The terms and conditions of the amended Order are in full effect, including those requiring submittal of
written notice of compliance or non-compliance with any schedule date.
Pursuant to North Carolina General Statute 1,43-21,5.3D, water quality fees have been revised to include
an annual fee for activities covered under a Special Order by Consent. The City of Albemarle will be
subject to a fee of $250.00 on a yearly basis while under the Order. An invoice for the annual fee will
be sent to you during the first quarter of calendar year. 2013.

Pursuant to provisions of North Carolina General Statute (G.S.) 143-215.2, this Special Order by
Consent is entered into by the City of Albemarle, hereinafter referred to as the City, and the North
Carolina Environmental Management Commission, an agency of the State of North Carolina created
by G.S. 143B-282, and hereinafter referred to as the Comrnission:
1. The City and the Commission hereby stipulate the following:
(a) The City holds North Carolina NPDES Permit NC0044024 for operation of an existing
wastewater treatment works and for making an outlet therefrom for treated wastewater to an
unnamed tributary to Little Long Creek, Class C waters of this State in the Yadkin -Pee Dee
River Basin, but is unable to consistently comply with effluent limitations for Total
Suspended Solids as set forth in NPDES Permit NC0044024. Compliance will require
preparation of plans and specifications for construction and operation of additional
treatment works.
(b) Noncompliance with final effluent limitations constitutes causing and contributing to
pollution of the waters of this State named above, and the City is within the jurisdiction of
the Commission as set forth in G.S. Chapter 143, Article 21.
(c) The City has secured a grant or has otherwise secured financing for planning, design, and
construction/re-pairs of a new or improved waste treatment system which, once. constructed
and operated, will be sufficient to adequately treat wastewater presently being discharged to
the extent the City will be able to comply with final effluent permit limitations in NPDES
Permit NC0044024.
(d) Since this Special Order is by Consent, neither party will file a petition for a contested case
or for judicial review concerning its terms.
2. The City, desiring to comply with the Permit identified in paragraph 1 (a) above, hereby agrees
to do the following:
(a) As settlement of all alleged violations of NPDES Permit NC0.044024 prior to entering into
this Special Order by Consent, the City agrees to pay the sum of $19,881.39 (including
$881..39 in investigative costs). A certified check must be made payable to the Department
of Environment and Natural Resources and forwarded to the Director of the Division of
Water Quality at 1617 Mail Service Center, Raleigh, North Carolina 27699-1617 by no
later than fifteen (15) days following the date on which this Order is approved and executed
by the Commission and received by the City. (Met)

(c) The city will submit quarterly progress reports detailing the work and activities undertaken
and completed with regard to the upgrade of the Highway 52 WTP's wastewater treatment
infrastructure. The reports are to be submitted as follows:

The quarterly reports are due in each respective office no later than January 1, April 1, July
1 and October 1 during each year the SOC is in effect, beginning October 1, 2011.
(d) The City shall comply with all terms and conditions of NPDES Permit NC0044024 except
those effluent limitations identified in paragraph 2(e) below. See Attachment A for all
monitoring requirements and effluent limitations. The Permittee may also be required to
monitor for other parameters as deemed necessary by the Director in future permits or
administrative letters.
(e) During the time in which this Special Order by Consent (SOC) is effective, the City shall
comply with the interim effluent limitations contained in Attachment A unless modified
below:

Under this SOC, only the parameters listed below have been modified from the most
current NPDES Permit NC0044024 in effect.

(f) During the term of this Order, the City shall ensure efficient operation and optimization of
all wastewater treatment processes and controls. Special attention shall be given to the
observance of standard operating procedures during the cleaning of sedimentation basins.
Although the effluent limits for TSS have been suspended for the time period established by
this Order, for the results of any daily sampling greater than 500 mg/L the City shall
include a statement along with the discharge monitoring report (DMR) submittal describing
the circumstances of the discharge, its duration, any downstream effects and clean up
efforts, if necessary.
In addition to the above, the City shall conduct weekly inspections of the unnamed tributary
to Little Long Creek downstream of the discharge, and beyond to a point 100 feet
downstream of its confluence with Little Long Creek, and remove any observed
accumulations of wastewater solids from the stream. A record shall be kept of the
occurrence of the inspections, conditions observed, and any remedial activities performed.
(g) No later than thirty (30) calendar days after any date identified for accomplishment of any
activity listed in 2(c) above, the City shall submit to the Surface Water Protection Section
Regional Supervisor for the Division of Water Quality's (DWQ) Mooresville Regional
Office written notice of compliance or noncompliance therewith. In the case of
noncompliance, the notice shall include a statement of the reason(s) for noncompliance,
remedial action(s) taken, and a statement identifying the extent to which subsequent dates
or times for accomplishment of listed activities may be affected.
The City agrees that unless excused under paragraph four (4), the City will pay the Director of
DWQ, by check payable to the North Carolina Department of Environment, Natural Resources,
according to the following schedule for failure to meet the deadlines set out in paragraphs 2(c)
and 2(0, or failure to attain compliance with the effluent limitations/monitoring requirements
contained in Attachment A.

4. The City and the Commission agree stipulated penalties are not due if the City satisfies to the
Division of Water Quality that noncompliance was caused solely by:
(a) An act of God;
(b) An act of war;
(c) An intentional act or omission of a third party but this defense shall not be available if the
act or omission is that of an employee or agent of the defendant or if the act or omission
occurs in connection with a contractual relationship with the Permittee;
(d) An extraordinary event beyond the Permittee's control. Contractor delays or failure to
obtain funding will not be considered as events beyond the Permittee's control; or
(e) Any combination of the above causes.
Failure within thirty (30) days of receipt of written demand to pay the penalties, or challenge
them by a contested case petition pursuant to G.S. 150B-23, will be grounds for a collection
action, which the Attorney General is hereby authorized to initiate. The only issue in such an
action will be whether the thirty (30) days has elapsed.
5. Noncompliance with the terms of this Special Order by Consent is subject to enforcement
action in addition to the above stipulations, including injunctive relief pursuant to G.S. 143-
215.6(C).
6. This Special Order by Consent and any terms, conditions, and interim effluent limitations
contained herein, hereby supersede any and all previous Special Orders, Enforcement
Compliance Schedule Letters, terms, conditions, and limitations contained therein issued in
connection with NPDES Permit NC0044024. In the event of an NPDES Permit modification or
renewal, any effluent limitations or monitoring requirements contained therein shall supersede
those contained in Attachment A of this Special Order by Consent, except as modified and
contained in paragraph 2(e) above.
7. Noncompliance with the terms of this Special Order by Consent is subject to enforcement
action in addition to the above stipulations, including injunctive relief pursuant to G.S. 143-
215.6(C).
S. Failure to meet the scheduled date identified in paragraph 2(a) may terminate this Special Order
by Consent and require the City to comply with the terms and conditions contained in the
permit identified in NPDES Permit NC0044024.
9. The Permittee, upon signature of this Special Order by Consent, will be expected to comply
with all schedule dates, terms, and conditions of this document.
This Special Order by Consent shall expire March 31, 2014.

I. The duration of the discharge must be reported in addition to the total flow.
2. Limit and monitor only if the facility adds chlorine to water that is eventually discharged.
3. The Division shall consider all effluent TRC values reported below 50 ug/l to be in compliance
with the permit. However, the Permittee shall continue to record and submit all values reported by
a North Carolina certified laboratory (including field certified), even if these values fall below 50
ug/l.
4. Zinc should be monitored if a Permittee uses zinc orthophosphate as a corrosion inhibitor.
5. Facilities using chloramination will be required to monitor ammonia nitrogen on a quarterly basis.
6. Parameters should be monitored in conjunction with toxicity test.
7. Fluoride monitoring applies if the facility backwashes with fluoridated, finished water.
8. See Special Condition A (2.) of NPDES Permit NC0044024.
All samples collected should be from a representative discharge event.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

Footnotes:
1. The duration of the discharge must be reported in addition to the total flow.
2. Limit and monitor only if the facility adds chlorine to water that is eventually discharged.
3. The Division shall consider all effluent TRC values reported below 50 ug/1 to be in compliance
with the permit. However, the Permittee shall continue to record and submit all values reported by
a North Carolina certified laboratory (including field certified), even if these values fall below 50
ugll.
4. Zinc should be monitored if a Permittee uses zinc orthophosphate as a corrosion inhibitor.
5. Facilities using chloramination will be required to monitor ammonia nitrogen on a quarterly basis.
6. Parameters should be monitored in conjunction with toxicity test.
7. Fluoride monitoring applies if the facility backwashes with fluoridated, finished water.
8. See Special Condition A (2.) of NPDES Permit NC0044024.
All samples collected should be from a representative discharge event.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

Please consider this correspondence as the quarterly report for the quarter ending 9/30/13 for the
above referenced project. The following activities have occurred through this reporting period:
1. Construction:
a. All construction activities have been substantially completed including the
Equalization Basin structure, Installation of 24" Residuals Influent, Installation of 24"
Overflow Line, Installation of Mixers and. Flow Control Structure, Electrical
Construction and Instrumentation, Installation of Gravel Drives and Seeding &
Matting.
b. Project reached Substantial Completion on Friday, September 27, 2013.
c. The Equalization Basin is currently being tested and evaluated by the City of
Albemarle.

Please consider this correspondence as the quarterly report for the quarter ending 3/31/13 for the
above referenced project. The following activities have occurred through this reporting period:
1. Construction:
a. Pre -Construction meeting held on 22 Jan 2013 (minutes attached). `Notice to
Proceed" issued 30 Jan 2013.
b. Construction activities currently underway including complete excavation of project
site for proposed concrete equalization basin. Erosion and sedimentation controls
installed. (RPR logs attached)
c. Shop drawings received and processed including concrete, reinforcing steel, mixers,
precast utility structures, etc.
d. Relocation of conflicting utilities underway.
e, Placement of reinforcing steel anticipated to start 4/1/13 with first concrete pour
following around 4/21/13.
f. Overall, project remains on schedule and has not experienced any unanticipated
delays, unforeseen site conditions or other issues that would jeopardize the target
completion date.

a. Owner has secured market financing for the project with funds deposited and

a. Project received bids on 11/1/12 with: eight received blds.
b. Project awarded to Gilbert Engineering Co. for a total bid amount of $667,142.00
c. Contractor has delivered fully executed agreements .with required insurance and
bonds to Owner.

a. It is anticipated that "Notice to Proceed' will be issued within the first two weeks of

Please consider this correspondence as The City of Aibemarle's request to modify the performance dates as
contained in the above referenced SOC agreement. This request for extension is due to various factors but
primarily is due to difficulties encountered during the geotechnical and subsurface utilities investigations.
initial geotechnical results indicated soil and rock conditions worse than initially expected. Subsequently
additional geotechnical field services, as well as additional subsurface utility locates, were initiated in order to
gather a more detailed understanding of the underlying existing site conditions. Preliminary design documents
where then modified accordingly precipitating additional time requirements.
With that the City of Albemarle would like to request the following dates be amended to' the SOC:
1, Begin Construction January 30`h, 2013
2. Complete Construction October 30th, 2013
3. Attain NPDES Compliance December 30th, 2013.
I would also like to relay that the project has received Authorization to Construct (ATC) from the NC DENR
Public Water Supply Section. The project is currently in solicitation with a bid opening date of November 1st
2012, I anticipate NC Local Government Commission action in December with construction commencing shortly
thereafter,

1. SOC approved for execution by the City of Albemarle City Council at their regularly
scheduled meeting on 9/19/2011,
2 Fully executed SOC mailed to NC DENR on 9/22/2011
3, Preliminary design efforts initiated including a review of available project data
(surveys and plant as -built drawings). Basis of design is currently being prepared for
review and approval by the City of Albemarle
