Reference our letter dated March 30, 2000 to your office regarding the flooding issues of the Jacobs Swamp Canal.
The WH Weatherspoon Plant, in Lumberton, North Carolina, has received the results of the Law Engineering Study
of the Jacobs Swamp Canal and surrounding properties subject to the flooding issues previously communicated
between the Plant Management and your office.
The results of the Engineering Study concludes that the Fipps property, (Beulah Church Road), lies entirely within
the floodplain limits defined by FEMA for the 1-in-100-year flood event as identified on the.FIRM 3'7155CO280D.
This property is not located in the Jacob's Swamp drainage basin but rather in the Cox Branch drainage basin.
Flooding on the Fipps property is the result of natural fluctuations of water levels in the Lumber River and not
overflow from the Jacob's Swamp diversion canal.
Wit Weatherspoon Plant has acquired approval from the U.S. Army Corps of Engineers, Wilmington District, to •
complete repairs to the WH Weatherspoon Plant Cooling Pond Dike. The Dike is located adjacent to the Jacob's
Swamp Canal. The work consists of the removal of fallen •trecs and stumps, which were damaged as a result of the
recent hurricanes. Several of the trees identified are fallen into Jacob's Canal and/or lie across the canal. We plan to
complete the removal of these fallen ti-ees authorized under US Army Corps of Engineers General Nationwide
Permit 3, Action ID 200001103. All work involving the tree removal will be performed from the top of the dike and
only the wood debris will be removed. There will be no disturbance of the Jacob's Swamp Canal below the toe of
the existing dike.
Mr. J. Mark Frederick, WH Weatherspoon Plant Manager, has aiso made personal contact with Mr. John Bullock
whose property is adjacent to the Jacob's Swamp Canal. His property is located entirely within the floodplain limits
defined by FEMA for the 1-in-100-year flood event as identified on the FIRM 37155C0190D. Mr. Frederick
communicated to Mr. Bullock that from the engineering study performed by CP&L that the occurrence of flooding
also is attributable to natural fluctuations of water levels in the Lumber River due to rainfall events. Mr. Frederick
also informed Mr. Bullock of the planned damaged tree work, which began on May 15, 2000, and will be completed
by June 30, 2000.
Based upon the results of the Law Engineering Study the damaged tree removal from the Jacob's Swamp Canal is
the only planned work that will be performed in regard to the storm and water issues in subject areas.
