Dear Mr. Carper:
On July 2, 2013, the Division of Water Resources (Division) received your application dated July 2, 2013,
requesting a General 401 Water Quality Certification and Buffer Authorization from the Division for your
project. On August 9, 2013, your agent, Mr. Robert Hopper of CDM Smith, notified the Division that the
City of Raleigh requested an Individual Certification because Nationwide Permit 43 currently does not
have a corresponding General 401Water Quality Certification. In accordance with 15A NCAC 02H .0503,
a Public Notice for the subject project was published in The News & Observer on September 5, 2013.
Attached is a copy of the affidavit of publication. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until all of the following information
is received:
Please submit $458.45 to pay for the costs of the advertising public notice, as required in Title
15A NCAC 02H .503(f).
The buffer impacts reported in the PCN application do not match those shown on the Figure 3 —
Neuse Riparian Buffer Impact Areas I Lower Lake and Figure 4 - Neuse Riparian Buffer Impact
Areas I Upper Lake. Specifically, buffer impact B5d is an impact to Zone 2 listed in the table as
an impact to Zone 1 and there may be an addition error in the total impact listed. Please correct
the listing of this buffer subarea and revise the buffer impact totals accordingly.
