The decision to waive the 401 for Cleveland County was based on the Corps assertion that there are less "environmentally damaging" alternatives to Cleveland County available for their future water supply and, therefore, the Corps 404 will not be approved for the reservoir project. In an effort to make the most efficient use of our limited resources, we reasoned that there would be no value added to either the State or Cleveland County if we injected ourselves into the middle of a process that has been ongoing since 2005 and already cost Cleveland County $1.7M. The media is making a big deal out of the fact that "this action is unprecedented and we have never done anything like this before," but as you would say, that doesn't mean that it wasn't the right thing to do.
