— Faiiure to Obtain a Stormwater Permit

Dear Mr. Coble:
On April 21, 2005, Jenny Freeman of this office conducted a site inspection at Coble's
Sandrock located at 5833 Foster Store Road in Alamance County, North Carolina. The site visit
was conducted after our staff received a referral regarding this site from the Solid Waste
Section, alerting our office that you have failed to obtain a stormwater permit.
It has been verified that your facility has not submitted a Notice of Intent for coverage
under the National Pollutant Discharge Elimination System (NPDES) General Permit
#NCG120000 to Discharge Stormwater. This permit is required of businesses such as yours
that generate stormwater discharges associated with activities classified as Landfills that are
permitted by the North Carolina Division of Solid Waste Management. You are hereby advised
that the failure to obtain a permit from this Division is a violation of North Carolina General
— Statute 143-215.1.
The permit requires that you (1) develop and implement an Erosion and Sedimentation
Control Plan, approved by the Land Quality Section, (2) obtain a permit for a sanitary landfill
from the Solid Waste Section, and (3) monitor stormwater discharges from your property.
Analytical monitoring is required at each stormwater discharge outfall on an annual basis during
a representative storm event. You are required to forward results from analytical monitoring to
the Division of Water Quality. In addition, you are required to perform weekly qualitative
monitoring at each stormwater discharge outfall on the property. Qualitative monitoring records
should be maintained at the facility and made available to Division of Water Quality staff upon
request. All of the abovementioned requirements are explained in detail in the permit text that
was provided to you during the inspection.
You are required to complete and submit the Notice of Intent to the Stormwater
and General Permits Unit of the Division of Water Quality in Raleigh (mailing address is
specified on the application) by May 13, 2005. Failure to do so will result in a
recommendation by this Office in favor of the pursuit of formal enforcement actions against you.
The enforcement options available to the Division of Water Quality for these violations include
civil penalties that may be as high as $25,000 per day per violation. If you wish to preempt the

initiation of a formal enforcement action by this Division, you should take actions to obtain the
required permit #NCG120000. It is our understanding that Joyce Engineering, Inc. will file the
application for you. Therefore, a copy of the Notice of Intent and the permit text are being
forwarded to their Greensboro office.
In closing, allow me to reiterate the seriousness of this matter. You must take immediate
steps to obtain a permit by submitting a completed Notice of Intent to Division of Water Quality
by May 13, 2005. Please expect a follow-up visit from Ms. Freeman next month to determine if
the previous violations have been abated. If you need additional information concerning this

Dear Ms. Carson,
Municipal Engineering Services Company, P.A. (MESCO) is submitting this Notice of Intent (NOI) for
coverage under the stormwater General Permit NCG120000, on behalf of Coble's Sandrock C&D
Landfill. Coble's Sandrock is an existing site located in the southwestern region ofAlamance County, just
east of Kimesville, NC.
In the summer of 2021 MESCO became aware of Coble's Sandrock lack of permit, and need for coverage
under the above General Permit for their Construction and Demolition Landfill (C&DLF). MESCO staff
met with Coble's Sandrock staff at the facility to discuss the need for a permit. Coble's Sandrock
subsequently authorized MESCO to set up a meeting with the North Carolina Division of Energy, Mineral
and Land Resources (NCDEMLR), and to submit the required application and supporting documents
needed for coverage under General Permit NCG120000.
_ On September 13, 2021, MESCO Project Manager S. Jay Zimmerman contacted Mr. Toby Vinson to
solicit guidance regarding application for coverage under the referenced General Permit. During this
conversation, it was explained that Coble's Sandrock had been operating the C&DLF for a number of
years and was not aware of the requirement to obtain the referenced permit until recently. Mr.
Zimmerman explained that the facility had previously received a Notice of Violation (NOV) from the
agency for failure to obtain a permit, and were directed to submit a NOI which they subsequently
.-, complied with, only to receive a letter from the agency indicating that C&DLF's were not required to seek
coverage under General Permit NCG120000. The following is a summary of the correspondence
discussed with Mr. Vinson:
• On April 21, 2005, staff from the NC Division of Water Quality (now Division of Water
Resources (DWR)) conducted a site visit based on a referral from the Division of Waste

—' Management (DWM) because Coble's Sandrock did not have a NPDES permit for stormwater for
their facility.
• On April 22, 2005, the DWR issued a NOV to Coble's Sandrock, for failure to obtain coverage
under the NPDES General Stormwater Permit, NCG120000. The NOV required a NOI to be
submitted on or before May 13, 2005.
• On May 11, 2005, Coble's Sandrock submitted the NOI and associated supporting information to
the DWR for coverage under the General Permit as instructed in the NOV.
-- • On July 11, 2005, in a letter signed by Mr. Ken Pickle, the DWR returned the application and
NOI, explaining that Coble's Sandrock did not need to apply for coverage, stating that "...C&D
landfills are not required to obtain a separate NPDES stormwater permit in North Carolina."
As a result of the above chain of events, Coble's Sandrock staff were under the impression that a
stormwater permit was not applicable to their facility, and their stormwater monitoring was limited to that
of a general construction permit, such as rainfall and occasional visual observations.
Mr. Vinson recommended MESCO discuss the matter with his Stormwater Program staff, and submit the
NOI and supporting information as soon as possible. On September 20, 2021, Mr. Zimmerman and
Environmental Specialist Evan Lambert discussed the situation with Stormwater Program Supervisor Ms.
Annette Lucas and General Permits Coordinator Ms. Brittany Carson, who recommended that MESCO
submit the NOI along with the 2005 correspondence (attached) to avoid a potential NOV or penalties.
Based on the above information and discussions with DEMLR staff, it is clear that Coble's Sandrock
believed they were in compliance with stormwater rules applicable to their operation. Once notified by
MESCO staff that their operation was subject to the General Permit, Coble Sandrock authorized MESCO
to complete the information necessary to support the permit application and to submit the required NOI
for coverage under General Permit NCG120000.
After DEMLR staff have completed the review of the NOI and associated information, please advise
MESCO of any other information needed to obtain coverage under the General Permit. If you have any
