Subject: Approval of Modification to the 401 Water Quality Certification Pursuant to Section 401 of the
Federal Clean Water Act with ADDITIONAL CONDITIONS for the I-485 Express Lanes,
Mecklenburg County, STIP No. I-5507
NCDWR Project No. 20191337 Ver.3
Dear Mr. Harris:
You have our approval, in accordance with the conditions listed below, for the following modifications to impacts
for the purpose the subject project.
Site 1: A change in permanent stream impact fill type from 28 feet of pipe extension to 28 feet of riprap channel. No
change to permanent bank stabilization or temporary stream impacts.
Site 4: An increase in permanent stream impacts of 51 feet, and a decrease in temporary stream impacts of 10 feet.
Also, a change in permanent wetland fill type to all permanent fill, and no mechanized clearing. No change to the
total 0.3 acres of wetland impacts though.
Site 22: An increase in permanent stream impacts of 29 feet, and a decrease in temporary stream impacts of 29 feet.
No change to permanent bank stabilization impacts.
Sites 11 and 12: Drainage design changes, but no change to the amount or type of impacts.
The amount of DWR required mitigation remains unchanged at 444 linear feet.
Please attach a copy of this letter with any copies of the original Water Quality Certification. All other impacts
and conditions of the Water Quality Certification 20191337v.2 dated September 21, 2020 still apply except
