The sponsorship is being transferred from Ocean Isle Investment Company to Stone Farm Investment, LLC, which includes the same sponsors of Ms. LaDane Williamson and Mr. DeCarol Williamson with the exception of Ms. Virginia Williamson (who is no longer affiliated with the Bank). The purpose of this letter is to provide you with the Amendment of the Mitigation Banking Instrument (MBI) and to request your agency's signature on this document. You will find that the Amendment to the MBI also contains previously approved updates and corrections, such as credit release schedules, monitoring plans, amended construction plans for Phase 2 & 3, and Conservation Easement survey boundary revision. All updates, amendments, and/or corrections have been circulated and coordinated with the Interagency Review Team (IRT). Pursuant to 60 FR 228, p.58610, 3. Agency Roles and Coordination, "No agency is required to sign a banking instrument; however, in signing a banking instrument, an agency agrees to the terms of that instrument." Please review the attached final amended version carefully; and if you are in agreement with the terms of the Amendment to the MBI, please sign your appropriate signature block and return it to our office within 30 days of your receipt of this letter. Please note that a copy of this Amendment to the MBI has been provided to the IRT member of your agency; and that the Office of Counsel, Wilmington District, has reviewed the provisions in the amended version to ensure the transfer of the Bank has not been compromised and all requirements remain in place.
