Here is my recommendation of some of the responses to Chris's comments - The impactfor Lot 48 includes a 10-foot buffer to accommodate for "any patio, deck, etc", per sheet 3 of 3. However, lots 41, 46, 51, 72, 77, 79, and the lift station between lots 49 and 50 all show building footprints up to wetland edges. No grading is shown on impact exhibits. Please occountfor anyfuture wetland impacts associated with future improvements and lot grading. The house boxes shown have been updated to allowfor a 10'buffer between any homefootprint and the wetlands. Final homes will most likely differfrom the example shown, but will still allow the bufferfor construction activity, patios, etc. Building lots 35, 36, and 38-43 all include a wetland through their yards. Anyfuture loss to this feature would likely isolate the remainder of wetland A -CC upslope (south). Please provide assurances future homeowners won't impact thisfeature. As stated on the impact maps, G// wetlands that are not permittedfor disturbance will be recorded on thefinal plot as restricted areas to remain undisturbed. 3. Building footprints providedfor a number of lots (e.g. 34, 35, 72, 74, 77, and others) are much smaller than those shown on nearby lots, in some cases not much larger than the proposed driveways. Please clarify whetherfuture lot buyers would be held to these limits of disturbance and if so, how. These building footprints Grejust examples of possible homes. Many of thesefootprints are over 4,000 sqft, allowingfor a large ranch style home. In reality, the buildingfootprintfor homes on these lots will not be that large, especiallyfor two story homes. The smallestfootprint shown is 1,750 sqft, which still allows a two story home with a two car garage and over 3,000 sqft living space. 4. Please identify activities that would occur within the easement shown between lots 51 and 73174. Propose to install a gravity sewer in this area between MH20 and MH30. There is a proposed 40' temporary wetland impact here. The are will be brought back to the original grade, seeded and left alone to vegetate back to it's original state. The Town of Four Oaks has agreed they will not require a maintenance corridor through this area (see attached letter) We had added the temporary impact to the impact maps. Wetlands shown on the impact exhibits don't appear to match those included on the 7115121 update to the JD map. Please explain the apparent discrepancy. The wetlands shown on these impact maps were surveyed in thefield based on the locations provided. The JD map was generated using a less accurate tool, so the wetlands shown on the impact maps should be considered accurate. 6. Lot 94 includes a wetland area beneath proposed building footprints but is not captured in impact calculations. Please review and if necessary, include these impacts in a revised application. The drivewayfor lot 94 was extended to allowfor the building to be constructed without any wetland impacts. 7. Identify all lots containing potentially jurisdictional features. Thefollowing deed notification shall be included in the recorded restrictive covenants for the subdivision before property containing wetlands is conveyed. Any alteration to this language must be approved before incorporation. "A portion of subdivision has been determined to meet the requirements for designation as a wetland. Any subsequentfill or alteration of this area shall conform to the requirements of the federal rules addressing wetland impact noted in the Code of Federal Regulations at the time of the proposed alteration. The intent of this provision is to prevent additional wetland and stream impact, so the property owner should not assume that ofuture application forfilling or alteration would be approved. The property owner shall report the name of the subdivision in any application pertaining to said rules. This covenant is to run with the land and shall be binding on a// parties and all persons claiming under them." Please let me know if you need anything else from us in order to get this resubmitted.
