APPROVAL of RANDLEMAN RIVER BUFFER RULES "GENERAL" MAJOR VARIANCE
AUTHORIZATION CERTIFICATE with ADDITIONAL CONDITIONS
Dear Dr. Thorpe,
You have our approval under the "General" Major Variance to the Randleman River Buffer Rules, in accordance
with the conditions listed below, for the following impacts for the purpose of the replacement of Bridge No. 73 on
SR 1549 in Guilford County:

The project shall be constructed according to your application dated June 6, 2007 and any conditions listed below.
This approval shall act as your Authorization Certificate as required within the Randleman River Riparian Buffer Rules
(i5A NCAC 2B .0250). In addition, you should get any other required federal, state or local permits before you go
ahead with your project including (but not limited to) Sediment and Erosion Control.
This approval is only valid for the purpose and design that you described in your application dated June 6, 2007. If you
change your project, you must notify us and you maybe required to send us a new application. If the property is sold,
the new owner must be given a copy of this authorization and approval letter and is thereby responsible for complying
with all conditions. For this approval to be valid, you must follow the conditions listed below.

1. Upon removal of the temporary detour bridge the area impacted shall be restored to pre-construction
conditions immediately after removal of the temporary approach and temporary bridge. Per your application
submittal, the area will be restored to natural contours and native woody vegetation shall be conducted as soon
as possible and not later than sixteen (16) months after construction and shall include planting of trees so that
at the end of five years shall consist (at a minimum) of two different hardwood species at a density of 320
trees per acre.
2. Compensatory mitigation for the impacts to 10,130 square feet of protected riparian buffers shall be required.
We understand that you have chosen to perform compensatory mitigation for impacts to protected buffers
through use of the North Carolina Ecosystem Enhancement Program (EEP). Mitigation for unavoidable
impacts to Randleman Riparian Buffers shall be provided in Randleman Watershed of the Cape Fear River
Basin and done in accordance with the Randleman General Major Variance. EEP has indicated in a letter
dated May 14, 2007 that they will assume responsibility for satisfying the compensatory mitigation
requirements for the above-referenced project, in accordance with the Tri-Party MOA signed on July 22, 2003
and the Dual-Party MOA signed on April 12, 2004.
If you do not accept any of the conditions of this authorization, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447,
Raleigh, N.C. 27611-7447. This authorization and its conditions are final and binding unless you ask for a hearing.
