Dunn, Coastal Coordinator Habitat Conservation Division DATE: October 26, 2021 SUBJECT: CAMA Dredge/Fill Permit Application for Green Channel Marker, LLC, Carteret County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 4021 Arendell Street adjacent Bogue Sound and the AIWW in Morehead City, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Spccics Act of 1973, as amended (16 U.S.C. 1531 et scq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq), the Magnuson -Stevens Fishery Conservation and Management Act (FCMA), as amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.). The applicant proposes to construct a three -slip docking facility with a 6' by 190' pier that intersects a 10' by 30' T-head platform 200' from NWL. Slips one and two are located along the northwest side of the platform with two 3' by 38' finger piers that contain boatlifts within each slip. Slip three would be located along the northeast side of the platform and have a 3' by 23' finger pier. Water depths within the slips range between -2' to -2.5' NWL. Submerged aquatic vegetation (SAV) was noted in the vicinity. The structure as proposed would be sited 730' landward the USACE AIWW setback. The Bogue Sound at this location is classified SA HQW by the Environmental Management Commission and is open to shellfish harvesting. The NCWRC has reviewed the permit application and is familiar with the project area. Our agency reviewed and commented (Tripp 17 November 2005) on a permitted but never constructed project off this shoreline. Due to the presence of SAV, the NCWRC requests the slips be extended waterward to depths that would allow vessel use with minimal SAV and sediment disturbance. The preferred depth would be -3' NW L. This extension should not cause navigation concerns due to the distance from the Af W W setback, the distance from riparian landowners, and the location of the previously permitted docking facility.
