Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Vehicular Access Bridges, Road, Culvert, Riuray 1) The authorized vehicular access bridges, retaining wall, road, and associated Coastal Wetlands fill shall adhere to the alignment depicted on the attached workplan drawings. 2) In accordance with commitments made by the permittee, any portion of the vehicular access bridges built over coastal wetlands shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the bridge decking. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2016 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Earl Younce and Vince O'neal ADDITIONAL CONDITIONS Permit # 101 -13 Page 2 of 3 3) The authorized culvert and associated riprap shall adhere to the alignment depicted on the attached workplan drawings. 4) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 5) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. 6) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. Sedimentation and Erosion Control 7) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 8) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). Stormwater Management 9) The Division of Water Quality approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of the Stormwater Permit No. SW7130411, which was modified on 5/13/13. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. General 10) No open water areas or vegetated wetlands shall be excavated or filled outside the area indicated on the attached workplan drawing. 11) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation in order to discuss the conditions set forth in this permit. 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) This permit does not grant any property rights or exclusive privileges. Earl Younce and Vince O'neal Permit # 101 -13 Page 3 of 3 ADDITIONAL CONDITIONS NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946 -6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many development or land disturbing activities are not allowed within the Environmental Management Commission's Tar /Pamlico. Contact a representative of the Division of Water Resources at (252) 946 -6481 for more information concerning allowable uses within the Tar /Pamlico Buffer. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No. SAW- 201301245.
