Robin — I would like to get your opinion on Butch's question below. It is my interpretation that in order to be deemed a
regional water system under G.S. 143 -355.8 in HB 609 that there would have to be the creation of some sort of board or
organization that was actually coordinating and planning for future water supply needs on a regional basis. Butch is asking
whether the establishment of a contract to sell water to Lincoln County would establish Cleveland County Water as a Regional
Water Supply Planning Organization. Thanks for your help.

Subject: HB 609
Dear Tom, we are having our regular Cleveland County Water Commissioner meeting October 9th 2012 to discuss the
contract with Lincoln County requesting two mgd from the propose Reservoir & to serve the west end of Lincoln County
water.
I would like your opinion if possible on section 143 -355.8 of HB 609 Regional Water Supply Planning Organization. It is
my interruption this would establish Cleveland County a Regional Water Supplier.
Also there has been the issue of the releasing of flows from the Reservoir. 143.355.7 (5) Maintain downstream flows
necessary to protect downstream users.
This indicates that by HB 609 we must release for Shelby demands.
The Reservoir would be the solution for Shelby, West Lincoln County & parts of Rutherford, Gaston and Cherokee County
South Carolina. Population served would be approximate over 80,000.
