Please find five copies of the Pre - Construction Notification Application for the above referenced
project. The site consists of wooded land and paved areas. Structures are not located on the
site. Proposed development at the site includes the construction of an approximate 80,000
square feet medical office building (MOB) and associated parking /landscaped areas. Road
access will be provided by the extension of Healy Drive, which is currently located near the
northwestern site boundary.
On behalf of the Broyhill Silas Pointe, LLC, I am requesting that a 401 Water Quality
Certification be issued to authorize the permanent impact (culvert) to 156 linear feet of stream
channel. Wetlands will not be impacted by the proposed project. Based on the proposed
impacts being greater then 150 linear feet of stream channel, mitigation at a 1:1 ratio is being
proposed.
The associated 401 Water Quality Certification Fee is included as an attachment. Please feel

The purpose of the proposed project is to develop the site wth an approximate 80,000 square feet medical office building
(MOB) and associated parking /landscaped areas Road access will be provided by the extension of Healy Drive, which is
currently located near the northwestern site boundary

The overall project consists of developing the site with an approximate 80,000 square feet MOB and associated
parking/landscaped areas The 80,000 square feet MOB is proposed to be four stones with 20,000 square feet of space
per floor In order to provide access to MOB, Healy Drive must be extended from the northwestern site boundary to Silas
Creek Parkway To facilitate the extension of Healy Drive and site development, the crossing location must be cleared
and graded As part of the grading and to provide access to the proposed MOB, 156 linear feet of stream channel will be
piped with 36" RCP and tied into existing culverts located up and down gradient of the stream Graders, haulers,
excavators and cranes will be used during the grading and construction activities on the site

D Impact Justification and Mitigation
1. Avoidance and Minimization
1a Specifically describe measures taken to avoid or minimize the proposed impacts in designing project
The proposed stream impacts are occurring on a reach of stream that up and downgradient portions of the stream have
previously been piped Approximately 1,000 linear feet of stream channel were previously piped up- gradient of the proposed
stream impacts and approximately 1,600 linear feet of stream channel were previously piped down - gradient of the proposed
stream impacts Due to the amount of stream that has been previously impacted up and down - gradient of the proposed
stream impacts, there is minmal aquatic habitat in the proposed impact area It is not functioning as a habitat corridor for
aquatic life Aquatic life has not been observed in the area of stream that is proposed to be impacted
Furthermore, when comparing green field site development versus the proposed use of the exisiting site, there would likely be
far greater impacts to streams and wetlands than those proposed in this application The applicant will be using a site which
the majority is currently developed Additionally, potential impacts associated with the development of a green field site with a
proposed MOB would likely result in impacts to higher quality features and result in greater loss and impact to aquatic species
and their habitat
The extension of Healy Drive has been designed to traverse as near to the northeastern site boundary as possible In doing
so, saftey concerns with bisection of parking areas and the MOB have been eliminated Furthermore, the extension of Healy
Drive will result in less traffic congestion than the use of the existing road infrastructure, especially the heavily congested Silas
Creek Parkway
The proposed grade increase of the Healy Drive extension is approximately 20 feet Based on the proposed increase in
grade, the use of retaining walls to avoid additional stream impacts is not economically feasible Additionally, the use of
retaining walls to leave a portion of the stream open will have potential safety concerns for vehicular and pedestrain traffic
traveling to and from the MOB, thus increasing the liability for injury for the property owner /developer It will be a maintenance
issue as it will create an area that could clog up and flood parking areas and nearby structures The potential to create an
unstable situation as the stream erodes down overtime and undermines the retaining wall is likely Furthermore, the use of
retaining walls could provide a pathway for sediments and other contaiminants that could negatively effect down - gradient
water bodies It is not a feasible option to leave a small open area down - gradient of Healy Road
Based upon the developer /owners experience in management and operation of similair existing facilues, the number of
parking spaces for the proposed MOB has been calculated to exceed local requirements The parking requirements of the
proposed MOB have been designed to properly accommodate the anticiapted number of patients and employees However,
the proposed grade in the vicinity of the stream is dictating the proposed stream impacts, not the proposed parking spaces

The clearing limits will be staked and silt fence will be used A temporary coffer dam will be installed upgradient of the
proposed culvert within areas of stream that will be permanently impacted by the culvert In areas that the proposed culvert is
connecting to the existing culverts, the pump around will utilize manholes in the exisiting culvert and temporary coffer dams
will not be used Upon completion of culvert installation, the temporary sand bag coffer dams will be removed and stream flow
will be diverted through the culvert A Stream Pump Around and Dewatenng Detail exhibit is included as an attachment

ECS consulted the Natural Heritage Program Website to determine if federally protected endangered or threatened
species inhabit the Winston Salem West, NC Quadrangle (the quadrangle that contains the site) The bog turtle
(Glyptemys muhlenbergn) was identified on the Winston Salem West NC Quadrangle as a federally listed threatened (due
to simdair appearance) species The bog turtle typically inhabits mud, grass and aphagnum moss of bogs, swamps and
marshy meadows These wetlands are usually fed by cool springs flowing slowly over the land, creating the wet, muddy
sod needed oy the turtles Wetlands are not located on the site and will not be impacted by the proposed project We did
not observe the bog turtle or suitable habitat for the bog turtle on the site
There are no other federally listed endangered or threatened species that have been identified on this quadrangle

This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit /461 Certification /LAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP, Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In-
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net,

On August 30, 2013, at your request and in your attendance, Sue Homewood conducted an or -site
determination to review a feature located on the subject property for intermittent /perennial determinations
with regards to the above noted state regulations. The feature that was reviewed is identified on the
attached map.
The channel identified on the attached maps was determined to be perennial throughout the property
boundary.
Please note that at the time of this letter, all intermittent and perennial stream channels and jurisdictional
wetlands found on the property are subject to the mitigation rules cited above. These regulations are subject
to change in the future.
The owner (or future owners) should notify the DWR (and other relevant agencies) of this decision in any
future correspondences concerning this property. This on -site determination shall expire five (5) years from
the date of this letter.
