Ingress and egress to property and proposed structures thereon with particular reference to automobile and pedestrian safety and convenience, traffic flow and control and access in case of fire or catastrophe. Two driveways are proposed on Aurelian Springs Road for the proposed concentrator site. The spacing between driveways and from intersections is in compliance with the NCDOT Policy on Street and Driveway Access to North Carolina Highways. The driveways have been designed to allow a safe and efficient traffic flow into and out of the site All concentrate haulage to the mineral separation plant in Stony Creek, Virginia will be from the entrance /exit at the concentrator site Iluka will use an internal road network to access areas of the mine Therefore, a minimal number of driveways will be required for the development of the mining operations and will be for access to and from the mining areas for workers and equipment In an effort to minimize land disturbance, existing driveways will be utilized to the maximum extent practical for site access. Screening and buffering with reference to type, dimensions and character. The concentrator site and mining operations will be buffered with earthen berms These berms will provide for visual screening, noise attenuation, and dust suppression. The concentrator site will also make use of existing vegetation and fencing around the perimeter Existing vegetation will be used as a screen around mining operations as much as practical. Structures are set back from the public road a minimum of 300 feet, and a 10' tall berm will be placed along Aurelian Springs Road at the concentrator site. Perimeter berms will be placed around the mining areas to create visual, noise, and light buffers Existing vegetation will be used to the extent practicable for additional screening. 6. Signs, if any, proposed exterior lighting with reference to glare, traffic safety, economic effect and compatibility and harmony with properties in the district. Iluka will post signage at the concentrator site and around the properties being mined The signage will identify the site and aid in creating a safe environment If the signage is lighted, it will utilize appropriate lighting to minimize offsite glare Page 2 of 4 Exterior lighting will be used at the concentrator site Within the mining area, lighting will be on equipment such as the mining unit, booster pumps, and earth moving equipment Exterior lighting will be designed and positioned to minimize any off -site glare and to ensure no traffic safety concerns are created Iluka conducted a traffic study to assess the effects of haulage and light vehicle traffic within the proposed mining area. The results of the traffic study indicate that the proposed vehicle traffic will not adversely affect the level of service for the existing road networks NCDOT has confirmed that turn lanes are not warranted with the anticipated traffic volumes Iluka's proposed operations are anticipated to create new jobs within the county Iluka anticipates that mining and reclamation will generally be completed within six to eight years on each property The properties will be released to the land owners as pasture, or as the NCDENR mining permit will require, and can be returned to agricultural use at that time 7. Required yards and other open space and preservation of existing trees and other attractive natural features of the land. All Halifax County setback and buffer requirements will be adhered to The mining activity on a parcel will be initiated by installation of erosion and sediment control devices in accordance with an erosion and sediment control plan approved by NCDENR. These devices include silt fencing, diversionary berms, and sediment traps located around the proposed mine cells Vegetation will be cleared next, which includes crop or timber harvesting, followed by root - raking (as necessary) to expose the topsoil Any remaining brush and tree material is burned under appropriate burn regulations or recycled. Iluka is sensitive to the effect of mining operations within the community Iluka intends to conduct a 24 -hour per day operation, 365 days per year. Iluka has experienced minimal noise or other complaints in their 15 years of conducting a 24 -hour per day operation at their Virginia facilities Iluka takes community relations very seriously and will work with the community to resolve issues and complaints if they should arise. Iluka's operations in the United States presently are conducted by its subsidiary, Iluka Resources Inc. ( Iluka) and include (1) a mineral separation plant in Stony Creek, Virginia, (2) two active mine sites, one in Greensville County, Virginia and one in Dinwiddie /Sussex Counties, Virginia, including a wet concentrator plant at each site; and (3) three former mine sites in final reclamation located in Dmwiddie County, Virginia, Clay /Putnam Counties, Florida, and Brantley County, Georgia Iluka is proposing the development of a new mineral sands mine and wet concentrator plant located in Halifax County, North Carolina (Figures 1 and 2). The proposed project, the Aurelian Springs mine, includes 70 parcels encompassing approximately 3,772 acres (Table 1 and Figure 3). This also includes approximately 67 48 acres for a new wet concentrator plant location and process water ponds (Figure 4) Disturbance activities will include discreet active mining areas, the construction and operation of a new wet concentrator plant, lay -down yards, pipeline corridors, process water and storm water ponds, a developed water source, and various support services. Although entire parcels are included in the permit, disturbance will be limited to only those areas required for mining and mining support 2.0 PREVIOUSLY LEASED PARCELS In 1989, U S RGC Mineral Sands (RGC), a predecessor of Iluka, leased the parcels identified in Table 2 and Figure 6 Although the leases were secured, mining activities never took place Iluka is pursuing mining of the same ore that was sought previously 3.0 PROPOSED CONDITIONAL USE PERMIT Iluka, through its North Carolina subsidiary, proposes a mining and reclamation operation for mineral sands in the Halifax County area on parcels located and identified on Table 1 The proposed operations include constructing a new wet concentrator plant and initial tailings area 4.0 MINING, PROCESSING, AND RECLAMATION OPERATIONS Mine Area Overview The proposed mineral sands mine will be located in rural areas of Halifax County, North Carolina west of Interstate 95 (Figure 1) The area can generally be described as rolling hills interspersed with small drainage features and wetlands Predominant land uses in the area are agriculture and silviculture. Agricultural operations are primarily cash crops and include corn, Page 3 of 18 tobacco, cotton, peanuts, and soy beans Silviculture operations consist of harvesting of local pines and hardwoods on a 30 to 35 year rotation Single- family housing is scattered and at very low densities and are primarily associated with farming and silvicultural endeavors. Mining Method The mining method to be used is similar to what has been successfully used at Iluka's Virginia operations Each parcel is surveyed prior to mining activities to ensure that boundary information is accurate. The mining process is initiated by installation of erosion and sediment control devices in accordance with a state - approved sediment and erosion control plan These devices typically include silt fences, hay bales, diversionary berms, and sediment traps located around the proposed mine cells. Clearing of vegetation is the next step with crops or timber harvested, followed by root - raking (as necessary) to expose the topsoil Remaining brush and tree material are burned under appropriate burn regulations. Topsoil is then removed and used to create berms around the mine cells for further erosion and sediment control, stormwater management and to isolate the mine cell from surrounding areas Topsoil may also be stored in separate areas with appropriate sediment and erosion control measures This topsoil will provide a suitable growing medium as well as a "seed bank" for native vegetation in the reclamation activity These activities are initiated from six 6 to 24 months prior to excavation, with mine cells varying in size based on the localized ore body The exposed ore material is a mixture of mineral sands (approximately 10 %), quartz sand (approximately 60 %) and kaolinite clay (approximately 30 %) and is excavated by track- mounted excavators Depths of mining average 12 to 15 feet Excavated ore is then placed in a mobile mining unit which breaks up clay and with the addition of water creates a slurry The mining unit hydraulically transports (pumps) the slurry to the wet concentrator plant for processing through HDPE pipe These pipes typically sit above ground within the mine area but will be bored perpendicularly under public roads. Streams and wetlands will be crossed via installation of temporary culverts All road and stream and wetland crossings will be permitted appropriately with the jurisdictional agencies In some areas, interception of the surficial water table may occur at lower elevations in the mine cell In these instances, the cell will be dewatered with water captured and utilized for make -up water in the mining process Process Method Ore is transported to the wet concentrator plant and then passed through a trommel screen to separate "undersize" (quartz sand, mineral sand, and kaolmite clay) and "oversize" (rocks, gravel, roots, and clay balls) material The "oversize" material is used for back -fill in the mine cells, to surface lay -down yards, and for road stabilization. The "undersize" is then pumped Page 4 of 18 through cyclones to separate kaolmite clay from the mineral sands and quartz sands The "overflow" (clay) from the cyclones is then pumped to a thickener where flocculent is added to increase the percent solids of clay from —5% to —30 %, which effectively dewaters the clay material and the excess water is directed to a clarifying pond for reuse. The cyclone "underflow" (mineral and quartz sands) is pumped to a series of spiral separators which separate quartz sand from mineral sands based on specific gravity. These spiral separators upgrade the mineral sands concentrate feed from approximately 10% to 90% producing mineral sand concentrate The mineral sand concentrate is then directed to a hydrosizer which removes additional fine to very fine quartz sand grains The mineral sand will then be loaded onto trucks and hauled for processing at the mineral separation plant located in Stony Creek, Virginia (Figure 5) Quartz sands from the spiral separators and hydrosizer are then directed to a sand tailings cyclone which dewaters the sands to approximately 75% solids with excess water directed back to the clarifying pond for reuse Tailing sands are then combined with the thickener underflow (clays) to create a sand -clay mix and are then pumped back to the mine cells for use in reclamation activities. Water Use All water used in these processes is returned to the clarifying pond for reuse, with make -up water coming from capture of stormwater in the mine cell, surficial water table dewatering in the mine cell, decanting from reclamation activities, and other sources such as groundwater wells and public water supplies as appropriate. Groundwater wells are typically installed in the deep rock aquifer at depths of 200 feet Figure 7 shows the typical recycled water processes Reclamation Method Mine cells are back - filled with the sand -clay mix (tailings) pumped from the wet concentrator plant. Excess water from tailings is decanted, collected in a water storage pond, and pumped back to the clarifying pond for reuse in the process. Due to the minimal volume of mineral sands extracted there are few voids remaining after mining and post - mining topography will generally mimic pre - mining topography In some cases, grades may be higher than pre - mining conditions due to swell factors associated with the clay content Topsoil used in containment berms around the mine cell or in stockpiles is then used during the final grading of the reclaimed mine cells The topsoil will provide a suitable growing medium as well as a "seed bank" for native vegetation The reclaimed area will be prepared for site planting and appropriate soil tests conducted for lime and fertilizer application Temporary vegetation will be used for soil stabilization with final vegetative cover typically being either pasture /grassland and or crops according to requirements of the NCDENR mining permit After soil stabilization, all erosion and sediment control devices installed at the initiation of mining will be removed Page 5 of 18 Land Disturbance Summary The intent of the mining and reclamation process utilized by Iluka is to minimize the total acres of disturbed land at any one time and still maintain efficient operations. At any given time, a number of acres will be disturbed and will include • Clearing Areas areas cleared in advance of mining and will vary with season, weather, and topographic conditions, • Production Areas. areas that are being actively mined and areas where tailings are being disposed, • Post - tailing Areas areas where tailings are being dewatered and graded and topsoil is being returned, • Reclaimed Areas areas that have been seeded and returned to the landowner after a period of maintenance and monitoring as required by the NCDENR mining permit. • Mining Support Areas areas including the concentrator locations, water storage ponds, laydown areas, stockpile areas, pipe corridors, utility easements, and clarification ponds In general, it is estimated that approximately 50 to 150 acres would be disturbed per year at any one mine area The length of time between clearing and reclamation generally ranges from six to eight years Refer to Appendix A for a summary and photographs of Iluka's mining process. 5.0 CONDITIONAL USE PERMIT STANDARDS Per Article VII, Section 70103 (f) of the Halifax County Zoning Ordinance, the Board of Adjustment shall find the satisfactory provision and arrangement have been made concerning the following standards 1. The concentrator site will also make use of existing vegetation and fencing around the perimeter. Existing vegetation will be used as a screen around mining operations as much as practical. Structures are set back from the public road a minimum of 300 feet, and a 10' tall berm will be placed along Aurelian Springs Road at the concentrator site Perimeter berms will be placed around the mining areas to create visual, noise, and light buffers Existing vegetation will be used to the extent practicable for additional screening 6. Signs, if any, proposed exterior lighting with reference to glare, traffic safety, economic effect and compatibility and harmony with properties in the district. Iluka will post signage at the concentrator site and around the properties being mined The signage will identify the site and aid in creating a safe environment If the signage is lighted, it will utilize appropriate lighting to minimize offsite glare Exterior lighting will be used at the concentrator site Within the mining area, lighting will be on equipment such as the mining unit, booster pumps, and earth moving equipment Exterior lighting will be designed and positioned to minimize any off -site glare and to ensure no traffic safety concerns are created Iluka conducted a traffic study to assess the effects of haulage and light vehicle traffic within the proposed mining area. The results of the traffic study indicate that the proposed vehicle traffic will not adversely affect the level of service for the existing road networks NCDOT has confirmed that turn lanes are not warranted with the anticipated traffic volumes. Iluka's proposed operations are anticipated to create newjobs within the county Iluka anticipates that mining and reclamation will generally be completed within six to eight years on each property The properties will be released to the land owners as pasture, or as the NCDENR mining permit will require, and can be returned to agricultural use at that time. Page 8 of 18 7. Required yards and other open space and preservation of existing trees and other attractive natural features of the land. All Halifax County setback and buffer requirements will be adhered to The mining activity on a parcel will be initiated by installation of erosion and sediment control devices in accordance with an erosion and sediment control plan approved by NCDENR. These devices include silt fencing, diversionary berms, and sediment traps located around the proposed mine cells Vegetation will be cleared next, which includes crop or timber harvesting, followed by root - raking (as necessary) to expose the topsoil. Any remaining brush and tree material is burned under appropriate burn regulations or recycled Topsoil is typically removed and used to create berms around the mine cells for further erosion and sediment control, storm water management, and isolation of the mine cell from surrounding areas Iluka does not anticipate mining of any wetlands or streams and will actively avoid any disturbance to these areas to the extent practical. Minor impacts to these features are anticipated for pipeline crossings and access Impacts to these features are being coordinated with the US Army Corps of Engineers and NCDWQ and will be permitted with these agencies as appropriate 8. General compatibility with adjacent properties and other property. Iluka is sensitive to the effect of mining operations within the community Iluka intends to conduct a 24 -hour per day operation, 365 days per year Iluka has experienced minimal noise or other complaints in their 15 years of conducting a 24 -hour per day operation at their Virginia facilities Iluka takes community relations very seriously and will work with the community to resolve issues and complaints if they should arise. The unique nature of Iluka's operations allows the mined properties to be mined and reclaimed within six to eight years, at which time the properties are released to the land owners again for their use Post - mining landforms will mimic pre - mining topography (gently sloping fields and rolling topography), and surfaces will be suitable for pasture land, silviculture, and row -crop farming 6.0 SITE CONDITIONS The following sections describe the project site conditions in two sections physical environment and infrastructure Page 9 of 18 Physical Environment The physical environment consists of physiography, topography, floodplains, soils, drainage basins, land cover, wetland communities, upland communities, protected species, significant biological features, prime farmland, archaeological/historical sites, and sensitive site receptors as described below. Physiography The proposed mine is located within unincorporated Halifax County, North Carolina, within three (3) different townships which include- Butterwood, Faucett, and Brinkleyville, with the majority of the operations proposed in Faucett Township. These townships do not have any regulatory authority over the proposed activity as the county will be the lead local authority Sixty-five parcels have been identified within the proposed mine site, and leases have been secured by Iluka for these parcels (Table 1 and Figure 3) The Halifax County Board of County Commissioners adopted the Halifax County Comprehensive Development Plan on July 8, 2002 This plan sets out policies and recommendations for the future growth and development of the unincorporated areas of Halifax County Review of the plan indicates a focus on economic development within the county while maintaining the environmental quality Based on review of this plan, the proposed Iluka mineral sands mine would be in compliance with the Comprehensive Development Plan The Halifax County zoning map indicates that the entire mine site is within the Residential- Agriculture (R -A) Zoning District The R -A zoning district principal use is for low density residential and agricultural purposes (Section 1301, Halifax County Code) However, certain uses, other than low density residential and agriculture, may be allowed subject to approval by the Halifax County Board of Adjustment (BOA) Section 1301 02 aaaa and iiii allow quarries and surface mining, respectively, upon approval by the BOA in accordance with Zoning Ordinance Article VII, Section 70103 Conditional Uses Topography Elevations in the project area range from approximately elevation 300ft. to less than elevation 100ft Detailed topography (4ft contour intervals) indicates rolling hills with drainage features There are areas of steeper slopes which will need to be considered during mine cell preparation for sediment and erosion control Areas with slope conditions ranging from high (steep) to low (flat) will be carefully planned during mining to ensure that erosion and sedimentation will not occur in steeper areas. Additionally, due to the extremely low amount of material actually removed during the mining process, post- mining topography will mimic pre - mining topography so that topographic features in general will be similar Page 10 of 18 • Chastain -Bibb level with a loamy surface and clayey or sandy subsoil which are poorly drained. As described in the mining process (Section 4.0), the topsoil is removed prior to excavation and utilized in the reclamation process as a growing medium and "seed bank" and upper soil characteristics will remain similar in both the pre - mining and post - mining condition Drainage Basins The project area straddles portions of five sub - watersheds, including Marsh Swamp (C, sw, NSW - #28- 79- 30 -1), Mill Swamp (C sw; NSW - #28- 79- 30 -1 -0 5), Martin Swamp (C; sw, NSW - #28- 79- 30- 1- 0.5 -1), Rocky Swamp (C, NSW - #28- 79- 28 -0.3), and Bear Swamp (C, NSW - #28- 79- 25 -7). The entire project area is subject to 15A NCAC 2b 0259, the Tar - Pamlico River Basin Nutrient Sensitive Waters Management Strategy. Protection and Maintenance of Existing Riparian Buffers (buffer rules) Iluka and Kleinfelder are coordinating with the buffer rules' implementing agency, the NC Division of Water Quality to ensure all project components are consistent with these rules Site visits were conducted with NC DWQ staff in December 2012 and January 2013, and permitting discussions are ongoing Land Cover The North Carolina Center for Geographic Information and Analysis (CGIA) conducted a comprehensive land cover analysis for the state of North Carolina in 1996 using satellite imagery and representative field review. Twelve (12) land cover types were identified in the proposed project area in 1996 The land cover types identified are primarily forested areas in association with silviculture activities and crop lands associated with agricultural activities Approximately 67% of the area is comprised of forested cover, and 33% of the area is comprised of agricultural cover Silviculture and agriculture activities create a dynamic state of land use cover in that these cover types change over time based on harvest schedules and crop rotation The recent aerial imagery indicates that silviculture and agriculture activities are still the dominate land cover types in the proposed project area During the reclamation process, lands disturbed by mining and support facilities will be returned to productive uses Post-mining topography will mimic pre - mining topography and few voids will be left behind In addition, topsoil will be returned to disturbed areas as a growing medium and "seed bank " Iluka will work with NCDENR and the landowners to return the lands in the post - mining condition to productive uses including silviculture and agriculture Wetland Communities Kleinfelder environmental scientists performed detailed wetland delineations during September, October, and November of 2012 These surveys found nearly 100 jurisdictional wetland areas comprising 497 acres within the project area Each area was delineated with sequentially Page 12 of 18 Floodplains Floodplam data obtained from the North Carolina Floodplam Mapping Program was reviewed for floodplain occurrences in the project area No floodplams occur within the project area Soils According to the National Resources Conservation Service (MRCS) there are 30 soil types mapped within the county that can be categorized into eleven (11) general soil map units as follows • Wedowee- Pacolet. gently sloping too steep with a loamy surface layer and clayey subsoil and well - drained • Tatum - Herndon gently sloping too steep with a loamy surface layer and clayey subsoil and well - drained • Wedowee-Emporia- level too steep with a loamy surface and clayey or loamy subsoil and well drained • Dothan- Fuquay- level to gently sloping with a sandy surface layer and loamy subsoil and well drained • Emporaa- Goldsboro - Gntney: level to sloping with a loamy surface layer and loamy or clayey subsoil and are moderately to well drained • Granthum -Exum level with a loamy surface and loamy subsoil and poorly to moderately drained • Noboco- Goldsboro - Gntney level to sloping with a loamy surface and loamy or clayey subsoil and moderately drained to well drained • Roanoke- Dogue- level with a loamy surface and a clayey subsoil and are poorly to moderately drained • State- Aitavisita level to sloping with a loamy surface and loamy subsoil and are moderately to well drained • Chewacla- Riverview level with a loamy surface and loamy subsoil and which range from poorly drained to well drained Page 11 of 18 • Chastain -Bibb level with a loamy surface and clayey or sandy subsoil which are poorly drained As described in the mining process (Section 4 0), the topsoil is removed prior to excavation and utilized in the reclamation process as a growing medium and "seed bank" and upper soil characteristics will remain similar in both the pre - mining and post - mining condition Drainne Basins The project area straddles portions of five sub - watersheds, including Marsh Swamp (C, sw, NSW - #28- 79- 30 -1), Mill Swamp (C sw, NSW - #28- 79- 30 -1 -0 5), Martin Swamp (C; sw, NSW - #28- 79- 30- 1- 0.5 -1), Rocky Swamp (C, NSW - #28- 79- 28 -0.3), and Bear Swamp (C; NSW - #28- 79- 25 -7). Delineations were verified during five on -site visits with the US Army Corps of Engineers during December 2012 and January 2013, and Jurisdictional Determinations have been issued These visits were conducted concurrently with NC DWQ staff performing Tar - Pamlico buffer rule stream permanence verifications In general, Iluka in its other mining operations has utilized the guidelines of avoidance and minimization for wetland resource impacts Wetland impacts have been limited to areas where economically recoverable ore is located, for road/pipeline crossings, and access In each instance, impacts are minimized to the extent practicable and then compensated with appropriate mitigation Upland Communities Upland communities were field reviewed for habitat types Habitat conditions were noted on each project parcel with particular attention paid to areas potentially suitable for rare and protected species. Classification of upland communities are based on the North Carolina Natural Heritage Program's publication, "Classification of the Natural Communities of North Carolina, Third Approximation 1990" (Shafale and Weakley, 1990) The vast majority of disturbance proposed will be to upland communities, primarily agricultural lands and pine plantation. • Upland communities identified within the project area include Agricultural lands: includes areas which are cultivated to produce crops and livestock. Based on field observations agricultural land within the project area includes cultivated fields of corn, tobacco, cotton, peanuts, and soy beans • Upland Weedy Meadows located within disturbed areas where vegetation is maintained in a graminoid or weedy state due to mowing or grazing activities Based on field observations, these systems occur within cleared areas adjacent to maintained roads, rights of way, pond edges and at the edges of agricultural lands. In some areas soil is compacted by maintenance activities which may alter natural hydroperiods and increase runoff • Mesic Mixed Hardwood Forest mixed hardwood forests that are widespread throughout the Coastal Plain and Piedmont Within the project area these systems are located along Page 13 of 18 transitional areas between forested wetland communities and herbaceous or cultivated upland areas These forests are associated with land forms such as ravines, lower slopes, and well- drained flatwoods, and areas of relatively nutnent -poor soils • Alluvial Bottomland Woodland: communities that occur on sandy terraces elevated above adjacent floodplains and swamps. These systems lie beyond the influence of normal flooding events, and are composed of transitional wetland and upland hardwood and conifer species. • Pine Plantation communities consist of densely planted loblolly pine stands that are actively managed for silviculture operations. Management activities for these areas include herbicide application, ditching and draining, and furrowing Species composition is limited and many of these plantation communities lack age distribution of tree species. Mid- and understory species are inhibited due to low light penetration and herbicide application Pine plantation environments lack transition between adjacent environments and are typically bound by access roads, ditches, or maintained timber stands. Protected Species A number of species occur in Halifax County that are protected by either state (North Carolina Wildlife Resources Commission) and/or federal (U S Fish and Wildlife Service) agencies The majority of faunal species are aquatic oriented and include mussels and fish which would not be directly impacted by the proposed operations The remaining protected fauna have been recorded recently in Halifax County with the exception of Bachman's Sparrow and Red - cockaded Woodpecker which are historic records (last observed more than 40 years ago) Several floral species have also been recorded in Halifax County as well. Biologists performing stream and wetland delineations were provided with photographs and descriptions of each protected species and their preferred habitat. Suitable habitat does exist for several of the species documented from Halifax County, and each area was investigated and none were found However, some species are best located during their specific flowering periods, which did not coincide with Klemfelder's investigations While surveys are ongoing for a handful of plant species, the likelihood of finding one is small given the intensive agricultural uses that have been dominant in the landscape for generations and absence of previously documented occurrences Kleinfelder scientists continue to remain in contact with resource agencies and will promptly notify county and state officials if any protected species are found. Significant Biological Features Review of the North Carolina Natural Heritage Element Occurrence database indicates that there are two Element Occurrences in or near proposed project area These include the Rocky Page 14 of 18 Swamp Aquatic Habitat that is part of Rocky Swamp and Game Lands that are managed by the North Carolina Wildlife Resources Commission No direct impacts are anticipated to the Rocky Creek Aquatic Habitat from the proposed mining activities Portions of mine areas do occur adjacent to the managed game lands No direct impacts are anticipated to the managed game lands, and efforts will be made to minimize impacts to the recognized game lands during mining activities Prime Farmland The dominant land cover in the project area is silviculture and agriculture This is due to the fact that many of the soils located in this area are suited for these activities. The majority of the proposed mining areas are located in prime farm land soils with a number of the areas located in areas considered as having high farmland viability The impacts to thcse farmland resources will be minimized as the topsoil will be removed prior to mining and then replaced over the sand -clay mix tailings providing a suitable growing medium for silviculture and agriculture at the post - mining phase of the project Archaeoloeical/Historical Sites In this general area archaeological and historical resources are primarily limited to historic sites such as churches, cemeteries, and old homesteads A search of the files of the State Historic Preservation Office (SHPO) was requested for previously identified historical and archaeological sites. Results of this inquiry indicated that there were no archaeological sites recorded within the proposed project area. A number of historical sites have been previously recorded There are some historic resources within proposed disturbance areas located primarily in the northwest portion of the area Additional surveys may be required by SHPO based on the final mine plan. Potential impacts to these resources will be minimized as has been done with Iluka's other mine sites by avoidance and minimization of encroachment and strict adherence to archaeological/historic resource protection guidelines. Sensitive Site Receptors The proposed project area was reviewed for the occurrence of sensitive site receptors These receptors are facilities and areas that would be sensitive to "quality of life" impacts from noise, lights, dust, traffic, and general aesthetics A field review by roadside observation was conducted to identify these receptor sites This survey found several churches and cemeteries, three schools, and two horse farms Iluka will utilize Best Management Practices during operation while mining near these areas to minimize impacts to these facilities. These could include berms and vegetation buffers, flashing Page 15 of 18 lights instead of backup alarms, and other measures as practical These measures have successfully been employed at other mine operations with tremendous success Infrastructure Infrastructure considerations in the project area include water and sanitary sewer, safety facilities, school systems, and the road network as described below Water and Sanitary Sewer Systems Halifax County has a water supply system throughout portions of the county Iluka will require approximately 0.75 to 1.0 MGD of makeup water for the wet concentrator plant and mining unit. Water service is available (6 inch line) near the proposed wet concentrator plant. Use of this water supply system may be a viable alternative to drilling of supply wells. Iluka is currently analyzing the available options for water supply to determine the most economically and environmentally viable option Safety Facilities Review of the Halifax County facilities database indicates that there are no safety facilities in the project area The proposed project will not be a burden on local safety resources as the project is not residential -based School Systems The project is not a residential -based project and there will not be an impact to the local school system Additional employees resulting from the project will be hired from the general area. Road Network The road network in the area consists of two lane paved roadways There is acceptable access to all proposed mining areas and the proposed wet concentrator plant Access to Interstate 95 for concentrate hauling to the mineral separation plant in Virginia is available via a route from Aurelian Springs Road to Piney Grove Church Road to Hwy 903 and then to Interstate 95 with one bridge crossing on Piney Grove Church Road (Figure 5) Review of the North Carolina DOT database on bridges indicates that the bridge at Piney Grove Church Road is adequate for concentrate trucks The road network in general appears adequate for concentrate haul trucks These roads are currently used for transport of timber and agricultural products with trucks of similar load capabilities However, the frequency of use for these commodities is more sporadic than the proposed activities Page 16 of 18 Iluka conducted a traffic study to assess the effects of haulage and light vehicle traffic within the proposed mining area. The results of the traffic study indicate that the proposed vehicle traffic will not adversely affect the level of service for the existing road networks. NCDOT has confirmed that turn lanes are not warranted with the anticipated traffic volumes. 7.0 CONCEPTUAL CONCENTRATOR SITE PLAN The Aurelian Springs wet concentrator plant will be constructed on Parcels 0530128 and 0501589 located on Aurelian Springs Road (SR 1600) (Figure 7) The plan, as presented, is conceptual to provide information to the county for orientation of the facility on the parcel, state road access points, berms for screening, and layout of basic components of the concentrator site This site plan is subject to change and final site plan approval will be requested from Halifax County at a later date. The basic elements of the conceptual site plan include concentrator building, offices for support staff, stockpile areas, loading areas, and stormwater and process water ponds As indicated previously, the wet concentrator plant site may use public water for water supply for employees as well as a septic system In addition to site plan approval from Halifax County, other applicable permits that will be required prior to construction and during operation include approval from Halifax County Building Inspection Department, NCDOT for road access, NCDENR for a mining permit, which includes erosion and sediment control during construction and operation, approval from NCDWQ for discharge from storm water and process water ponds during operation, and approval for drinking water well and septic tank. In addition, should minor wetland impacts be required, permits will be obtained from the NCDWQ and U.S Army Corps of Engineers 7.0 PROFFERRED CONDITIONS Iluka offers the following conditions as part of the CUP approval with Halifax County. 1 All required state ( NCDENR Division of Energy, Mineral and Land Resources, NCDWQ, and NCDOT) and/or federal permits governing this operation in Halifax County will be obtained and Iluka will operate according to the conditions contained therein 2 Coordination with the NCDOT and Halifax County shall be a continuous effort in order to preclude and/or correct any road problems ansing from this operation 3 Iluka will continue to partner with recognized mine reclamation and soil science experts (such as the ongoing 10+ year partnership with Virginia Tech) to maximize post -mining productivity and to address issues related to soil productivity and soil stabilization. 4 Setbacks from road right -of -ways, property lines, and residences will be based on Halifax County zoning criteria and NCDENR Division of Energy, Mineral and Land Resources criteria Page 17 of 18 5 Signage will be maintained on all sides of the property being mined 6 A plan will be implemented to mitigate impacts to adjacent water well users, which will include well repairs and well replacement where such issues are directly attributable Iluka's operations Page 18 of 18 TABLES Table l Aurelian Springs Conditional Use Permit Parcels List Property Owner Name Property Owner Mailing Address Tax Parcel #
