The references to spraying and runoff because of full storage pond conditions were in the inspections of 2005 &
2006. The ponds are lined. I will inquire whether they want to do a permit correction for the pond volumes.
As for any sort of waiver from CO, I will put this e‐mail in their file and let them know that Schedule 1. of the current
permit has been met and no further action is required.

I just spoke with Tessa and Nathaniel. This facility falls under 02T since they have added fields (major mod) after Sept 1
2006, but the 14‐day minimum storage requirement is not spelled out in 02T or anywhere besides the water balance
policy issued in 2008. The water balance policy is not enforceable like the 02T regulation. If this were a new permit, our
desire to push for 14‐days of storage might be a different story as would the date of the frac tank/heavy rain event (i.e.
if the frac tank event occurred at their current field acreage, this would be a red flag. I know you said you thought it was
10+ years ago and they have added 13+ acres since then but please continue to try to confirm that date). However,

since this is an existing facility that has demonstrated through the water balance that they do not need the storage
capacity, if the Asheville region believes that they are managing their irrigation and fields responsibly and do not see any
issues with their wet weather storage, Lake Toxoway can proceed with managing and maintaining their ponds (including
re‐lining without need for additional storage).
If they want, they can request a permit correction to modify the facility description so that the pond volumes are
correct. Otherwise, please include a note in the file to capture it at the next permit renewal.
Assuming that the ponds are actually already lined (and liners are just in poor condition), they should submit as built
drawings/specs after they install the new liner. If they aren’t already lined (I don’t think this is the case based on their
letter to NT but please double check) they will need to submit a permit modification.
Let me know if you have any more questions or if this doesn’t provide you with enough information to move forward
with Wyatt and the permittee.
