Billy Clarke, Reference is made to your letter of September 28 responding to DWR's issued NOV (NOV-2021-PC-0460). In the letter it states Mr. Scherer missed the permit deadline of September 1, 2021, for removing 40 linear feet of culvert and restoring the piped steam reach due to the backlog of work at Cantrell Construction. Further it states, due to the October 15 start of the trout mortarium of the issued permit, Mr. Scherer will not be able to conduct this work until after April 15, 2022. The Corps is waiving the trout moratorium under regional condition 1.2 of the issued NWP 27 verification. The work noted above, which is required under DWR's and the Corps' permit, can be conducted between October 15 and April 15. This will provide Mr. Scherer the opportunity to eagerly correct his mistake of missing another deadline in resolving the matters with DWR and Corps that originated in early 2017. Cantrell Construction has equipment on Mr. Scherer's property and without too much difficulty will be able to accomplish the work as authorized. The activities for removing 40 linear feet of culvert from UT Steel Creek with restoration of the stream channel and banks is to be completed by December 31, 2021. The planting of the stream buffer is to completed by March 31, 2022. A temporary vegetative and mulch cover is to be established and maintained after the stream channel and banks are restored. Restoration of the stream reach and stream buffer is to conducted per the submitted plans/drawings. During the last 53 months, the agencies have been more than charitable and tolerant of the many missed deadlines. If Mr. Scherer is unable to make the December 31 deadline noted above, then the Corps may initiate actions to encumber is his property holdings in Transylvania County. Description of projects area and activity: This after-the-fact NWP 29 verification authorizes 0.013 acres of permanent wetland impacts and 40 linear feet of permanent stream impacts to an unnamed tributary (UT) of Steel Creek associated with installation of culverts. The NWP 27 verification authorizes 40 linear feet of permanent stream impacts to a UT Steel Creek associated with culvert removal and stream restoration activities. Special Condition(s): 1) Activities for removal of 40 linear feet of culvert from UT Steel Creek with restoration of the stream reach and stream buffer, per the submitted plans/drawings, is to be completed by September 1, 2021. 2) Visual monitoring of the above noted restored stream reach and stream buffer will be conducted at a minimum of quarterly for 12 months after completion of the restoration activities to ensure the reach is stable and revegetation of the buffer is successful. During the monitoring period any failures of stream restoration structures and/or stream buffer vegetation will be replaced/repaired by the Permittee upon identification by the Permittee, his authorized agent, or the Corps. 3) In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby incorporated as special conditions of this permit authorization. Note(s): Some of impacts authorized under these permit verifications were previously authorized under a permit verification dated June 8, 2017, action ID SAW-2017-00423. The Permittee failed to meet the conditions of the June 2017 permit verification. Therefore, the previous authorized impacts to UT of Steel Creek were administratively suspended. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action. This verification will remain valid until the expiration date identified below unless the nationwide/regional authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide/regional permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide/regional permit. If the nationwide/regional permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide/regional permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide/regional permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide/regional permit’s expiration, CESAW-RG-A 2017-00423 modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization. Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You should contact the NC Division of Water Resources (telephone 919-807-6300) to determine Section 401 requirements. For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA), prior to beginning work you must contact the N.C. Conditions for Transfer of Compensatory Mitigation Credit: • Once this document has been signed by the Mitigation Sponsor and the USACE is in receipt of the signed form, the Permittee is no longer responsible for providing the mitigation identified in this form, though the Permittee remains responsible for any other mitigation requirements stated in the permit conditions. • Construction within jurisdictional areas authorized by the permit identified on page one of this form can begin only after the USACE is in receipt of a copy of this document signed by the Sponsor, confirming that the Sponsor has accepted responsibility for providing the mitigation requirements listed herein. For authorized impacts conducted by the North Carolina Department of Transportation (NCDOT), construction within jurisdictional areas may proceed upon permit issuance; however, a copy of this form signed by the Sponsor must be provided to the USACE within 30 days of permit issuance.
