4. Project Description and History
4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: *
The northernmost portion of the project area consists of an approximately 0.5-acre laydown area. An approximately 510-foot long and 30-foot wide corridor extends south from the laydown
area to Terrible Creek. Land use in and abutting the project area is classified as Utility as the project area is within the Terrible Creek Wastewater Treatment Plant parcel.
Several types of land cover are present within the project areas. The land cover in the laydown area, which is in the northernmost portion of the project area, consists of herbaceous cover
dominated by grasses and common lawn weeds that is regularly mowed, and heavily developed or disturbed land that contains facilities and infrastructure associated with wastewater
treatment processes and paved and graveled roadways. The project corridor extends south from the laydown area to Terrible Creek. The western portion of project corridor is within an
existing maintained corridor that contains regularly mowed herbaceous vegetation. The eastern portion of the project corridor consists of mixed deciduous -coniferous forest land.
The north -central portion of the project corridor traverses a wetland system that consists of forested wetland areas outside of the existing maintained corridor and herbaceous wetland
vegetation within the maintained corridor. The south-central portion of the project corridor traverses two narrow intermittent stream channels that transport water from wetland complexes
west of the project corridor to a discharge point into Terrible Creek east and downstream of the project corridor.

4h. Explain the purpose of the proposed project:
The purpose of the project is to install a new 36-inch effluent pipe parallel to an existing 12-inch effluent pipe. Several years ago, the 1.0 million gallons per day Terrible Creek Wastewater
Treatment Plant was decommissioned and a new 3.0 million gallons per day state-of-the-art wastewater treatment facility was constructed on the same parcel. Modifications to the effluent
discharge piping was not performed during the treatment plant site modifications. Installation of a new effluent pipe to transport treated wastewater from the treatment plant to Terrible
Creek will provide redundancy to the existing effluent pipe and prevent effluent flow backup within the treatment plant systems.
41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: *
The project entails connecting the new effluent line to an existing manhole within the fenced portion of the Terrible Creek Wastewater Treatment Plant and installing the pipe parallel to an
existing effluent pipe to a discharge point abutting Terrible Creek. The existing parallel pipe corridor is maintained, construction access will be via the existing corridor, and the laydown
area is in a maintained grass area within the fenced portion of the treatment plant.
A portion of a jurisdictional wetland will be traversed by the pipe corridor, as depicted on Impact Map 1. The wetland areas within the project's limits of disturbance consist of maintained
corridor associated with the existing parallel pipe and forested wetland abutting the existing pipe corridor. The wetland area between the silt fences that bound the project corridor will be
temporarily impacted during construction. Topsoil will be temporarily stored separately from subsoils and excess material will be removed from the wetland areas. The wetland area will be
restored to pre -construction contours and seeded with native grasses and strawed within a timely manner upon completion of pipe installation. Crossing of the wetlands by the pipe will not
result in loss of jurisdictional waters of the U.S.; however, conversion of forested wetlands to non -forested wetlands will occur to provide for a permanent access corridor for the pipe.
The pipe corridor will cross two unnamed tributaries that converge downstream of the project corridor and discharge into Terrible Creek. The unnamed tributaries provide connectivity of
wetlands west of the project corridor to Terrible Creek. Due to the existing figuration of the unnamed tributaries within the project corridor, as depicted on the attached Impact Map 2,
crossing of the southern unnamed tributary at an angle less than 15 degrees of perpendicular is not possible. All stream work will be performed in the dry. During construction, temporary
diversion structures will be installed upstream and downstream of the areas of excavation, and the stream will be pumped around the dammed area. Crossing of the unnamed tributaries
during construction will be performed via existing culverted crossings or use of temporary fords. The unnamed tributaries will be returned to their preconstruction configurations with riprap
being placed below the pre -construction grade in the bed and banks of the streams to protect the streams from structural erosion and provide velocity control since the streams are
downstream of existing culverts.
A headwall and wingwalls will be constructed at the terminus of the effluent pipe, as depicted on Impact Map 3. The pipe terminus is several feet from the stream bank to provide a velocity
dissipation area for the effluent pipe's discharge. The newly created velocity dissipation area will tie into the existing streambed elevation of Terrible Creek. To prevent erosion and scouring
of the streambed, riprap will be installed within the velocity dissipation area and within an approximately 429 square foot area of Terrible Creek where the dissipation area discharges into
Terrible Creek. The riprap within Terrible Creek will be installed at and below the existing streambed elevation. Additionally, a small portion of Terrible Creek, approximately 275 square feet,
will be temporarily disturbed during construction in association with installation and removal of a diversion structure such that work can be performed in the dry.
The pipe will be installed through jurisdictional areas using open cut installation techniques. Excavated material will be sidecast for a short period of time while the pipe is being installed.
Upon completion of the pipe installation, the upper layer of the trench in jurisdictional wetland areas will be backfilled with the topsoil that was sidecast during the trench excavation and the
elevation of the trench will be returned to original grade. Anti -seep collars will be installed on the pipe in the wetland crossing area, as prescribed by State guidance, to avoid indirect post -
construction impacts from the project.
Indirect impacts of the project are anticipated to be beneficial. Construction of the project will provide redundancy to the existing effluent pipe and prevent effluent flow backup within the
treatment plant systems during periods of elevated water levels in Terrible Creek. Equipment anticipated to be used during the proposed 36-inch effluent pipe installation include backhoes,
front-end loaders, and dump trucks. Details of proposed activities, such as temporary stream bypass devices and anti -seep collars, are provided on the design drawings submitted in
conjunction with this permit application.

E. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
Avoidance of all impacts is possible only with a no -build alternative, which does not meet the need of the project. During design, the project corridor was
positioned to avoid and minimize impacts to jurisdictional features. To minimize conversion of forested to non -forested wetlands, the proposed limits of
disturbance in the wetland crossing was positioned to incorporate as much of the existing maintained wetland corridor as feasible. Where avoidance of
jurisdictional wetlands was not possible due to constraints, the limits of disturbance were reduced to the extent practicable.
The project has been designed in accordance with applicable Minimum Design Criteria. During design, the construction corridor in jurisdictional areas
was minimized to the extent practicable and the limits of disturbance within jurisdictional areas is 30-feet wide. The width of the permanent maintained
access corridor associated with the pipe was designed to the minimum width practicable and does not exceed 30-feet. The project design includes anti -
seep collar installation on the pipe downstream of the wetland area.
The project design and specifications instructs the contractor to return all temporarily impacted jurisdictional areas to their pre -construction elevations,
re -seed wetland areas with an appropriate herbaceous wetland seed mixture and stabilize all stream banks using erosion control matting that does not
contain plastic mesh and/or plastic twine within 60 days of construction completion. The project corridor crosses an existing culvert that will be removed
for installation of the pipe. Post -pipe installation replacement of the culvert has been designed to ensure proper flow and aquatic life movement during
low flow conditions.
Best Management Practices are included in the project design to appropriately control erosion and sediment associated the project. All in -stream work
will be performed in the dry via use of a diversion structure. Additionally, uncured concrete will come in contact with stream waters. The size and density
of riprap, per the design, is appropriate for the application site conditions. Most of the discharge site's riprap dissipation area was designed in an upland
area to minimize impacts to Terrible Creek. Only a small portion of riprap will be placed in Terrible Creek's stream bed, as required to tie the dissipation
area to the existing stream bed.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Impacts to jurisdictional areas during construction will be limited to the extent feasible by performing as much work as is possible from upland areas. In
areas of impact, silt fencing will be placed upgradient of the jurisdictional areas and all construction activity will be performed upgradient of the silt
fencing. All disturbed areas will be returned to original grade and seeded with a native seed mix within 60 days of completion of the project. Swamp
matting will be used where appropriate in wetland areas. Excavation of the pipe trench will be performed as prescribed the by the USACE in
jurisdictional areas and side casting of excavated material into abutting wetland areas will be avoided to the extent feasible.

The project is being constructed such that the new 3.0 million gallon per day Terrible Creek Wastewater Treatment Plant has adequate ability to
discharge the plant's previously permitted NPDES effluent and prevent interruption of the facility's treatment system. The project will not induce growth in
the service area. The population in the service area is anticipated to increase as the population in Fuquay Varina service area increases. The project will
ensure that the residents of the service area have adequate and reliable wastewater treatment services. Existing ordinances and regulations, including
the Clean Water Act, erosion and sediment control regulations, and storm water ordinances are expected to prevent impacts to downstream water
quality due to development in the project service area.

The project corridor consists of regularly maintained herbaceous vegetation bound by wooded areas. A survey of the areas within and abutting the
project corridor were performed in June 2021 by qualified biologists during the optimal survey window for Michaux's sumac. No specimens of Michaux's
sumac were identified during the survey. A review of the forested areas abutting and in proximity of the project corridor were assessed and no long leaf
pine was found to be present.
