Contained in this package are documents pertaining to the proposed construction of a new
seawall and retaining wall at the Prewitt residence at 179 Tryon Bay Circle, in Lake Lure,
NC. On May 5, 2013, an eight inch rainstorm occurred over a 1 to 2 hour period that caused
a slope failure on the Prewitt property (Tax Pin 223731) between the back corner of the
house and Lake Lure. The loose soil slid into the Prewitt's boathouse which has since been
removed. There were several large trees that also slid with the sheared layer that were
removed because of safety issues. In order to stabilize the home (which is presently
restricted from access by the county building inspector and fire marshal) a new segmental
block, two tiered wall is necessary to stabilize the property and the home.
By copy of this letter, the Prewitts respectfully request that a 401 Water Quality Certification
be issued for this project. As you can see from the supplied pictures, a prompt review to
facilitate an accelerated construction schedule would be appreciated. The Prewitts are very
anxious to return to their home. If you have any questions or concerns, please contact me at

Abbreviated Application Form
The following is an abbreviated application form for those applying for a 401 Water Quality
Certification to impact FERC (Federal Energy Regulatory Commission) regulated and US
Army Corps of Engineers Reservoir owned/regulated lake shore or bottom under the U.S.
Army Corps of Engineers Permit GP30 and other lake shore or bottom under the U.S. Army
Corps of Engineers Permit GP80. This Application cannot be used for wetland or stream
impacts. Please provide five (5) copies of this application and supporting information as well
as a non- refundable application fee to the Division of Water Resources of $240.00 for impacts
to lake bottom of less than 1 acre and $570.00 for impacts to lake bottom of greater or equal to
1 acre.

shear failure at the back of the house extending to the lake. A new seawall and retaining
