Troxler Commissioner North Carolina Department of Agriculture and Consumer Services Division of Marketing Mr. Trent Allen Regional Supervisor Water Quality Regional Operations Section Fayetteville Regional Office 225 Green Street, Suite 714 Fayetteville, NC 28301-5095 Subject: Dear Mr. Allen, Permit Rescission Request Southeastern Agricultural Center NCDA&CS Marketing Division Lumberton, NC 28358 Robeson County Facility Number: AWI780108 Joe Sanderson Director Tad Atkinson Manager (Interim) October 14, 2021 Based on discussions with Fayetteville Regional Office staff and an evaluation of historical and ongoing operations at the Southeastern Agricultural Center, we would like to request rescission of the Southeaster Agricultural Center's Animal Individual State Permit AWI780108. Factors that help us arrive at this decision include, 1) the facility does not meet the "Feedlot" definition in G.S. 143-215.10B., i.e. horses are not confined at the facility for 45 or more days during a 12-month period. The actual number of days of confinement are typically less than 40 days per year, and during the majority of shows (which are one -day shows) many horse owners choose not to confine their animals at the facility at all; 2) all stables are completely covered and waste is collected and stored in a sealed roll off container; 3) the Ag Center has a contract with the Robeson County Landfill whereby they provide the roll off container to collect and store the waste and then transport the container to their facility when filled, where the material is then utilized at the landfill site for ongoing landfill operations; 4) Ag Center staff routinely collect waste during and after events to maintain the facility in a clean and safe condition for event participants and visitors; and 5) potential for impacts to surface water are further minimized through stormwater collection and a stormwater retention pond on site. We do not anticipate that the conditions presented will change in the foreseeable future. If substantial changes to operations are proposed for this facility that have the potential to alter its exemption from permitting status, we will consult with DEQ Regional Office staff.
