This detention pond with its design will allow for capture and slow release of up to a 1001 year rainfall event and should take care of any problems you had noted in your inspection report from your inspection of June 11, 2009. The water will enter a fore -bay or pre - basin and be allowed to settle and then go into a metering basin and the metering basin will then allow the water to be metered out and at that point it will enter the recycle system. This will allow the water to be stored and metered out to the recycle system and therefore not cause overflow into Lime Kill Creek. The Explosive Supply quarry lease site is comprised of several parcels owned by both NCDOT and the Greenlee family. The permitted mine site was notified by letter on June 18, 2009 of possible overflow problems not allowed under their current Wastewater Recycle Permit No. WQ0004624. We are proposing with this report to modify an existing onsite upstream basin to not only remove suspended sediment but to also detain the runoff from 29 acres of the site in order to prevent excessive runoff into the existing closed loop system. The upstream expanded pond will contain not only the 25 year event but will also greatly reduce the runoff up to the 100 year event (see calculations). Because of challenging topography the pond has been split into two ponding areas to achieve the required surface area and allow for a drop in elevation between the two areas. The first area will function as a forebay and will settle out the majority of the sediment. The dam for the forbay is proposed to be a rock dam which will enhance the settlement capacity by serving as an intermediate baffle, thereby, protecting the proposed cmp outlet control structure from large sediment deposits. A byproduct of achieving the required surface area paired with the topography provides a pond with sediment storage in excess of the required by 60%. (see sediment basin design sheet and stage storage). The Rational Method was used to develop the stormwater management for this report. Two analyses are provided. The first hydrologic analysis (hydro # 1) evaluates the main pond with the proposed drain holes functioning. This analysis provides the information for calculating the time to dewater. The total time to dewater calculates out to be 48 hours with an average rate of 0.29 cfs. The water surface elevation in this analysis never reaches the weir and therefore the outflows remain low. This analysis was used to size the outlet control structure and determine the maximum outflow from the pond. The water surface elevation only gets high enough to overflow the weir of the outlet control structure during the 100 year storm. The emergency spillway elevation is never reached but a spillway has been proposed due to the fact that this will be a permanent pond. See the table Z below for a summary of total discharges for the 2, 10, 25, and 100 year storm. Also see hydrology report # 2 for more detailed information. Based on our permit guidance, we don't require an ATC for dewatering of quarries and sand . mines unless they use chemical treatment. Also, an ATC is not required for process ww for sand/gravel and closed -loop recycle systems. We could require them to provide plans and cafes for the ww system to show they will meet permit limits and then issue them an ATO if no upgrades are required to the system. Is the owner aware that we would like this ncg02 to replace the WQ permit? Klimek, P.E., Director Division of Water Quality By the Authority of the Environmental Management Commission Permit No. NCG02000b, PART III MONITORING, CONTROLS, AND LIMITATIONS FOR PERMITTED DISCHARGES SECTION A: STORMWATER BEST MANAGEMENT PRACTICES (BMPS) PLAN The permittee shall implement stormwater BMPs to ensure that contaminants do not enter surface waters via stormwater that comes in contact with any unstabilized overburden, raw materials, intermediate products, finished products, byproducts or waste products located on the site covered by this permit. A BMP Plan shall be developed in accordance with the requirements of this section. The BMP Plan requirement, or portions of the plan requirement, may be met by utilizing appropriate requirements in other documented plans' specific to the permitted facility. 2. Management of Stormwater Runoff and Runon. The permittee shall maintain stormwaten BMPs for land disturbance areas and outside process areas. In addition, controls should) be used to limit or isolate selected land disturbance and process areas and limit the amount of off site stormwater ninon to those areas. Appropriate Best Management Practices (BMPs) should be used to divert, infiltrate, reuse or otherwise manage stormwater runoff and ninon in a manner that reduces pollutants in stormwater discharges leaving the site. Appropriate BMPs may include but are not limited to: vegetative swales, berms, use of reclaimed mine areas, and reuse of collected stormwater (such as for an industrial process or as an irrigation source). 3. BMP Controls Inspection and Maintenance. All stormwater BMPs shall be inspected by or under the direction of the permittee at least once every seven calendar days and within 24 hours after any storm event that results in a discharge. The BMPs implemented shall be operated and maintained so that they are cleaned out when the sediment storage capacity has been reduced by 50%. If any visible sedimentation is leaving the property, corrective action shall be taken to reduce the discharge of sediments. Visible sedimentation found offsite shall be recorded with a brief explanation as to the measures taken to prevent future releases as well as any measures taken to remove the sediment that left the site. All other stormwater specific controls (e.g. oil /water separators) shall be inspected and qualitatively monitored (as per Part III.B.3) on a semiannual schedule, once in the fall (September -November) and once during the spring (April -June). A log of sampling data and of activities taken to implement BMPs associated with the vehicle maintenance activities shall be maintained and incorporated into the BMP Plan and kept onsite for the duration of the permit term and made available to the Director upon request. 4. Erosion and Sedimentation Control. The permittee shall implement the management practices and the erosion and sedimentation control measures that are included in the mining permit or erosion and sedimentation control permit issued by the Division of Land Resources. Compliance with the issued permit is considered a requirement of this general permit. Any deviation from the issued permit, or amendments to the issued permit, that impacts water quality shall constitute a violation of the terms and conditions of this general permit. A signed copy of the issued permit including the approved erosion and sedimentation control measures and the reclamation plan shall be maintained on the site at all times. Once an area is released by the Division of Land Resources in Part III Page 1 of 9 Permit No. NCG020000 Existing, new and expanding treatment facilities shall be subject to the following operational requirements. SECTION B: REQUIREMENTS FOR OPERATION OF A TREATMENT FACILITY Operation and maintenance of treatment facilities must be in accordance with the requirements in this General Permit. For the purposes of this permit no documentation other than a signed Certificate of Coverage is required to operate an existing treatment facility. New facilities must also have an Authorization to Construct permit. 2. Diversion or bypass of untreated wastewater from a treatment facility is prohibited except under provisions of this permit in Part IV, Section C.3. In the event that a facility fails to perform satisfactorily, including the creation of nuisance conditions, the permittee shall take immediate corrective action, including those actions that may be required by this Division, such as the construction of additional or replacement treatment or disposal facilities. 4. The issuance of this permit shall not relieve the permittee of the responsibility for damages to surface waters of the State resulting from the operation of a treatment facility. 5. Any discharge from a treatment system to groundwater must protect the groundwater standards specified in 15A NCAC 2L, Groundwater Classification and Standards. 6. Any groundwater quality monitoring, as deemed reasonably necessary by the Division, shall be provided. No chemical flocculants shall be used in the treatment facility without written authorization from the Division. 8. All discharges of mine dewatering wastewater and process wastewater will be monitored in accordance with Part III, Section C of this permit. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Pemuttee, a formal permit request must be submitted to the Division of Water Quality (Division) accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of the request will be considered on its merits and may or may not be approved. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those actions that may be required by this Division, such as the construction of additional or replacement treatment or disposal facilities. 6. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and in a manner approved by the Division. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 8. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 9. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited. 10. Freeboard in the recycle ponds shall not be less than two feet at any time. 11. If not already established, a water -level gauges, to monitor water levels in each of the recycling ponds, shall be installed within 60 days of issuance of this permit. These gauges shall have readily visible permanent markings indicating the maximum liquid level at the top of the temporary liquid storage volume, minimum liquid level at the bottom of the temporary liquid storage volume, and top of the dam elevations. Caution must be taken not to damage the integrity of the liner (if present) when installing the gauge. 12. If not already established, a protective vegetative cover shall be established and maintained on all earthen basin embankments (outside toe of embankment to maximum pumping elevation), berms, pipe runs, erosion control areas, and surface water diversions. Trees, shrubs, and other woody vegetation shall not be allowed to grow on the earthen basin dikes or embankments. Earthen basin embankment areas shall be kept mowed or otherwise controlled and accessible. 13. Any monitoring deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 14. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 15. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available to the Division or other permitting authority, upon request. 16. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the recycle system at any reasonable time for the purpose of determining compliance with this permit, may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. 17. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205 (c)(4). 18. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. 19. The issuance of this permit does not exempt the Permittee from complying with any and all statutes,'rules, regulations, or ordmances.which may be imposed by other government agencies (local, state, and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B 0200, erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCGO10000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 2H .0500.20. 20. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of this project. 21. Noncompliance Notification: The Permittee shall report by telephone to the Asheville Regional Office, telephone number (828) 296- 4500, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank, the known passage of a slug of hazardous substance through the facility, or any other unusual circumstances; b. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors, etc.; c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility; or d. Any time that self -monitoring information indicates that the facility is not in compliance with its permit limitations. Occurrences outside normal business hours may also be reported to the Division's Emergency Management personnel at telephone number (800) 858-0368, or (919) 733-3300. Persons reporting such occurrences by telephone shall also fife a written report in letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 21. Upon classification of the wastewater treatment and spray irrigation facilities by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Pernittee shall designate and employ a certified operator to be in responsible charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the facilities in accordance with 15A NCAC 8G .0201. The ORC shall visit the facilities in accordance with 15A NCAC 8G .0204 or as specified in this permit and shall comply with all other conditions specified in these rules. i 22. The Pemrittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. The inspection was also in conjunction with the permit renewal request. The system appears to be well operated with no discharge to surface waters. The permit requires that freeboard levels in the recycle ponds be maintained at two feet at all times. A freeboard marker should be installed in the freshwater pond, as this is the pond containing the recycling pumps. The fresh water pond is in need of dredging. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. - The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Pemvttee, a formal permit request must be submitted to the Division of Water Quality (Division) accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of the request will be considered on its merits and may or may not be approved. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those actions that may be required by this Division, such as the construction of additional or replacement treatment or disposal facilities. 6. The residuals generated from these treatment facilities must be disposed in accordance with North Carolina General Statute § 143-215.1 and in a manner approved by the Division. M 7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages' to surface or groundwaters resulting from the operation of this facility. 8. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 9. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited. 10. Freeboard in the recycle ponds shall not be less than two feet at any time. 11. Any monitoring deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 13. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available to the Division or other permitting authority, upon request. 14. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the recycle system at any reasonable time for the purpose of determining compliance with this permit, may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. 15. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205 (c)(4). 16. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. 17. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 18. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of this project. 19. Noncompliance Notification: The Permittee shall report by telephone to the Asheville Regional Office, telephone number (828) 251-6208, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank, the known passage of a slug of hazardous substance through the facility, or any other unusual circumstances; b. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors, etc.; c. Any failure of a pumping station, sewer line, or treatment facility resulting it by-pass directly to receiving waters without treatment of all or any portion of the influent to such stat ' or facility; or d. Any time that self -monitoring information indicates that the facility is not in compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in, letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 20. Upon classification of the facility by the Water Pollution Control Systems Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the WPCSOCC. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of 15A NCAC 8G .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of 15A NCAC 8G .0202. 21. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. The analysis may include, but shall not be limited to, Total Organic Carbon, BOD, COD, Chlorides, Phosphorus, Nitrates, Phenol, Total Trihalomethanes, TCLP analysis, Total Halogenated Compounds, Total Coliforms, and Total Dissolved Solids. If lagoons are a part of tie facilities and the recycle water is industrial, provide a hydrogeologic description of the subsurface to a depth of 20 feet or bedrock, whichever is less. The number of borings shall be sufficient to define tie following for the area underlying each major soil type at the site: significant changes in lithology, the vertical permeability of tie unsaturated zone, the hydraulic conductivity of the saturated zone, and the depth of the mean seasonal high water table. f. Five copies of all reports, evaluations, agreements, supporting calculations, etc., most be submitted as a part,of die specifications which are signed and sealed by a North Carolina Professional Engineer. First, this makes it difficult to determine which of the three effluents is in violation of their permit should stream damage occur. Secondly, the major receiving stream, North Fork of Catawba River, is classified as a Trout Stream and does not need the solids loading that the proposed mine would give it. C. PLANT SELECTION AND SPECIFICATIONS Select plants which are best suited. In making the selection, keep in mind the plants' characteristics, climatic adaptation, the intended use, and level of maintenance required. Suggested time of seeding, rates of seed and mixtures for specific uses should be obtained from the soil conservationist. Whenever available, certified seed tested within six months before seeding should be used. Legumes should be scarified if neces- sary and, inoculated with the proper strain of nitrogen -fixing bacteria before seeding. 'hen grass is established by using-stolens (sprigs or runners), use precaution to make -ertain only fresh, moist planting material is used. SEEDING OR PLANTING Uniformly apply seed with a drill, culti- packer seeder or hydroseeder. Seed may - also be broadcast by�using a whirlwind or cyclone seeder or by hand. Cover the seed 1/4-to 1 inch deep,.depending on the size of the seed, and firm the, soil except where a cultipacker­or hydroseeder is used. MULCHING . Mulching is a very important step in estab- lishing vegetation on critical areas. This material is highly susceptible to erosion due to slow water intake and rapid runoff. To aid;in overcoming these conditions, organic matter can be applied in the form of manure, lime applied where needed, and..appropriate commercial fertilizers added. On most sites, four inches pf loamy topsoil applied to the site before seeding enhances establishment of ground cover and minimizes maintenance. — SITE PREPARATION Where equipment will travel over the site during planting and/or for maintenance after establishment,.slopes should be no steeper than 3:1. Where practical, fill and'shape gullied areas. Install necessary water control measures such as diversions, waterways or outlets, subsurface (tile) drainage, and terraces. Remove all debris, such as stones, tree stumps, etc. that may interfere with seeding and maintenance operations. SEEDBED PREPARATION Scarify surface to a depth of at least four inches with a disk or other suitable method. We do not feel we have suf- ficient .site -specific hydrogeologic information to predict the effects of blasting or hydraulic depressurization on the lime- stone unit in question as a result of the proposed mining ac- tivities. Given the uncertainty involved, we would recommend thel installation of 3-4 water level observation wells around the periphery of the quarry area. Periodic measurements (monthly or bimonthly) from these bedrock wells would allow evaluation of the quarry's impact on areal hydrostatic levels. Don Link, our regional hydrogeologist in Asheville, will be happy to as- sist in determining the optimum location and construction de= ; tails for these wells.
