On behalf of LLFIex, LLC (LLFIex), Hart & Hickman, PC (H&H) is submitting the enclosed semi-
annual stormwater Discharge Monitoring Report (DMR) for the site referenced above in
accordance with the industrial stormwater permit (NCG030694). Please note there are benchmark
value exceedances in Stormwater Discharge Outfall (SDO) samples SDO-001, SDO-002, and
SDO-004. Chemical Oxygen Demand (COD) was detected above the benchmark of 120 mg/L for
SDO-001 (139 mg/L) and SDO-002 (218 mg/L). Copper was detected above the benchmark of
0.010 mg/L for SDO-004 (0.011 mg/L). Historically, the Former Cunningham Plant outfalls have
exceeded the benchmark for copper.
In 2014, DEQ performed an inspection to assess compliance with the NPDES general stormwater
pen -nit to evaluate the drainage of the facility's five SDOs. The SDOs were found to be in excellent
condition and concluded in a letter dated June 5, 2014 that offsite sources have opportunities to
contaminate samples taken from outfalls 1, 2, 4 and 5. Considering the 2014 NC DEQ letter, none
of the metal exceedances require a tiered response.
Monitoring concentrations of COD in stormwater discharge is a new requirement under the new
general stormwater permit which became effective July 1, 2021. Because COD has not been
monitored prior to this sampling period, there have been no previously detected exceedances in
SDO-001 or SDO-002 above the benchmark for COD. Therefore, a Tier One response will be
documented in the Stormwater Pollution Prevention Plan (SWPPP) in accordance with the
industrial stormwater permit (NCG030694). This response will identify potential causes and
feasible actions to prevent exceedances in the future. The response will also list monitoring and
inspection details such as the date and value of the benchmark exceedance, the inspection date,
selected actions, and the date the selected actions are implemented.

Additionally, a stormwater management inspection will be conducted to evaluate potential
background sources of COD and whether conditions onsite can be improved to prevent
exceedancesin the future.
