences within 1.0 mile of the study area. Rusty-patched Bumble Bee USFWS optimal survey window: May - September Biological Conclusion: Not Required The USFWS lists RPBB as a historic record for Watauga County, North Carolina. Additionally, the USFWS does not require surveys for RPBB in North Carolina because USFWS assumes the state is unoccupied by RPBB. Natural Resources Technical Report TIP B-5979, Watauga, N.C. 4 December 2019 Spruce-fir Moss Spider & Critical Habitat USFWS optimal survey window: May – August Biological Conclusion: No Effect This species and critical habitat is known to occur >5,000 feet and is characterized by mature Fraser Fir and Red Spruce Forests. This habitat does not occur within the Project Area. Furthermore, a review of NHP records on or updated April 2019 indicates no known occurrences within 1.0 mile of the study area. Blue Ridge Goldenrod USFWS optimal survey window: July - September Biological Conclusion: No Effect The species occurs in the High Elevation Rocky Summit natural community generally at or above elevations of 4,600 ft along cliffs, ledges, balds, and dry rock crevices of granite outcrops of the higher mountain peaks. This habitat does not occur within the Project Area. Furthermore, a review of NHP records on or updated April 2019 indicates no known occurrences within 1.0 mile of the study area. Heller’s Blazing Star USFWS optimal survey window: July - September Biological Conclusion: No Effect The species occurs in the High Elevation Rocky Summit natural community on high elevation ledges, rock outcrops, cliffs, and balds at elevations of 3,500 – 5,999 feet. This habitat does not occur within the Project Area. Furthermore, a review of NHP records on or updated April 2019 indicates no known occurrences within 1.0 mile of the study area. Roan Mountain Bluet USFWS optimal survey window: June - July Biological Conclusion: No Effect The species occurs at high elevation peaks at elevations between 4,200-6,300 feet. This habitat does not occur within the Project Area. Furthermore, a review of NHP records on or updated April 2019 indicates no known occurrences within 1.0 mile of the study area. Spreading Avens USFWS optimal survey window: June - September Biological Conclusion: No Effect The species occurs in areas of exposed to full sun on high-elevation cliffs, outcrops, and bases of steep talus slopes at elevations ranging from 4,300 – 6,300 feet. This habitat does not occur within the Project Area. Furthermore, a review of NHP Natural Resources Technical Report TIP B-5979, Watauga, N.C. 5 December 2019 records on or updated April 2019 indicates no known occurrences within 1.0 mile of the study area. 4.2 Bald and Golden Eagle Protection Act The bald eagle is protected under the Bald and Golden Eagle Protection Act and enforced by the USFWS. Habitat for the bald eagle primarily consists of mature forests in proximity to large bodies of open water for foraging. Large dominant trees are utilized for nesting sites, typically within 1.0 mile of open water. A desktop-GIS assessment of the project study area, as well as the area within a 1.0-mile radius of the project limits, was performed on September 9th, 2019 using 2018 color aerials. The Project Site is adjacent to the SFNR, which winds throughout the 1 mile radius of the Project Area and provides potential nesting and foraging habitat. Since there is foraging and nesting habitat within the review area, a survey of the project study area and the area within 660 feet of the project limits was conducted on November 15th, 2019. No bald eagles or nest sites were observed on the date of survey. As well, a review of the NHP database on April 2019 revealed no known occurrences of this species within 1.0 mile of the project study area. Due to the lack of habitat, known occurrences, and minimal impact anticipated for this project, it has been determined that this project will not affect this species 4.3 Essential Fish Habitat The Project is located in NCDOT Division 11. No Essential Fish Habitat is located in the Study Area. 5.0 WATER RESOURCES Water resources in the study area are part of the SFNR/New River basin [U.S. Geological Survey (USGS) Hydrologic Unit 05050001. One river was identified in the study area (Table 3). The location of the river is shown in Figure 3. Table 3. There are no designated High Quality Waters (HQW) or water supply watersheds (WS-I or WS-II) within or within 1.0 mile downstream of the study area. The North Carolina 2018 Final 303(d) list of impaired waters identifies the SFNR within the study area as an impaired water (not supporting aquatic life) due to “fair” benthos rating (Figure 3). No other surface waters were identified in the study area. Natural Resources Technical Report TIP B-5979, Watauga, N.C. 6 December 2019 6.0 REGULATORY CONSIDERATIONS 6.1 Clean Water Act Waters of the U.S. One (1) jurisdictional stream was identified in the study area (Table 4). The location of this stream is shown on Figures 2 and 3. The jurisdictional stream in the study area has been designated as a cold water stream for the purposes of stream mitigation. Table 4. Classification Compensatory Mitigation Required River Basin Buffer South Fork New River 120 Perennial Undetermined Not Subject Total 120 No jurisdictional wetlands were identified within the study area. 6.2 Construction Moratoria The SFNR (10-1-(3.5)) is not classified as a Trout (Tr) stream by the NC Division of Water resources (Surface Water Classification Mapper, accessed 09/12/2019), however all of Watauga County is designated by the USACE as a Trout watershed. The NC Wildlife Resource Commission (NCWRC) has recommended a moratorium on in-stream work and land disturbance within the 25-foot trout buffer from October 15 – April 15 due to the likelihood of wild brown trout in the project study area. 6.3 N.C.
