Lee Energy Complex NPDES Stormwater Permit Requirements Wayne County Dear Mr. Draovitch: Our office has reviewed information submitted by Duke Energy on the applicability of the NPDES Stormwater Program to the H.F. Lee Energy Complex. Regional Office and Central Office staff have also conducted site visits at the facility to evaluate the site conditions. All information and site reviews indicate that stormwater runoff from potential areas of industrial activity at the site is either managed through your wastewater NPDES permit (NC0003417) or is not discharged from the site as a point source. The NPDES stormwater program requires the existing of stormwater point source discharges from industrial activity for permit coverage. Since this does not currently exist at the H.F. Lee Complex, and NPDES stormwater permit is not required at this time for this facility. It is our understanding that in the future activities at the facility may change due to the movement of material on the property. If these conditions would lead to a point source discharge of stormwater from industrial activity, then conditions would warrant the need for NPDES stormwater permit coverage. With these changes you would be expected to apply for and receive permit coverage prior to the start of these activities.
