PROJECT SUMMARY: The applicant proposes to excavate an area 14' x 40' in an existing drainage canal at it's confluence with the Rose Bay canal, bulkhead the canal sides, construct a 15' x 26' boathouse and a 6' x 20' dock. Tod I Brennan Rose Bay Canal Hyde County Project Setting The 3.82 acre project site is former agriculture field located at 119 Rose Bay Loop Road near the flashing light on HWY 264 in the community of Rose Bay adjacent Rose Bay Canal near Swan Quarter in Hyde County, North Carolina. The field has been out of production, taken out because of saltwater intrusion, a condition exacerbated by its landscape position, low elevation and ditch system around the field. Adjacent to and south of the field is a scrub /shrub wetland mixed with pockets of Coastal Wetlands that transitions to a homogeneous stand of Coastal Wetlands associated with Rose Bay Creek and Rose Bay off the Pamlico Sound. The applicant owns 61.75 acres of the adjacent wetlands to the south. The field has been left out of production allowing succession to take place. Approximately half of the field supports a stand of Coastal Wetland species including three square Scir us robustus), salt grass Distichlis s icata), and salt meadow hay (S artina ap tens). Higher elevations of the field are dominated by Phra mites sp. The west side of the field borders Rose Bay Canal off Rose Bay Creek. The bank of the canal is f 2.5' above the normal water level (NWL) and there is an unimproved dirt path that traverses along the canal bank. Several pot holes exist in the dirt path. This dirt path was used mainly by bank fishermen driving into the site to fish. The applicant has put up a gate at the paths intersection with the field to stop unauthorized entry onto the property. The canal bank slopes gently downward to the field resulting in an upland area ±50' wide. The higher elevation in this area likely resulted from the original excavation of the Rose Bay Canal. The entire field has been delineated as wetlands by the US Army Corps of Engineers regulatory staff and approximately half of the field has been delineated as Coastal Wetlands by Division of Coastal Management staff. The field has a drainage canal /ditch around the perimeter. The drainage canal on the south side is larger /wider (15' wide) at its confluence with Rose Bay Canal while on the north side of the field the drainage canal narrows to a culvert crossing at the gated field entrance. There is a 10' wide x 25' long wooden footbridge across the southern canal 40' landward of its confluence with Rose bay Canal. Rose Bay Canal is 65' wide in the vicinity of the project site and narrows to 30' near the gated entrance to the field. The property across the canal to the west is developed with a large boat basin that is used as a railway to haul out wooden commercial fishing trawlers. Water depths in Rose Bay Canal range between 5' to 7' below NWL. Water depths in the drainage canal are 3' below the NWL. Rose Bay Canal is designated as Coastal Waters and as a Primary Nursery Area by the Marine Fisheries Commission and SC by the Environmental Management Commission and is closed to shellfishing. Project Description The applicant proposes to develop the mouth of the southern drainage canal into a boat h_ . . Tod J. Brennan Rose Bay Canal Hyde County Page Two basin that will support a 15' x 26' boathouse. The proposal is to excavate the canal bottom in an area 14' wide x 40' long to a max final depth of 4' below the NWL and bulkhead the sides of the canal adjacent the excavated area. A 6' wide x 40' long dock/finger pier will be constructed on the landward side of each stretch of bulkhead. Water flow in the drainage canal will remain open. The 15' x 26' long boathouse will cover a 13' x 13' boatlift. A 6' x 20' dock is proposed to be constructed adjacent and parallel to Rose Bay Canal not extending more than 2' seaward of the canal bank. The project as proposed will result in two boat slips. The applicant also proposes to fill and grade the unimproved dirt path/spoil bank upland area using both fill from the excavation activities and from an offsite source. Two small retaining walls are proposed on each side of the existing footbridge to level the approaches on each side. Project Impacts The project as proposed will result in the excavation of 560 ft2 of canal bottom. The boathouse will shade 390 ft2 of canal bottom. The dock /finger piers will shade 480 ft2 of uplands. The second dock adjacent Rose Bay Canal will shade 40 ft2 of canal bottom and 80 ft2 of uplands. A total of 2 boat slips are proposed. The project will increase small boat activity in the area and their associated impacts. Currently, there is an old footbridge that spans the entrance of a drainage ditch. A new footbridge was built about 40 feet up the drainage ditch earlier this year under a CAMA Minor Permit. The old bridge will be removed and that section of the ditch will be widened and deepened slightly. A bulkhead will then be built along both sides of that portion of the ditch. Pilings will be driven in both sides and a roof will be constructed. The visitors dock will be built in the main channel and will not involve any excavation. Pilings will be driven in very close to shore and a dock will be attached on the land side of the Pilings. Some fill will be brought in to the site and primarily used on the ditch end where the boathouse will be located. The entire area (none of the designated wetland areas) will be graded utilizing some fill, including the entrance easement to get rid of ruts and holes.
