The Wilmington Regional Office received a complete modification to the Stormwater Management Permit
Application for the Visitors Center - Hammocks Beach State Park on July 19, 2001. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth
in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 971235 dated August 29, 2001, for the
construction of Visitors Center - Hammocks Beach State Park.
This permit. shall be effective from the date of issuance until rescinded and shall be subject to the conditions and
limitations as specified therein, and does not supercede any other agency permit that may be required.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and binding.

I. DESIGN STANDARDS
The total allowable built -upon area for the tract is 327,897 square feet. This permit covers the construction
of 166,063 square feet of built -upon area.
2. The overall tract built -upon area percentage for the project must be maintained at 25%, as required by
Section 1005 of the stormwater rules.
3. Approved plans and specifications for projects covered by this permit are incorporated by reference and are
enforceable parts of the permit.
4. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum
side slopes of 3:1 (H:V) or curb outlet systems as defined in the stormwater rules and approved by the
Division.
5. Runoff from the parking lot is being treated in shallow infiltration basins scattered throughout the site. Each
basin is designed to store and infiltrate the first 1.5" of runoff from the drainage area.

6. No piping shall be allowed except:
a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road.
b. That minimum amount needed under driveways to provide access to lots.
7. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all
impervious areas and su fac€ waters.
8. The tract will be limited to the amount of built -upon area indicated in the approved plans.
9. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable
built -upon area.
10. The Engineer/Owner/Developer/Permittee must certify in writing that the proj ect's stormwater controls, and
impervious surfaces have been constructed within substantial intent of the approved plans and specifications.
Any deviation from the approved plans must be noted on the Certification.
11. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a
written time schedule to the Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director that the changes have been
made.
12. Deed restrictions are incorporated into this permit by reference and must be recorded with the Office of the
Register of Deeds prior to construction. A copy of the recorded restrictions must be received by this Office
within 30 days of the date of recording. Recorded deed restrictions must include, as a minimum, the
following statements related to stormwater management:
a. "The maximum built -upon area is 327,897 square feet, inclusive of that portion of the right-of-way
between the front lot line and the edge of the pavement, structures, pavement, walkways of brick,
stone, slate, but not including wood decking."
b. "Construction of additional impervious area in excess of 166,063 ft2 will require a permit
modification."
C. "The covenants pertaining to stormwater regulations may not be changed or deleted without
concurrence of the State."
d. "Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the
development except for average driveway crossings, is strictly prohibited by any persons."
e. "Projects within CAMA's Area of Environmental Concern (AEC) are subject to a reduction of the
permitted amount of built -upon area due to CAMA jurisdiction within the AEC."

13. The following items will require a modification to the permit. Revised plans, specifications and calculations
must be permitted prior to the permittee beginning construction on the modification:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering or piping any vegetative conveyance shown on the approved plan.
14. The Director may determine that other revisions to the project should require a modification to the permit.
II. SCHEDULE OF COMPLIANCE
Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational
for their intended use prior to the construction of any built -upon surface except roads.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other
vegetated conveyances will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted
stormwater management systems at optimum efficiency to include:
a. Semi-annual inspections of the filter media. If the sand is not passing the 1.5" storm event within 5
days, the top 2"-3" of sand will be excavated and replaced with clean, dry sand.
b Sediment removal.
C. Mowing, and revegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plan details and specifications.
4. The permittee shall submit recorded deed restrictions limiting built -upon area within 30 days of the date of
recording.
5. The permittee shall submit the Engineer/Owner/Designer/Permittee Certification within 30 days of
completion of the project.
6. The permittee shall submit all information requested by the Director or his representative within the time
frame specified in the written information request.
III. GENERAL CONDITIONS
1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes
'143 215.6A to 143-215.6C.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a
permit modification, revocation and reissuance, or termination does not stay any permit condition.

4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit,
revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations
contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina
General Statute 143-215.1 et. al.
5. The permit is not transferable to any person except after notice to and approval by the Director. The Director
may require modification or revocation and reissuance of the permit to change the name and incorporate
such other requirements as may be necessary. A formal permit request must be submitted to the Division
of Water Quality accompanied by the appropriate fee, documentation from both parties involved, and other
supporting materials as may be appropriate. The approval of this request will be considered on its merits,
and may or may not be approved.
6. The permittee grants permission to DENR Staff to enter the property for the purpose of inspecting all
components of the stormwater management facility.
7. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state and federal)
which have jurisdiction.
8. The permittee will notify the Division of any name, ownership or mailing address changes within 30 days.

8. PROJECT SUMMARY: Applicant proposes to modify the application currently in circulation for the
Hammock's Beach Mainland Facility. Included is the removal of the bulkhead and breakwater, and
alterations to the docking facility. Additionally, the proposal requests the renovation of the park facilities
located on Bear Island. These facilities include a bathhouse, picnic shelters, boardwalks, and gazebo.

9. NARRATIVE DESCRIPTION:
This project can be divided into two parts: The first is the modification to the project currently
under review. Due to agency concern, the applicant has made some changes to lessen the
impacts to be incurred by the renovation of the park's mainland facility. Additionally, he has
modified the docking facility to be more useful. The original field report was sent out for
circulation on March 04, 1998. To refresh your memory, the site is a 30.16 acre tract adjacent to
Bogue Sound, on the mainland opposite of Bogue Inlet, east of Queen's Creek and west of
Swansboro at the end of State Road 1511, in Onslow County. Elevations extend from the waters
edge to approximately 20' above mean sea level. The tract has been historically vegetated with
pines, oaks, wax myrtle, and cedar, but has undergone extensive clearing due to vegetation loss
from the hurricane season of 1996. Additionally, much of the tract was disturbed and cleared for
an archaeological assessment.
This site serves as the education center and launching area for ferries to transport the public to
Bear Island. There is currently a ranger station serving dually as a visitor's center, a picnic
shelter, a bulkhead at the staging area with a pier and dock, and 3 demonstration buildings.
These facilities are serviced by a septic system and the Onslow County public water supply.
The Onslow County Land Use Plan classifies the area as Limited Transition, with all areas within
AEC's classified Conservation. The Division of Marine Fisheries has not designated the waters
of Bogue Sound in this area as Primary Nursery. The waters are open to the taking of shellfish
for consumption. The Division of Water Quality classifies the waters of Bogue Sound SA.
There is an Outstanding Resource Water classification within the sound at the project location,
but it does not extend close enough to the mainland at this location to effect the project.
There is a fringe of Spartina alterniflora and Juncus roemerianus along this shoreline, typically
transitioning landward to Groundsel Bush, then to oaks and wax myrtle. There are some wetland
ravines extending into high ground that were vegetated with white bay, yaupon and wax myrtle
prior to clearing. These are delineated on the submitted plats as Section 404 Wetlands, although
the delineation has not been approved by the US Army Corps of Engineers.
State Permit 16-94 was issued to this facility in 1994 for the excavation of Cow Creek; it was
later modified to allow for resurfacing and maintenance to the existing visitor's center amenities.
This permit was set to expire on 12/31/97, but was renewed for 2 years.
The applicant's recent proposal was for the complete renovation of the mainland facilities. This
was to include a new visitor's center with accompanying roadways and parking facilities, a ranger
residence, sidewalks, bulkhead, picnic shelters, and pier with dock. For more specific details
regarding the project, see the field report dated March 04, 1998, and accompanying application
The modification to this proposal lies in the deletion of the 100' bulkhead located at the visitor
staging area, and consequent deletion of the filling of the 2830 square feet of bog wetland. There
were breakwaters proposed along the docking area that have been eliminated. And lastly, there
are 12 mooring pilings proposed adjacent to the docking area where there were none. These are
in the form of 3 bumper piles to the west, a 10' x 22' boat lift to the south, and 5 mooring pilings
to the east. The additional impact to be incurred by the mooring system is ±555 square feet of
open water, for a total open water impact of 1755 square feet. The "Structures Sheet" of the
application has been re -submitted to reflect these changes.
The second part of this major modification is the renovation of the Bear Island facilities of
Hammock's Beach State Park. The support facilities on the island include a landing station on
the estuarine side, and a roadway to a bathhouse and picnic facilities on the ocean side. The
application addresses only the renovation of the ocean side facilities. This portion of the
proposal was addressed in the original Environmental Assessment along with the renovations to
the mainland facility.
Bear Island is an 892 acre island owned by the State of North Carolina. Of this, 872 acres are
registered as Natural Heritage Area, leaving approximately 20 acres available for development.
It is within this area that the NC Division of Parks and Recreation proposes to renovate the
existing beach facilities. With the exception of the park facilities, the island is undeveloped.
The island ranges in elevation from 0' to 30' above sea level. At the project site, there are peaks
reaching 20' in elevation. This dune system constitutes primary elevation for the purposes of
dune development and setback determinations. According to Onslow County officials, the FIRM
maps indicate that the waterward 260' of the island in the project area carries a 100 year flood
elevation of 15', 16', and 17'. The island landward of the 260' line lies within a B-zone. Onslow
County receives discounted flood insurance rates by requiring an additional 2' be added to the
100 year flood level for the first floor elevation.
The island supports typical barrier island vegetation, with largely unvegetated sandy areas,
maritime forest patches, and various salt tolerant grasses such as sea oats. The island carries a
Conservation Classification within the Onslow County Land Use Plan. The Atlantic Ocean
carries a water quality classification of SB, and is open to the taking of shellfish for consumption.
The ocean does not function as a Primary Nursery Area. Bear Island is afforded an erosion rate
of 2' per year, according the DCM Long Term Average Annual Erosion Rates. This rate requires
that small structures be located a minimum of 60', and large structures 120% from the first line of
stable natural vegetation.
There is an existing well and septic tank on the property. The septic tank would require
improvements to support the new facility.
There is currently a road extending from the estuarine side of the island to a dilapidated
bathhouse on the ocean side of the island. Because of the erosion in this area, and the subsequent
condition of this structure and the picnic shelters, the DPR is proposing to demolish these
structures. The proposal is to close the existing roadway to public foot traffic approximately 100'
landward of the existing bathhouse. A 290' x 10' elevated boardwalk will lead from this point
westward to the proposed 30' x 30' covered deck. The boardwalk will continue from the deck
oceanward for another 140' to connect to a 16' x 40' gazebo. A handicapped accessible ramp will
lead from the gazebo over the vegetation line to the beach. On the west side of the above
mentioned deck, there will be 2 one-way parallel boardwalks extending to a new bathhouse. The
boardwalks will extend approximately 135' x 10' each until they merge into one for the last 15' of
the walkway. A two story bathhouse is proposed landward of the primary dune. This structure is
proposed with outer dimensions of approximately 65' x 78', with the first floor elevated to 14'
above sea level. There are 4 picnic shelters proposed landward of the bathhouse, approximately
15' x 15' each.
With the exception of the ocean access and gazebo, all structures are proposed to be located in
excess of 120' from the first line of stable natural vegetation. This may change when the
vegetation line is located 60 days prior to construction as the rules require. However, there is
room for the structures to meet the setback requirements.
10. ANTICIPATED IMPACTS:
The project as proposed will disturb approximately .39 acres of back dune area, resulting in .21
acres of impervious area. There will be no built -upon areas within 575' of the estuarine system.
The newly renovated facility will improve safety at the public facility. The boardwalk system
should discourage foot traffic through the dunes, and minimize the creation of "blow out" areas.
The project should not increase traffic to the island, as the support facilities for the use of the
island already exist.
