Army Corps of Engineers 151 Patton Avenue, Room 208 Asheville, NC 28801-2714 Subject: After-the-Fact Nationwide Permits 3, 13, and 45 Verification Application for August 17, 2021 Tropical Storm Fred Damages in Division 14 DF 17614 and 17614 Haywood, Transylvania, and Macon Counties, North Carolina Dear Mrs. Amschler: The North Carolina Department of Transportation (NCDOT) Division 14 completed emergency roadway repairs in response to flooding on August 17, 2021 from Tropical Storm Fred. Repairs for most sites were coordinated previously with you and other pertinent state and federal agency representatives. Most repairs are now completed, and we are requesting after-the-fact permit verifications as necessary. Repairs have been funded with federal money from the Federal Emergency Management Agency and the Federal Highway Administration. Maps, photos, and a listing of repair sites that affected jurisdictional areas are included in this transmittal. The vast majority of the work affecting jurisdictional areas involved recovery and stabilization of lost road shoulders through the placement of rip rap and other rock in stream channels, some of which migrated considerably due to the flooding. Most of this work qualified for non-notification Nationwide 3 or 13 Permits because impacts were below the established thresholds and there was a lack of Section 7, Section 106, or other triggers under the Nationwide or Final Region Conditions. However, several sites require verification due to exceedances of thresholds, other than “no effect” determinations for Section 7, or other regional condition exceptions. Attached to this submittal is a comprehensive list of all sites including non-notification sites and sites needing verification of the applicable Nationwide Permits and/or GCs. Also included is one site (5) without stream impacts, but in need of US Fish and Wildlife Service (USFWS) concurrence. Note that the list also includes three bridge replacements that we will requesting after-the-fact permit verifications of separately from this request once designs and any remaining evaluations are completed. Construction of these bridges is expected to begin in a few weeks. Nationwide 13 Actions Exceeding Non-notify A Nationwide 13 and/or 45 is requested for the following repair sites solely because of an exceedance of the non-notification impact thresholds: 17, 19, 20, 60, 95, 100, 103, 115, 118, 125, 149, 281, 341, 342, TS Fred Division 14 Damages Page 2 October 15, 2021 344, 347, 358, 367, 421, 459, and 478. Repairs of these sites did not affect habitats for listed species. Two sites (149 and 358) required the felling of a combined 13 trees, however the trees were not suitable for bat roosting so there was no effect of these actions on Indiana bat (Myotis sodalist) and northern long-eared bat (Myotis septentrionalis, NLEB). Removal of these trees also did not result in anticipated changes to the nighttime illumination of riparian areas, so a no effect on gray bat (Myotis grisescens) is warranted for these sites as well. All repairs except for site 149 were exempt undertakings under Section 106 according to the PA agreement checklist because they occurred in disturbed rights-of-way, or streams. Site 149 repairs affected undisturbed ground that was cleared through Section 106 by survey from USDA Forest Service archaeologists. Nationwide Actions with Section 7 Due to other than “no effect” Section 7 calls, a Nationwide 3 or 13 verification is requested for the following sites: 4, 39, 41, 45, 131, and 226. Details of these sites and actions are as follows:  At site 4 accumulated debris and sediment was removed from the right and middle barrels of a triple box culvert under NC 215. This site is near bridge no. 430445 which is known to harbor a colony of gray bats. The work required placement of rip rap on the eroded stream bank immediately upstream of the culvert as well. The work occurred in a noisy urban-industrial setting and on the opposite side of a 4-lane roadway from the gray bat roost bridge. Work did not occur at night. There were an estimated three to five small walnut sapling trees removed for access, but these trees were not likely suitable as bat roosts based on their small size and vigor and their removal did not alter the nighttime illumination conditions of the nearby bat roost or river channel. For these reasons the work may have affected but not adversely effected (MANLAA) gray bats. (*Note that repair work at site 2, which previously involved bridge no. 430445 was eliminated due to the damage primarily being considered cosmetic. No work has occurred at site 5, which remains on the list but will not require stream impacts. Remaining work at site 5 will not affect a known gray bat roost and should be limited to replacement of a short piece of guardrail.)  At Sites 39 and 41 the wingwalls of the bridges were rebuilt or reinforced with rip rap where banks had scoured upstream of the structures. The work was done during the day and without tree removal. The work caused noise and vibration disturbance from track-hoe operations and rock placement. However, according to workers on-site, bats were never seen flying in the vicinity during the construction. Therefore, we believe the work on these sites may have affected but not adversely effected (MANLAA) gray bats.  Shot rock was placed in a deep scour hole adjacent to the west abutment of bridge no. 430170 (site 45) and also along eroded road shoulders along SR 1111 (Site 131). Both sites are within occupied and critical habitats for Appalachian elktoe (Alasmidonta raveneliana). Based on the scour and severe and sudden bedload redistribution that occurred in the East Fork Pigeon River from the storm, it seems unlikely that live mussels were present in or near the work site at site 45. The work here involved replacement of recently wash-out uplands, though some rock exceeded that footprint by a minor amount. At site 131, work also involved the replacement of lost road shoulders (uplands) while the rock placement was largely kept out of the pre-storm river bed. This work caused some short-term turbidity and sediment resuspension, but also stabilized a source of sediment to the river. As of October 9, 2021, the rock stabilization in both locations appears to be stable. Based TS Fred Division 14 Damages Page 3 October 15, 2021 on these factors, we believe that the work in these locations likely adversely affected elktoe habitat, short-term, but effects on the species may be discountable based on the scale of recent flooding impacts. Moreover, the completed action may benefit Appalachian elktoe by reducing erosion and a source of sedimentation in the rivers.  A culvert at site 226 has collapsed and/or separated in a tributary approximately 0.3 miles upstream to the Little Tennessee River in Macon County. The stream is too small to support fish or mussels. The pipe will be replaced in-kind. With the application of best management practices (dewatering and post-construction erosion control) the work “may affect but not adversely affect” Appalachian elktoe and spotfin chub (Cyprinella monacha). In addition to site 2 noted above, the list of Division 14 storm damages that were initially coordinated with agencies on August 22, 2021 also no longer includes storm damage work as site 90. This site was removed because damage is considered pre-existing and not necessary to address for integrity of the bridge (430074). The damage at site 89 is no longer anticipated to include boulder placement or in-stream work. Work will be restricted to placing mesh wire over eroded soils above the river elevation, so there will be no effect on rock gnome lichen (Gymnoderma lineare), which are known to be present in the vicinity. Also, Gary Kauffman with USFS screened the project site on September 1, 2021. After repair were made to site 37, it was evident that this work likely had no effect on Appalachian elktoe habitat in the West Fork Pigeon River adjacent to the site. The stabilization only required placement of boulders above the river ordinary high water and on top of shot rock that was originally used to construct the roadway. Completed repairs should not have had any effects on other listed species potentially occurring in the vicinity of the work areas based on currently available species habitat requirements and geographic distribution information. Nationwide Actions with other Regional Condition Exceptions Verification of Nationwide 3 permits at some sites is requested due to exceptions from the regional conditions, namely the burial of culvert inverts below the natural stream grades. At site 225, a lost culvert section was replaced with an unavoidable outlet perch. This was due to the grade of the remaining unmodified culvert section and the sheer drop to the scoured channel below. Similar perches will remain on culverts to be replaced in entirety at sites 337 and 340 where the stream grade would otherwise require excessively sloped pipes otherwise. Steeply sloped pipes are prone to section failure and separation. Also, the streams at these sites all appear fishless and the outlet drops from these culverts should not constitute an impediment to aquatic life passage not already afforded to some extent by the natural channel morphology. Rip rap was also needed and placed below these culvert outlets to provide needed stability/shoring for the road shoulders during the pipe replacements. Site 337 was discussed in the field with you, Kevin Mitchell, and Holland Youngman on September 7, 2021. Impacts to Waters of the United States TS Fred Division 14 Damages Page 4 October 15, 2021 Impacts to streams for each site are quantified in the attached list with stream name and classification included. Compensatory mitigation is not proposed since the impacts overall have not appreciably degraded or caused appreciable loss of stream habitats and functions. Permits Requested NCDOT is hereby requesting after-the-fact authorization under Section 404 of the Clean Water Act for the described actions. This application has been sent to the North Carolina Department of Environmental Quality (DEQ), Division of Water Resources (DWR) because it will require a written GC for some impacts as well. By copy of this letter, I am asking Mrs. Marla Chambers, Western NCDOT Review Coordinator of the WRC, to comment directly to the regulatory agencies and myself concerning the Nationwide Permit Verifications and 401 WQC Written requests.
