They did have a permit from 2009, and they just proposed to "lessen" the impacts utilizing
bioengineering, so we just processed it as a reverification with reduced impacts and no mit
plan review... Boo.
Your letter will definitely help the IRT in that final determination in closeout....

No worries. I had the same comments the first time around and we raised them as concerns but
that was back when DWQ was "waiving" EEP approvals so when they chose not to address them we
didn't follow up. Maybe nothing will happen this time other than we'll be prepared when it
comes time to do close out.....

Tasha forwarded your letter on to me on the first one .... I already verified the permit with
just the WRC comments as special conditions. Glad you put your thoughts into it. After
seeing Cane Creek last week, I wish I had put something along the lines you did for
#3 .... Unfortunately, Todd and I discussed this project and realized that the initial review
of the mit plan had already been conducted (not a portal posting) and we missed our
opportunity. That is the whole point of the portal now, so hopefully this will be one of the
last ones like this.
