If Vecellio & Grogan, Inc has removed suspected sediment from the JS at Permit site 4, that is OK. However, I would recommend that no further removal takes place without an approved plan. Photo documentation with a description of the sediment removal activities already performed at Permit Site 4 should be provided, estimating the quantity removed and the location selected for on-site stabilization. This is in direct conflict with the direction given in the email below that you sent to Joshua Young. I’m not sure at who’s direction that V&G has proceeded but, I just wanted to know if their actions constitutes a problem with the compliance of the NOV. It is not uncommon that we would ask the contractor to proceed with the cleanup as soon as possible after photos and documentation. This is usually tied to pending weather events and our desire to remove the sediment before additional rain occurs and compounds the problem. As always, we will defer to NCDENR direction in such matters. Thanks, Art C. The NOV issued on Friday 10-15-21 (attached) listed several items of non-compliance for the site and those items will need to be completed before a follow up inspection can be scheduled. As stated in the NOV, the first step is to submit a written plan to address each non-compliance issue. Once the plan is reviewed and approved by DWR, site remediation activities recommended at Permit Site 4 and 6 can begin. Sediment removal activities should not begin on-site prior to approval. Once the work is complete as approved, and documentation has been provided, a follow up inspection can be scheduled. Let me know what support I can provide at this time.
