Good morning Kristi Lynn and Hannah,
I’m working on a permit modification for U‐4751/R‐3300. Below is an e‐mail correspondence from Joanne discussing the
upcoming modification but the e‐mail does not include every aspect of the modification that has been discussed. The
modification that will be submitted will address the following.
R‐3300B
removal of SR 8 from the project since the Department purchased the property and the SR is no longer
required. This reduces the permanent the permanent wetlands impacts at Site 19 by approximately 2 acres.
Culvert at permit site 31 will be replaced rather than extended. This revision will reduce permanent stream
impacts.
U‐4751
Permit remaining impacts at the I‐140 interchange to complete construction of interchange.
Beane Mitigation Site
Permit tributary (surface water) impacts associated with the construction of the Beane Mitigation Site. DWR has
been involved in the PJD and mitigation proposal for this site.
My question is, can you please confirm that the e‐mail below from Joanne can be used as the pre‐filling notification for
all of these permit modification actions?
Also, due to the timing and need for these modifications, I may have to apply for the R‐3300B modification separate of
the other items in order to have the permits in hand for the R‐3300B advertisement, which means the updated permit
needs to be in Raleigh by mid‐November. I can not apply for the U‐4751 interchange until the Beane Mitigation Site
proposal is accepted by the agencies because the it will serve as the mitigation source for these wetland impacts.

The DWR has no issue with your proposed plan, since you were permitted and mitigated for these impacts. The DWR
will copy this email in order to comply with the pre‐notification for the proposed modification for the project (which will
be 20161268V4)

As you know, there have been a lot of discussion about completing the fills at the interchange of U‐4751 and I‐
140. There are concerns that placing this fill in stages as originally proposed would create settling and stability issues
which has occurred on other projects There is also a tremendous advantage for the Department financially and to
complete this under the current contract. Phase 1 would be to complete the fills on the ‐L‐ line for the I‐140
flyover. This proposed fill is shown on the attached permit drawings (permit drawings 47 of 83 and 50 of 83. I have
highlighted the additional fill on the permit drawings in yellow. These areas have already been permitted but were
noted as “Grading Only” on the South side of I‐140. The fill on the North side of I‐140 would be in uplands. Phase II
would be to pursue a permit modification to complete the entire interchange under this contract, hopefully including
the structures as shown in the attached rendering. However, we want to pursue Phase 1 as soon as possible to take
advantage of the conveyor belt. The contractor has almost completed the fill needed on the South side of I‐140 under
the current contract and will remove the conveyor as soon it is completed so the Department would have substantial
cost savings if we approve the Phase I fill now while the conveyor is still operational. This would also gives us time to
complete the permit modification to complete everything on the South side and keep the conveyor in use without
reinstalling it in the future.
Since Phase 1 fill is already permitted and/or in uplands, is there any permitting or consistency issues with the
Department proceeding with this work under this contract from your agencies perspective?
Secondly, do you see any issues, from your agencies standpoint, with the Department pursuing a permit modification to
complete this interchange as shown on the rendering? I’m hoping to have the revised permit drawings for the impacts
not currently authorized in the next 4‐6 weeks. This additional work, noted on the permits drawings as “Future(By
Others)” had been proposed to be part of the R‐3300A contract. However as noted above there is a financial, stability
and safety advantages for the Department to complete this interchange under the current contract.
