Dear Mr. Murray,
As a result of inspections of the Parkton Wastewater Treatment Plant during the month of October 2005,
there were several areas noted of serious concern. You are requested to attend a show cause hearing on
January 4th, 2006 at which time the Fayetteville Staff of the Division of Water Quality, Surface Water
Protection, would like to offer you the opportunity to discuss these issues. This "Show Cause Hearing"
will take place at 10 am, in the 7th floor conference room of the Division of Water Quality Offices
located in the Systel Building, 225 Green St., Fayetteville, North Carolina. You should bring the
Parkton Operator Visitation Log, Chain of Custody Reports for September 2005, and any written
correspondence that has occurred between you and the town.
Please respond within 5 days of receipt of this letter to acknowledge your desire to discuss this
matter. If you fail to respond or not show for the hearing, disciplinary action may proceed.
If you have any questions concerning this matter, please do not hesitate to contact either Mr. Don
Register Wastewater Treatment Consultant, or myself at 910-486-1541.

Subject: Notice of Possible Revocation, Suspension, or Issuance of a Letter of Reprimand
Biological Grade 4 Certificate #8273
Dear Mr. Murray:
This letter is to notify you that the Water Pollution Control System Operators Certification Commission will convene
a disciplinary advisory committee on April 18, 2006 at 10:00 a.m. in the Ashley House Conference Room at 219 East
North Street in Raleigh, N.C. for possible action on your operator certification.
This action is being considered as questions have been raised by the staff of the Surface Water Protection Section,
Fayetteville Regional Office whether you have used reasonable care or judgment or have failed to apply your
knowledge or ability in the performance of your duties as Designated Operator in Responsible Charge for the Town
of Parkton Wastewater Treatment Facility, Permit # NC0026921.
This matter was discussed with you at a show cause meeting at the Fayetteville Regional Office on January 4, 2006.
Please note that this action is in regards to your Biological Wastewater Certification # 8273 only.
Title 15A NCAC 8G .0802(d) states: "The operator shall have an opportunity to submit, a written response to the
Chairman prior to the date of the advisory committee meeting. The operator shall also be given the opportunity to
make an oral statement before the advisory committee." A copy of the regulations and G.S. 90A-41 is enclosed for
your information. Should you desire to provide a written response, please mail it to the following address within 10
days of receipt of this letter:

Also as noted above, if you choose to make an oral statement to the advisory committee at the meeting on April 18,

(919) 733-0026 within ten (10) days of receipt of this letter. You should inform Mr. Rimmer if you will be present at
the meeting and whether or not you will be making an oral statement

TACU received a note from Mr. Murray Monday afternoon relinquishing his Biological Wastewater
Grade 4 Certificate along with the actual certificate issued on 6/15/1987. At this time there is no need
for further action. If Mr. Murray does wish to get re -certified, he will have to start at Grade 1 and
progress back up through each grade. Due to Mr. Murray's health at this time it is unlikely that he
will pursue certification in the future.
The advisory committee scheduled for today will now not need to meet. I will include a discussion of
the disciplinary procedures in the next Commission meeting agenda.
