Salisbury St. Raleigh, North Carolina 27604 Dear Karen Higgins, 20 13 100 6 WK Dickson is pleased to submit a Nationwide Permit 12 Pre - Construction Notification (PCN) for the Tanyard Branch Sanitary Sewer Improvements project. The PCN is being submitted on behalf of the City of Eden. The proposed project has no impacts to wetlands and temporary stream impacts are less than 500 LF. Therefore, this PCN is submitted as a courtesy, since formal notification is not required. The project is being undertaken to replace and repair an existing sewer line adjacent to Tanyard Branch, Cherry Creek and an unnamed tributary to improve safety and accessibility. Based on an evaluation of the existing sewer line, replacement and upgrading was recommended to prevent failure. This sewer line is a high priority main and is a maintenance concern. It also is potentially a significant source of exposure to spills and overflows due to its age, inaccessibility, and location along the streams. The attached PCN package includes PCN Form, Supporting Figures, and design plans. Stream impacts resulting from the Tanyard Branch Sanitary Sewer Improvements project total 250 linear feet of impacts. The impacts are temporary excavation and temporary stream crossings for construction access. The streams will be restored to pre - construction contours and stabilized. The project meets all conditions of the NWP 12 and GC 3699. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The project is located within the city limits of Eden and most of the site is developed. Residential and commercial business dominates the land use. The project site is located mostly within maintained easements and beneath roadways. The project is a mix of residential and commercial landscapes. Areas of forested are limited and fragmented. The existing sewer easement follows streams and low areas. These streams flow beneath streets multiple times. Immediately adjacent to the channels are residential yards and paved parking lots. The project site is often located along property boundaries. The proposed Tanyard Branch Subsystem Sewer Rehabilitation project is located in an existing network of sewer easements adjacent to Tanyard Branch, Cherry Creek, and, one smaller unnamed tributary. The existing sewer easement parallels the streams where not beneath roads and parking lots. The topography consists of moderately steep valleys to gentle slopes to gently sloping floodplain along the alignment. The geology of the area has fractured fine grain metamorphic bedrock. In the project vicinity, land use includes forested pasture, commercial, and residential property. Within the project vicinity, is a mix of managed herbaceous cover and mixed upland hardwoods. The forested areas are a mix of mature and immature alluvial hardwood forests. Residential properties are typically urban residential communities. Commercial uses are limited near the project area. Agricultural use is limited to scattered small home gardens. 3d. Explain the purpose of the proposed project: The Tanyard Branch Outfall is a major interceptor sewer in the Bridge Street Sewershed and has been identified as a problematic sewer contributing excessive inflow and infiltration. The outfall has been a source of repetitive and numerous overflows including over 27 overflows caused by excessive inflow and infiltration and or structural issues with the pipe resulting in 17 Notices of Violation and an EPA Administrative Order. The outfall traverses directly adjacent to Tanyard Branch, a tributary of the Dan River. As noted above, the outfall has been the source of 27 or more overflows in the last five years resulting in raw sewage spills to the adjacent stream and Dan River. The Dan River is an impaired waterway and the overflows have contributed to elevated fecal coliform counts. The downstream portion of the outfall is directly in Tanyard Branch and is classified as a high priority sewer. Its location makes it vulnerable to failure, heavy infiltration and exfiltration making if difficult, if not impossible, to repair. Rehabilitation and relocation, in particular where the sewers are classified as high priority, is the first critical component of stream restoration for these reaches. A water -tight, non - vulnerable and sustainable sewer void of conflict with these tributaries will eliminate overflows and sewer leakage via exfiltration and improve the quality of the stream. The project will also improve the areas of highly eroded sections and stabilize them to reduce turbidity and sedimentation in surface waters. Comments: (Stream Impacts) Construction for Tanyard Branch sewer rehabilitation project occurs near or along the narrow floodplain of local streams. In addition to Tanyard Branch, the sewer rehabilitation will occur along the floodplain of Cherry Branch and an unnamed tributary to Tanyard Branch. Due to the existing location of the sewer within the stream channel in multiple locations, unavoidable stream impacts will occur. A survey of existing conditions and design decisions will likely reduce the estimated impacts to streams. No wetlands were observed within or near the construction corridor. Where possible, existing sewer crossings are being relocated outside of the channel or designed to cross closer to perpendicular where currently crossing at an acute angle. Existing sewer line within the channel will be removed when crossing is aerial and when buried below the channel bed the line will be plugged at both ends and abandoned. D. Impact Justification and Mitigation 1. Avoidance and Minimization la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Due to the nature of this project, complete avoidance is not possible. Both stream and wetland impacts were considered when designing the sewer rehabilitation. Most impacts will occur within an existing maintained easement. Where lines are relocated outside the stream channel, some clearing of buffer may be necessary at the new location. All impacts will be temporary except where crossings will be relocated. The long -term impact of relocation will minimized by abandoning the existing sewer line currently within the channel. All channel impacts will require the channel to be restored to the original profile and dimension. lb. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Impacts are minimized using a staged construction approach. This approach allows minimization of the impact of each stage during the project construction. All work in streams will be conducted during dry conditions and/or with mats to protect soil structure. Jute matting and native plantings will be used to stabilize the disturbed stream banks. The stream will be restored to preconstruction elevations and stabilized with an appropriate riparian or wetland seed mix. Anti -seep collars will be used where necessary. F. Supplementary Information S. Endangered Species and Designated Critical Habitat (Corps Requirement) Sd. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? The North Carolina Natural Heritage Program data source was used to evaluate the project site for protected species. Under evaluation, one federally endangered species was found to be located approximately 1 mile from the proposed project in the Dan River. The endangered species is Roanoke Logperch (Percina rex). Due to the nature of this project, complete avoidance is not possible. Suitable habitat for protected species does not exist within the proposed project. The proposed project is within an existing sewer line easement therefore, land use and habitat will not change. Stream impacts were considered when designing the sewer rehabilitation. Most impacts will occur within an existing maintained easement. Where lines are relocated, the relocation is outside the stream channel where possible or the crossing is designed to cross near perpendicular to minimize impacts. Some clearing of buffer may be necessary at the new locations. All impacts will be temporary except where crossings will be relocated and where the existing lateral service lines are replaced and the stream bank will be stabilized. Stabilization of the lateral line replacement will be minimized and not exceed 10 linear feet of stream channel. The long -term impact of relocation will minimized by abandoning the existing sewer line currently within the channel. All channel impacts will require the channel to be restored to the original profile and dimension.
