The purpose of the project is to replace a hiuctionally obsolete 20' L x 19' W single span timber bcidge with a new 18' W x 4' H s 88' L"bottoniless" reinforced concrete culvert builC with reiuforced concrete heaclwalls ai�d �viug�valls. The footiugs of tl�e proposed botto�nless cuh�ert/bridge �vill spau Frozen Creek on a 135 degree skew. A staged construction process with temporary travel lanes will be utilized to m�intain traffic duriug construction. No mitigation will be required for this pcoject since this is a sp�iwing bottomless structare. I am enclosing a PCN application, Rapanos Jurisdictional forin, SHPO forms, plan sheets showing the proposed work, a marked couuty uiap, � USGS c�uad map and photogrlpl�s. The North Carolina Natural Heritage Database was checked for records of tlueatened and endangered species. The database lists 49 species for Transylvania Count�� that have federal stah�s. Tl�e bog turtle (G/�l�lemys ��rirhlenbergii) is listed as fln•eatened due to similarity of appearance to the listed northern bog turtle. Eight speeies, C�rolina Northern Flying S�uirrel (Gln:�conrys subrinus colornius), App�lachian elktoe (dlasnrrrlontn rcrnenelimzn), mountain sweet pitcher p]aut (Sai�rnce��in ri�brn ssp. jo��esir), small whorled pogonia (I,soh�in medeoloides), spreading avens (Geann rndint�mr), swamp pink (Ilelonins bidlatn), Virgiuia spirae� (Spirnea virgi»in»a) aud rock gnome lichen (Gynmodernui linem�e), are listed as either tlueatened or endaugered. Small �vliorled pogouia and eock gnome lichen are laio�vu to occur within five miles of the project are�. The endangered Appalachiau elktoe does not occur in tlie S�vaunah River Basin. Altholigli most rock gnome licl�en populations occtu• near oi• above 5000 feet elevation, it does occur at lower elevations witl�ui deep river gorges. "1'he elevation at tlie site is appro�imately 2020 feet and tlie sarroundiug liabitat at the project site is witliin the ] 00-yeai• floodplaiu and vertical rock substrate required by the rock gnome lichen is lacking. Therefore, tliere is no suitable l�abitat for tliese species. The small whorled pogonia generally occurs iu open, dry, decidiious ��voods witli acid soil according to tlie U.S. Fish and Wildlife Service. I-lowever, it is also kiiown to occur iii a variety of habitats in Nortl� Carolina, including along streTms. The habitat at the project site is floodplain and maintained road riglit of way. The habitat consists of deciduous trees, such as black walnut a��d tulip poplar. The area is also heavily impacted Uy invasive species that include privet, Japanese honeysuckle, nmltitlora rose and periwiiilcle. Habitat at the bridge site appears to have a very lo�v potential to support small whorled pogonia. Records indicate the nearest known occurreuce of small whorled pogonia is approsimately 2.25 miles uorth���est of the project area. This project is limited in scope and habitat appears to be lacking Yor aquatic 1ud terrestrial tlu•eatened and endangered species. For these reasons aud those discussed above, we reconunend a"�io effect" determination for tlu•eatened and endangered species. Tl�is project was reviewed for historic and ctiltural resources by the NCDOT's Human Enviraunent Unit in 2013. It was detcrmiued that neither historic �rchitecture nor arcl�aeology required � survey (sce attached forms). NCDOT best ma��agement practices will be used to minimize and conhol sedimentation aud erosiou ou this project Tl�e conshvction forem�n will review all erosion and sedimentation control measures daily to ensure erosioii and sedimentation is being effectively controlled. If tlie devices are uot fimetioning as inteuded, they will be replaced inunediately witli better devices. Impacts to W�ters of tLe United States Frozen Creek (DWQ Class: C, Tr) is shown on the USGS topographic map as a peremiial stream. The chamiel is well defined with a substrate primarily composed of cobble, gravel and saud/silt and is approaimately 7-13 feet in width. Frozen Creek flows ap��roaimately 1.6 miles to Toxa���ay Creek, with theu flows 2.5 miles before joining the Tosaway River, which tlien flows into tlie Lake Jocassee Reservoir. To�s���ay River meets the detiuition of a Traditional Navigable Water. For these reasons, we believe Prozen Creek is a Relatively Permanent Water aud is under tl�e jurisdictioii of tlie U.S. Ariny Corps of �ngineers. In oi•der to construct the project, it will be �iecessaiy to impact �vaters of tlie United States in tlie Savamiah River Basin (HUC 03060101). Specifically, NCDOT is re�uesting to replace Bridge No. 72 with a new spamiing structiue. Tl�e impacts are listed in the table below. Frozen Creek constitures a second order stream trending south to north through the project area. It tums northeast about two miles north of the project area and continues flowing at thls orienfaflon until i[ empties in[o the West Fork Fren[h Broad River west of Rosman. This section of the counry has excellent-drainage through the Toxaway, Horsepasture, and Thompson rivers and their tributaries, which form the headwa[ers of the Savannah River Dralnage Basin. The topography is characterized by hilly, Inter- mountain terrain exhibiting elevations ranging between 2100ft AMSL ancl 2800f[ AMSL. The Bridge 72 APE is typified by frequently (looded and poorly drained land surfaces bordered by 30% to 509� sloping hillsides. A map review and site file search conducted at the Office of State Archaeology (OSA) evidenced no previously documented archaeological sites within or immediately adjacen[ to Ihe study area. An inspection of National Reglster o( Historic Places (NRHP), State SWdy Listed (SL�, Locally Designated (LD), Determined Eligible (DE�, and Surveyed Site (SS) properties employing resources available on the NCSHPO website demonstrated that none of the above designated property lypes were located in the vicinity of the project area. Historic maps of Transylvania County were appraised for evidence of former structure locatlons, land use patterns, or other confirmation of historic occupation at this locale and archaeological/historical re(erence materials were inspected as well. In general, the historical review established an absence of NRHP listed properties, archaeologkal sites, or cemeteries withln the APE. In addition, topographic, geologic, environmental, and NRCS soil survey maps (Tn, TaF, CeG) were re(erenced (or the evafuation of ecological, geomorphological, hydrological, or other elements that may have resulted In pas[ occupatlon at this location. Conslruction design data was examined for determining the potential Impacts to [he APE ground surtaces.
