NC 28210 Authorizing development in Bertie County at west side of NCDOT Bridge No. 53, crossing Whiteoak Swamp. north of Windsor. as requested in the permittee's application dated 4/5/13, including wor lan drawings (1), dated received in the M1ID City office on 7/27/13 This permit, issued on August 27, 2013 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Natural Gas Line 1) Unless specifically altered herein, this permit authorizes only the relocation of 825' feet of natural gas pipeline, including horizontal directional drilling of the natural gas line under the Whiteoak Swamp, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 946 -6481 for this determination. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2016 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Piedmont Natural Gas Permit # 102 -13 Page 2 of 2 ADDITIONAL CONDITIONS 2) All staging areas shall be located a minimum of 30 feet from the Normal Water Level. Sedimentation and Erosion Control 3) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials resulting from the horizontal directional drilling operations do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). General 4) No work shall take place on any property until such time as the permittee has obtained proper legal authority (i.e. deeds, easements, right of way encroachment agreements, etc.) for said property. 5) Any alteration of or addition to the approved natural gas line route that involves any Area of Environmental Concern shall require additional authorization from the Division of Coastal Management. Contact a representative of the Division at (252) 946 -6481 prior to the commencement of any such activity for this determination. 6) No vegetative wetlands or open water areas shall be excavated, cleared, or filled outside the area indicated in the attached workplan drawings. 7) The permittee and/or his contractor shall meet with a representative of the Division of Coastal Management prior to project initiation in order to discuss the conditions set forth in this permit. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946 -6481 prior to the commencement of any such activity for this determination.
