This is additional information, adding another tract (Buffkin) to the original submittal. We were
waiting for
Daniels South plans to be completed and combine Daniels South, and Buffkin with previously
submitted Daniels North. However the owners have decided Daniels South will not be constructed, it
will be placed in open space. (I have attached an email from one of the owners stating this.) Don't
hesitate to contact me if any questions.

Wyatt, please let this email confirm our discussion that there will be no impact to the tract of land called
Daniels Southside located off Hwy 210 in the McGee's Crossroads area. This entire tract will be set aside
as open space and whatever offset that Johnston County requires. If you need anything else please don't

Information originally submitted with no revisions has been omitted (USFWS, NC SHPO, etc).
The PCN Info sheet contains the updated info, with revised sections highlighted as Revised from Original
PCN.
Revisions include the total parcels, site plans/impact maps, subdivision plans, JD Request (included is the
Approved JD Request Form), and one additional wetland impact.
Briefly:
Initial delineation conducted 2015, verbal concurrence provided by USACE (David Shaeffer).
Two ponds determined to be upland (excluded) by USACE (Samantha Daley).
Construction begun 2017, without authorization. After the fact impacts are included.
PCN submitted June 2021 requesting authorization for ATF impacts. Future impacts were planned at the
time, but USACE requested permitting of ATF prior to moving forward with additional phases.
Additional Parcel (Parcel #3 Buffkin Tract) added July 2021, post submittal.
USACE Request for entire subdivision to be included in PCN Request.

Project Description and History (revised from Original PCN)
The Daniel Farm subdivision is multi -phase single family residential subdivision, located on NC Hwy 210
in Johnston County, NC. The subdivision consists of 6 separate parcels. The northern three parcels,
which are situated north of Hwy 210, will be developed as housing. The southern three parcels, situated
south of Hwy 210, will be undeveloped and designated as Open Space.
Two of the northern parcels have been cleared and are currently under construction as the Daniel Farm
Subdivision.
Prior to clearing and grading, the property was agricultural use. Adjacent properties are comprised
primarily of single-family residential subdivisions and/or agricultural use.
Total Wetland Acres: 13.558 Total Stream LF: 4,827
Project Purpose:
To construct a single-family residential subdivision with required infrastructure, utilities, and amenities,
to meet high demand in the western Johnston County area.
Project Detail
This submittal is requesting after -the -fact authorization for impacts associated with construction of the
initial phases of the Daniel Farm project. Also included are proposed impacts for additional phases on
Parcel 3, adjacent to the west.
After the fact impacts include two permanent wetland impacts for lot fill, and 4 temporary stream
and/or wetland sewer crossings.
Three of Daniel Farm parcels — 2 north and 1 south - were originally delineated in 2015. Potentially
jurisdictional features included 2 wetlands, 2 streams, and 2 farm ponds on the two northern parcels
where development has already occurred. The JD Info for these three parcels is included with this
submittal.

Subdivision plans including lot layouts, utilities, stormwater, and erosion & sediment control were
prepared and approved by Johnston County Public Utilities in 2017. Roadway and utility construction
began in 2018 and have been completed. Lots were recorded beginning in 2019. Early phases of the
subdivision have been completed, houses have been constructed and are presently occupied.
During construction of Daniel Farm, the following impacts inadvertently occurred:
• Permanent wetland impacts occurred during construction of Street B (as shown on attached
E&SC plans), which extends along the western boundary throughout the subdivision.
Construction of this roadway will permanently impact and remove 0.10 acres of wetlands,
situated near the headwaters of an intermittent stream (Wetland I and Stream 2 on the JD
delineation map). This impact will allow the roadway to continue into developable uplands and
provide access to at least 16 additional lots.
• Temporary stream and wetland impacts occurred Stream 2 and Wetland I during the
construction of a sewer collection line. This construction also required permanent conversion of
forested wetland to herbaceous wetland within a permanently maintained utility corridor
(Stream 2). The temporary impacts have been completed and restored.
Two farm ponds on the site were determined to be isolated and have been converted to stormwater
management ponds. Verification of the isolated determination is included in the JD Packet.
Parcel 3 (the Buffkin Tract) was delineated in 2020 and included as part of the subdivision. Potentially
jurisdictional features include 5 Wetlands and 2 streams. This parcel is currently undeveloped. The JD
Info for Parcel 3 is included with this submittal.

The Daniel Farm Subdivision will be constructed on the three northern parcels in different phases (some
of which have been completed); however, the project is considered whole for permitting purposes. The
three southern parcels will remain undeveloped and be designated as Open Space.

Section E. Impact Justification and Mitigation Instructions
Avoidance and Minimization (revised from Original PCN)
Prior to site design, streams, wetlands, and riparian buffers were delineated to identify potential
resource areas to avoid where practical. Impacts have been avoided where possible, while allowing
access to developable uplands.
Permanent Wetland Impact #1 is required for the construction of a roadway which provides access to 16
developable upland lots.
The sewer corridor is located to provide access for the subdivision while avoiding the main bottomland
hardwood forest along Stream 1.
Permanent Wetland Impact #6 is required for the construction of a residential lot. This fill is required to
clip a small portion of the wetland and provide stable for upland construction.
Compensatory Mitigation for Impacts (revised from Original rk_.iv)
The applicant is proposing to pay mitigation at 2:1 ratio for two permanent wetland impacts, 1:1 ratio
for sewer corridor conversion impacts
Payment will be through Private Mitigation bank.

• Delineation of streams and wetlands was conducted on both Daniel Farm North and Daniel Farm
South by Wyatt Brown, Brown's Environmental Group, Inc.
• During site meeting, USACE David Shaeffer agreed with the delineation. No written
confirmation was issued.
• Subdivision planning began.
2017
• During site meeting, USACE Samantha Daley agreed the two farm ponds located on north side
were constructed in uplands and not jurisdictional. The ponds are not shown as jurisdictional on
the original 2015 delineation.
• The Non -Jurisdictional status was verified this in email 7/6/17. USACE asked for amended JD
Request to include Approved for the ponds and Preliminary for all jurisdictional features.
• In late 2017, the county approved site plans, utility, ESC, and stormwater plans and site work
began.
2019
• Planning began for Daniel Farm South. Wyatt Brown checked with USACE Samantha Daley
regarding the JD status.
• USACE noted that the original delineation info was 4 years old, land had been cleared, and asked
for revised exhibits, PJD forms, etc. for both north and south sides, revised tables and acreages,
and info on the ponds for the Approved portion.
Current status:
There is still no written Preliminary and Approved JD for the project, north or south side.

I. REQUESTS FOR CORPS APPROVAL OF SURVEY PLAT
Prior to final production of a Plat, the Wilmington District recommends that the Land
Surveyor electronically submit a draft of a Survey Plat to the Corps project manager for
review.
Due to storage limitations of our administrative records, the Corps requires that all hard -
copy submittals include at least one original Plat (to scale) that is no larger than 11"x17"
(the use of match lines for larger tracts acceptable). Additional copies of a plat, including
those larger than 11"x17", may also be submitted for Corps signature as needed. The
Corps also accepts electronic submittals of plats, such as those transmitted as a Portable
Document Format (PDF) file. Upon verification, the Corps can electronically sign these
plats and return them via e-mail to the requestor.

When the entire actual Jurisdictional Boundary is depicted:
include the following Corps Certification language:
"This certifies that this copy of this plat accurately depicts the boundary of the jurisdiction
of Section 404 of the Clean Water Act as determined by the undersigned on this date.
Unless there is a change in the law or our published regulations, the determination of
Section 404 jurisdiction may be relied upon for a period not to exceed five (5) years from
this date. The undersigned completed this determination utilizing the appropriate Regional

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in
the review area, and the requestor of this PJD is hereby advised of his or her option
to request and obtain an approved JD (AJD) for that review area based on an
informed decision after having discussed the various types of JDs and their
characteristics and circumstances when they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a
Nationwide General Permit (NWP) or other general permit verification requiring "pre -
construction notification" (PCN), or requests verification for a non -reporting NWP or
other general permit, and the permit applicant has not requested an AJD for the
activity, the permit applicant is hereby made aware that: (1) the permit applicant has
elected to seek a permit authorization based on a PJD, which does not make an
official determination of jurisdictional aquatic resources; (2) the applicant has the
option to request an AJD before accepting the terms and conditions of the permit
authorization, and that basing a permit authorization on an AJD could possibly result
in less compensatory mitigation being required or different special conditions; (3) the
applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can
accept a permit authorization and thereby agree to comply with all the terms and
conditions of that permit, including whatever mitigation requirements the Corps has
determined to be necessary; (5) undertaking any activity in reliance upon the subject
permit authorization without requesting an AJD constitutes the applicant's acceptance
of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps permit
authorization based on a PJD constitutes agreement that all aquatic resources in the
review area affected in any way by that activity will be treated as jurisdictional, and
waives any challenge to such jurisdiction in any administrative or judicial compliance
or enforcement action, or in any administrative appeal or in any Federal court; and (7)
whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms
and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it
becomes appropriate to make an official determination whether geographic
jurisdiction exists over aquatic resources in the review area, or to provide an official
delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds
that there "may be"waters of the U.S. and/or that there "may be" navigable waters of
the U.S. on the subject review area, and identifies all aquatic features in the review
area that could be affected by the proposed activity, based on the following
information:
