Comment: The 30-minute settleability test was 90 ml/L with a clear supemate at the time of the
inspection. The ORC and staff should investigate the additions of a food supplement (with
minimal to no grease content) during extended periods of no influent flow.
A check valve was not operating properly for one of the blower/motor units during the
inspection. The check valve must be repaired/replaced within the near future to ensure the
treatment facility has two operational blower/motors units.

The U.S. Environmental Protection. Agency (EPA) recently published the National Pollutant Discharge
Elimination System (NPDES) Electronic Reporting Rule. The rule requires NPDES regulated facilities to
report information electronically, instead of filing written paper reports. The rule does not change what
information is required from facilities. It only changes the method by which information is provided (i.e.,
electronic rather than paper -based).
EPA is phasing, in the requirements of the rule over a 5-year period. The two phases of the rule, and their
key milestones, are:
Phase 1—Starting on December 21, 2016, regulated entities that are required to submit Discharge
Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently
reporting your DMR data electronically using eDMR, then you simply need to continue reporting
in the same way as you are now. The key change is that, starting on December 21, 2016,
electronic reporting of DMRs will be required, instead of voluntary.
Phase 2 —Starting on December 21, 2020, regulated entities that are required to submit certain
other NPDES reports will begin submitting these reports electronically. Reports covered in the
second phase include Notices of Intent to discharge in compliance with an NPDES general permit,
Sewer Overflow/Bypass Event Reports, and a number of other NPDES program reports.
Incorporating Electronic Reporting Requirements into NPDES Permits
The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic
reporting requirements into NPDES permits beginning December 21, 2015. Under the new rule, the
electronic reporting process supersedes the paper reporting process. According to our files, your NPDES
permit became effective after November 2013, and should contain the requirement to electronically
report your Discharge Monitoring Reports using NC DWR's eDMR system.

to identify the initial recipient for the NPDES electronic reporting data [see 40 CFR 122.41(I)(9)]. Initial

recipient of electronic NPDES information from NPDES-regulated facilities (initial recipient) means the
entity (EPA or the state authorized by EPA to implement the NPDES program] that is the designated entity
for receiving electronic NPDES Data [see 40 CFR 127.2(b)]. Permittees are required to electronically
submit the required NPDES information to the appropriate initial recipient, as determined by EPA. By July
18, 2016, EPA must identify and publish on its web site and in the Federal Register a listing of initial
recipients by state and by NPDES data group. Once available, you can use EPA's web site to find out or
determine the initial recipient of your electronic submission,
NC DWR has submitted a request to EPA to be the initial recipient for the following NPDES data groups:
1. Discharge Monitoring Reports;
2. General Permit Reports [Notices of Intent to discharge (NOIs); Notices of Termination (NOTs)];
3. Pretreatment Program Reports; and
4. Sewer Overflow/Bypass Event Reports

submission for each state. Instructions on how to access and use the appropriate electronic reporting
tool will be available as well.

submitted electronically using eDMR, The eD.M.R, system allows .permitted facilities to enter monitoring data
and submit DivIRs electronically using the internet. Until such time that the state's eDMR, application is
compliant with EPA's Cross -Media Electronic Reporting Regulation (CROMERR), permittees will be required
to submit all discharge monitoring data to the state electronically using eDMR and will be required to complete
the eDMR submission by printing, signing, and submitting one signed original and a copy of the computer

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being
physically located in an area where less than 10 percent of the households have broadband access, then a
temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring
data may be submitted on paper DMR forms (MR 1, 1.1„ 2, 3) or alternative forms approved by the Director,
Duplicate signed copies shall be submitted to the mailing address above,
Requests for temporary waivers from the NPDES electronic reporting requirements must be submitted in
writing to the Division for written approval at least sixty (60) days prior to the date the facility would, be
required under this permit to begin using eDMR. Temporary waivers shall. be valid for twelve (12) months and

Section B. (11.)(a) or by a duly authorized representative of that person as described in Part II, Section B.
(11.)(b). A person, and not a position, must be delegated signatory authority for eDMR reporting purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user account

1 am in receipt of your letter dated March 19th in reference to the ammonia levels present in
our water sampling from the October 2014 self -monitoring report. Please be advised that this
past summer -fall our facility underwent a major renovation and included in the upgrade was a
lot of interior painting. l believe the increase in the ammonia content is a direct relation to the
cleaning of paint brushes by the painting sub -contractor. We had instructed there to please
not clean their brushes in sinks within the building but that did not always happen, The
renovations were completed in early December 2014 so our levels should be within the
allowable limits moving forward..
Also, please note that Deacon Guy Piche is no longer the director for the Conference Center. I
replaced Deacon Piche as director in December 2013 so all future correspondence pertaining to
the Center should be directed to my attention.

II. Compliance Performance:
The North Carolina Department of Environment and Natural
Resources (NCDENR) regulate the Catholic Conference Center
effluent discharge under the National Pollutant Discharge Elimination
System (NPDES). The NCDENR issued to Catholic Conference
Center a NPDES Permit that includes water quality limits and
sampling and monitoring requirements. The NPDES permit requires
Catholic Conference Center to test for routine wastewater parameters
of the treated water leaving the wastewater facility. The monitoring
frequency for these tests is set at various intervals as set forth in the
permit. During the year 2012, the Nh3n limit was exceeded on April
16, 2012. The reason being for the above non-compliance is the plant
has very little flow, if any, going through it during that time. The only
activity taking place is cleaning in the Facility. The following table is
a summary of the testing for the parameters that are assigned Water
Quality Standards by the NPDES Permit.
There were no bypasses or spills during 2012.

indicating a violation in November, 2010. This violation occurred when our operator used
a contaminated bottle to collect the sample and it was not discovered until the annual
report was being completed.
An amended L f}luent report was filed in January upon the discovery of the error. l
have enclosed a copy of your letter and the amended report for your records. No remedial.
action is needed and our system is operating according to our permit requirements.

II. Compliance Performance:
The North Carolina Department of Environment and Natural
Resources (NCDENR) regulate the Catholic Conference Center
effluent discharge under the National Pollutant Discharge Elimination
System (NPDES). The NCDENR issued to Catholic Conference
Center a NPDES Permit that includes water quality limits and
sampling and monitoring requirements. The NPDES permit requires
Catholic Conference Center to test for routine wastewater parameters
of the treated water leaving the wastewater facility. The monitoring
frequency for these tests is set at various intervals as set forth in the
permit. During the year 2010, the number of test conducted met the
required testing. In November, the facility was non -compliant due to
a high fecal. The reason these tests were performed on the treated
wastewater as it was discharged to the creek. The following table is a
summary of the testing for the parameters that are assigned Water
Quality Standards by the NPDES Permit.
There were no bypasses or spills during 2010.

to expiration of the current permit. If you have already mailed your renewal application, you may
disregard this notice.
Your renewal package must be sent to the Division postmarked no later than February 1, 2010.
Failure to request renewal by this date may result in a civil penalty assessment. Larger penalties may be
assessed depending upon the delinquency of the request.
If any wastewater discharge will occur after July 31, 201.0, the current permit must be renewed.
Discharge of wastewater without a valid. permit would violate North Carolina General Statute 143-215.1;
unpermitted discharges of wastewater may be assessed civil penalties of up to $25,000 per day.

issuance of the last permit. Subrnit one signed original and two copies.
A The completed application form (copy attached), signed by the permittee or an Authorized
Representative. Submit one signed original and two copies.
If an Authorized Representative (such as a consulting engineer or environmental consultant) prepares
the renewal package, written documentation must be provided showing the authority delegated to any

A narrative description of the sludge management plan for the facility. Describe how sludge (or other
solids) generated during wastewater treatment are handled and disposed. If your facility has no such
plan (or the permitted facility does not generate any solids), explain this in writing. Submit one signed
original and two copies.
The following items must be submitted by any Municipal or Industrial facilities discharging
process wastewater:
Industrial facilities classified as Primary Industries (sce Appendices .A-D to Tide 40 of the Code of Federal
Regulations, Part 122) and ALL Municipal facilities with a permitted flow? 1.0 MGD must submit a
Priority Pollutant Analysis (PPA) in accordance with 40 CFR Part 122.21.

The treatment system is an existing 0.020 MGD wastewater
Treatment facility with the following components:
• Bar screen
• Aeration basin
• Secondary clarifier with sludge return
• Chlorine contact chamber with tablet disinfections

This facility is located southwest of Hickory at the Catholic
Conference Center WWTP at 1551 Trinity Lane off NCSR 1.120 in
Catawba county. Discharge from the Catholic Conference Center
Wastewater facility is received into an unnamed tributary to Camp
Creek, classified WS-III Waters in the Catawba River Basin.

II. Compliance Performance:
The North Carolina Department. of Environment and Natural
Resources (NCDENR) regulates the Catholic Conference Center
effluent discharge under the National Pollutant Discharge Elimination
System (NPDES). The NCDENR issued to Catholic Conference
Center a NPDES Permit that includes water quality limits and
sampling and monitoring requirements. The NPDES permits requires
Catholic Conference Center to test for routine wastewater parameters
of the treated water leaving the wastewater facility. The monitoring
frequency for these tests is set at various intervals as set forth in the
permit. During the period at which Statesville Analytical was
responsible for the plant operations for the 2008-year a total of tests
were conducted. These tests were performed on the treated
wastewater as it was discharged to the creek. On February 5, 2008,
the heater on the BOD incubator went out and samples were frozen.
The following table is a summary of the testing for the parameters that
are assigned Water Quality Standards by the NPDES Permit.

Comment: The ORC's records were organized and well maintained. DMRs were
reviewed for the period November 07 through October 08. No limit violations were
reported and all monitoring frequencies were correct. The review of the DMRs revealed
the following discrepanices: the effluent fecal coliform monthly average value was not
calculated properly on several occasions, the permittee's information (address, phone
number) and permit expiration date were not documented on the back of the DMRs, and
no verification letters from the contracted laboratory were attached to the February 08
and July 08 DMRs regarding the "LA - lab accident " transcriptions.

conducted met required testing. For the months of February and
March the plant was non -compliant due to low-level chlorine limit
was not met because the de -chlorination unit had not been installed.
During the weeks of January 1— January 7, July 1 — July 8, September
4 — September 7 and December 24 — December 31, 2007, the facility
was closed.

This letter transmits a Notice of Violation and assessment of civil penalty in the amount
of $981.50 ($900.00 civil penalty + $81.50 enforcement costs) against the Catholic Conference
Center.
This assessment is based upon the following facts: A review has been conducted of the
self -monitoring data reported for February 2007. This review has shown the subject facility to be
in violation of the discharge limitations found in NPDES Permit No. NC0071447. The
violations are summarized in Attachment A to this letter.
Based upon the above facts, I conclude as a matter of law that the Catholic Conference
Center violated the terms, conditions, or requirements of NPDES Permit No. NC0071447 and
North Carolina General Statute (G.S.) 143-215.1(a)(6) in the manner and extent shown in
Attachment A. A civil penalty may be assessed in accordance with the maximums established by
G.S. 143-215.6A(a)(2).
Based upon the above findings of fact and conclusions of law, and in accordance with
authority provided by the Secretary of the Department of Environment and Natural Resources
and the Director of the Division of Water Quality, I, Robert B. Krebs, Surface Water Protection
Regional Supervisor for the Mooresville Region, hereby make the following civil penalty

Pursuant to G.S. 143-215.6A(c), in determining the amount of the penalty I have taken
into account the Findings of Fact and Conclusions of Law and the factors set forth at G.S. 1438-
282.1(b), which are:
(1) The degree and extent of harm to the natural resources of the State, to the public
health, or to private property resulting from the violations;
(2) The duration and gravity of the violations;
(3) The effect on ground or surface water quantity or quality or on air quality;
(4) The cost of rectifying the damage;
(5) The amount of money saved by noncompliance;
(6) Whether the violations were committed willfully or intentionally;
(7) The prior record of the violator in complying or failing to comply with programs
over which the Environmental Management Commission has regulatory authority;
and
(8) The cost to the State of the enforcement procedures.
Within thirty days of receipt of this notice, you must do one of the following:

Please be aware that a request for remission is limited to consideration of the five
factors listed below as they may relate to the reasonableness of the amount of the
penalty assessed. Requesting remission is not the proper procedure for contesting
whether the violation(s) occurred or the accuracy of any of the factual statements
contained in the civil penalty assessment document. Because a remission request
forecloses the option of an administrative hearing, such a request must be
accompanied by a waiver of your right to an administrative hearing and a
stipulation that no factual or legal issues are in dispute. Please prepare a detailed
statement that establishes why you believe the civil penalty should be remitted,
and submit it to the Division of Water Quality at the address listed below. In
determining whether a remission request will be approved, the following factors
shall be considered:
(1) whether one or more of the civil penalty assessment factors in G.S. 143B-
282.1(b) were wrongfully appliedto the detriment of the petitioner;
(2) whether the violator promptly abated continuing environmental damage
resulting from the violation;
(3) whether the violation was inadvertent or a result of an accident;
(4) whether the violator had been assessed civil penalties for any previous
violations; or
(5) whether payment of the civil penalty will prevent payment for the
remaining necessary remedial actions.
Please note that all information presented in support of your request for remission
must be submitted in writing. The Director of the Division of Water Quality will
review your evidence and inform you of his decision in the matter of your
remission request. The response will provide details regarding case status,
directions for payment, and provision for further appeal of the penalty to the
Environmental Management Commission's Committee on Civil Penalty
Remissions (Committee). Please be advised that the Committee cannot consider
information that was not part of the original remission request considered by the
Director. Therefore, it is very important that you prepare a complete and thorough
statement in support of your request for remission.
In order to request remission, you must complete and submit the enclosed
"Waiver of Right to an Administrative Hearing and Stipulation of Facts" form
within thirty (30) days of receipt of this notice. The Division of Water Quality
also requests that you complete and submit the enclosed "Justification for

ASSESSMENT FACTORS
1) The degree and extent of harm to the natural resources of the State, to the public
health, or to private property resulting from the violation;
The residual chlorine concentration in the effluent exceeded the permit limit on nine
monitored occasions during the month of February 2007. Since dechlorination equipment
had not been installed it is likely that the residual chlorine concentrations exceeded the
permit on each day during the month of February 2007. This is the first month of the
lowered permit limit for NC0071447 as the permittee was previously only required to
monitor the residual chlorine concentration. The permit limit was exceeded by 790-1,760
percent during the month.
2) The duration and gravity of the violation;
The permit was exceeded during the entire month of February and on one day during the
month of March 2007. The facility had dechlorination equipment installed in March
2007.
3) The effect on ground or surface water quantity or quality or on air quality;
Residual chlorine reacts with organic matter in water and creates disinfection by-products
(trihalomethanes, haloacetic acids, etc.) which at toxic to both humans and aquatic
organisms.
4) The cost of rectifying the damage;
The cost is unknown
5) The amount of money saved by noncompliance;
Money saved is equivalent to the cost for the design, installation, certification, and
operation of a dechlorination system.
6) Whether the violation was committed willfully or intentionally;
The permittee was given 18 months from the time of the last permit renewal to the time

the lower chlorine limit went into effe
7) The prior record of the violator in complying or failing to comply with programs
over which the Environmental Management Commission has regulatory authority;
The permittee has had no prior enforcement cases with the Division of Water Quality.

The Division of Water Quality has reviewed your letter of September 21, 2007, asking that the Division
consider the Roman Catholic Diocese of Charlotte's remission request in the matter of the subject case,
even though the request was submitted outside the statutory time frame allowed for such consideration.
You stated the reason for the delay in submitting the request was because your client requested this
action during a time when you were recovering from surgery,
While the Division has sympathy for your circumstance, we regret that we cannot accept this request. It
has simply arrived too far outside of the statutory time frame to be able to justify it as a legitimate
remission request. Even if could be allowed, the information provided in your letter as justification for
remission does not impress this office as being compelling because the permittee was given eighteen
months before the total residual chlorine limit carve into effect, but did not contract for installation of
necessary improvements until after that compliance schedule had expired.

I am writing to you with a great deal of embarrassment. I
represent the Roman Catholic Diocese of Charlotte which has
churches, agencies, schools and other offices scattered amongst the
46 western -most counties of the State of North Carolina. Included
within the Diocese is the Catholic Conference Center located in
Hickory, North Carolina. Back on July 16, 2007, Rev. Mr. Guy
Piche', the Director of Properties for the Diocese of Charlotte,
provided to me a letter which was a Notice. of Violation and
Assessment of Civil Penalty and requested that I prepare a response
to request a remission based on the facts that the Catholic
Conference Center had previously not been assessed any civil
penalties, that the Catholic Conference Center had abated any
environmental damage resulting from the violation and that the
violation occurred as a result of a very recent change in the law
dealing with chlorine and its use. The Catholic Conference Center
as a result of the change had availed itself of an architect's
services and a contractor to make the necessary corrections to be
in compliance with the law. The initial request for a contractor's
services was on February.26, 2007 and the contractor's work was
completed on March 19, 2007.
The request to allow my client the opportunity to submit a
request for remission is not likely taken. I suppose that I have
the same problem as many others in that we all have a lot of work
to do and not enough time to do it in. I have searched my memory
to determine why I just simply forgot to act on behalf of my client

and the only thing that I can put my finger on is that I had
undergone heart surgery the week before at Presbyterian Hospital on
July 10th and at the time Rev. Mr. Piche' approached me, I was still
operating at a high anxiety level. My client certainly should not
be penalized for my inconvenience or neglect.

your earliest convenience.

I am writing to you with a great deal cal:: embarrassment. I
represent the Roman Catholic Diocese of Charlotte which has
churches, agencies, schools and other offices scattered amongst the
46 western -most counties of the State of North Carolina. Included
within the Diocese is the Catholic Conference Center located in
Hickory, North Carolina. Back on July 16, 2007, Rev. Mr. Guy
Piche', the Director of Properties for the Diocese of Charlotte,
provided to me a letter which was a Notice of Violation and
Assessment of Civil Penalty and requested, that 1 prepare a response
to request a remission based on the facts that the Catholic
Conference Center had. previously not been assessed any civil
penalties, that the Catholic Conference Center had abated any
environmental damage. resulting from the violation and that the
violation occurred as a result of a very recent change in the law
dealing with chlorine and its use. The Catholic Conference Center
as a result of the change had availed itself of an architect's
services and a contractor to make the necessary corrections to be
in compliance with the law. The initial request. for a contractor's
services was on February 26, 2007 and the contractor's work was
completed on March 19, 2007.
The request to allow my client the opportunity to submit a
request for remission is not likely taken. I suppose that I have
the same problem as many others in that we all have a lot of work
to do and not enough time to do it in. I have searched my memory
to determine why I just simply forgot to act on behalf of my client

and the only thing that I can put my finger on is that I had
undergone heart surgery the week before at Presbyterian Hospital on
July 10th and at the time Rev. Mr. Piche' approached me, I was still
operating at a high anxiety level. My client certainly should not
be penalized for my inconvenience or neglect.

A fast track application for Authorization to Construct dechlorination facilities was
received on January 16, 2007, by the Division. Authorization is hereby granted for the
construction of modifications to the existing Catholic Conference Center WWTP with discharge
of treated wastewater into Camp Creek in the Catawba River Basin.
This authorization results in no increase in design or permitted capacity and is awarded
for the construction of the following specific modifications:
Installation of a dechlorination system utilizing sodium sulfite pursuant to the fast
track application received on January 16, 2007, and in conformity with the
Minimum Design Criteria for Dechlorination Facilities.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of
NPDES Permit No. NC0071447 issued April 18, 2005, and shall be subject to revocation unless
the wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified in Permit No. NC0071447.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by this Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.
The Mooresville Regional Office, telephone number [phone], shall be notified at
least forty-eight (48) hours in advance of operation of the installed facilities so that an on site

inspection .can be made. Such notification to the regional. supervisor shall be made during the
.normal office hours from 8;00 a..m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays..
Pursuant to 15A NCAC 214 .0140, upon completion of construction and prior to operation oi
these permitted facilities, the completed Engineering Certification form attached to this permit shall be
submitted to the address provided on the forin.
Upon classification of th.e facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to he in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of (he type and grade at least
equivalent to or greater than the classification assigned to the wastewater treatment facilities by
the Certification Commission.
The Permittee must also employ a certified back-up operator of the appropriate type and
grade to comply withthe conditions of T1.5A.:8G.0202. The ORC of the facility must visit each
Class:, I facility at least weekly and each Class II, III and IV facility afleast daily, excluding
weekends and .holidays, must properly manage the facility, must document daily operation and
maintenance of the facility, and must comply with all other conditions of TI5A:8G.0202,
A copy of the approved plans and specifications shall be rnaintained on file by the
Perminee for the life of the facility.
During the construction of the proposed additions/modifications, the permittee shall
continue to properly maintain and operate the existing wastewater treatment facilities at all times,
and in such a manner, as necessary to comply with the effluent limits specified in the NPDES
Permit.
You are reminded that it is mandatory tor the project to be constructed in accordance
with the North Carolina Sedimentation Pollution Control Act, and, When applicable, the North.
Carolina Dam Safety Act. In addition, the .specifications must clearly state 'what the contractor's
responsibilities shall be in complying with these Acts.
Failure to abide by the requirements contained in this Authorization to Construct rnay
subject the Permittee to an enforcement action by the Division of Water Quality in accordance
with North Carolina General Statute 143-215.6A to 143-215,6C,
The issuance of this Authorization to Construct does not preclude the Pertnittee from
complying with any and all statutes, rules, regulations, or ordinances which may be imposed by
other government. agencies (local, state, and federal) which have jurisdiction.

We are in receipt of your letter of June 16t and the attached
Evaluation Inspection report, We are pleased to note that once again our
treatment plant has received a satisfactory rating in all categories. We
make a concerted effort to ensure continuous compliance and it is grati-
fying to see that we have been successful in those efforts.
We also note several corrective actions you have requested and
wish to assure youthat your concerns are being addressed. Statesville
Analytical personnel have agreed to install the additional grating you
recommended to them during your visit here. We have retained a local
contractor to repair the roadbed in those areas where it is deficient in order
to ensure that the plant is accessible to all vehicles in any kind of weather.
These items will be completed as soon as practicable. I trust that this will
satisfy your concerns regarding safety and access to the plant.
One final note: I will be retiring on July 1, 2005. The official con-
tact person for the Catholic Conference Center in regard to the treatment
plant after that date will be: Rev. Mr. Guy A. Piche - Director of the Center.

PERMIT:
The permit authorizes the continued operation of an existing 0.020 MGD wastewater treatment
system consisting of a bar screen, aeration basin, secondary clarifier with sludge return, and a chlorine
contact chamber with tablet disinfection.
2005.
The permit for this facility became effective on November 1, 2000 and will expire on July 31,
RECORDS AND REPORTS:
Records and reports consisting of monthly monitoring reports, chain of custody forms, lab analysis
reports, calibration logs, and Operator -in -Responsible Charge/maintenance log were reviewed at the time
of the inspection. The records were organized and well maintained.
FACILITY SITE REVIEW/OPERATIONS & MAINTENANCE:
All treatment units seemed to be operating properly, and the facility was well maintained. The
mixed liquor appeared well mixed and adequately oxygenated Screenings are disposed at the county
landfill. Process control consists of settleability tests which are done twice a month. Sludge wasting is
based on settleability tests.
The facility is staffed with a Grade 11 ORC. A certified back-up operator has been designated and
is available when the ORC is unable to visit the facility.
LABORATORY:
Statesville Analytical (Certification #440) in Statesville, North Carolinaprovides analytical
support. The lab was not evaluated during this inspection. The pH meter, TRC meter, and thermometer
appeared to be properly calibrated:
EFFLUENT/RECEIVING WATERS:
The facility was not discharging at the time of the inspection. The facility discharges into an
unnamed tributary to Camp Creek, which is a Class WS III water in the Catawba River Basin. The
receiving stream did not appear to be negatively impacted. The outfall location was accessible and well
maintained.
SELF -MONITORING PROGRAM:
Self -monitoring reports were reviewed for the period November 2002 through October 2003.
Review of the DMRs indicated numerous TRC values in excess of 28ug/I. Be aware that a stream
standard of.l7ug/1 has been established for total residual chlorine for chronic toxicity effects, with 28ug/1
set as the maximum allowable effluent concentration to protect the receiving stream against acute toxicity
effects. Please maintain the total residual chlorine concentration as low as possible, while still complying
with fecal coliform limits.
FLOW MEASUREMENT:
Instantaneous flow is measured by the bucket and stopwatch method.
SLUDGE DISPOSAL:
Sludge is removed as needed by Robert's Septic Tank Service, Inc. of Maiden, North Carolina and
disposed at the City of Newton Clarks Creek WWI?.

2H.0105(e)) regulations require that permit renewal applications must be filed at least 180 days prior to expiration of

solids) generated during wastewater treatment are handled and disposed. If your facility has no such
plan (or the permitted facility does not generate any solids), explain this in writing. Submit one signed
original and two copies.
The following items must be submitted by anyMunicipal or Industrial facilities discharging
process wastewater.
Industrial facilities classified as Primary Industries (see Appendices A D to Title 40 of the Code of Federal
Regulations, Part 122) and ALL Municipal facilities with a permitted flow ? 1.0 MGD must submit a
Priority Pollutant Analysis (PPA) in accordance with 40 CFR Part 122.21.
The above requirement does NOT apply to privately owned facilities treating 100%
domestic wastewater, or facilities which discharge non process wastewater (cooling
water, ifiterbackwash, etc.)

The facility was last inspected by Wes Bell of this office on November 30, 2000.
PERMIT:
The permit authorizes the continued operation of an existing 0.020 MGD wastewater
treatment system consisting of a bar screen, aeration basin, secondary clarifier with sludge return,
chlorine contact chamber with tablet disinfection.
The permit for this facility became effective on 11/1/00 and expires on 7/31/05.
RECORDS AND REPORTS:
Records and reports consisting of discharge monitoring reports (DMRs), laboratory analyses,
chain of custody forms, Operator -in -Responsible Charge (ORC)/maintenance log, and calibration
data were reviewed on -site at the time of the inspection. The records were organized and well
maintained.
FACILITY SITE REVIEW/OPERATIONS & MAINTENANCE:
The process units appeared to be operating properly and the surrounding grounds were well
maintained. The mixed liquor appeared to be adequately oxygenated and well mixed. Screenings
are disposed at the county landfill. The ORC was very knowledgeable of the treatment processes
and equipment used at the facility.
The process control program consists of settleability tests. This office recommends the
increase in frequency of the settleability measurements to twice per month. Sludge wasting is based
on the settleability tests. The facility is staffed with one Grade II ORC. A certified backup operator
has been designated and is available when the ORC is unable to visit the facility.
LABORATORY:
Statesville Analytical (Certification # 440) of Statesville, N.C. has been contracted to provide
analytical support. The laboratory was not evaluated during this inspection. The pH and TRC meters
and thermometer appeared to be properly calibrated.
EFFLUENT/RECEIVING STREAM:
The effluent was clear with no floatable solids or foam. The facility discharges into an
unnamed tributary to Camp Creek, which is a WS-III water in the Catawba River Basin. The outfall
location was well maintained and accessible. The receiving stream did not appear to be negatively
impacted.
A review of the DMRs have indicated numerous TRC values in excess of 28,41. Be aware
that a stream action level of 17gg/1 has been established for total residual chlorine for chronic
toxicity effects. An action level of 28,2g/1 has been set as the maximum allowable effluent
concentration to protect the receiving stream against acute toxicity effects. Please maintain the total
residual chlorine concentration as low as possible, while still complying with fecal coliform limits.

SELF -MONITORING PROGRAM:
Self -monitoring reports were reviewed for the period March 2001 through February 2002,
inclusive. No limit violations were reported. Only one TRC value was reported for the week of
March 25 through March 31, 2001. The inspection verified that the second TRC value was collected
and analyzed; therefore, the ORC will resubmit an amended DMR. All monitoring frequencies were
correct.
All field analyses appeared to have been collected and analyzed within the required holding
times and all samples appeared to be properly preserved.
FLOW MEASUREMENT:
Effluent flow is measured instantaneously by a bucket and stop watch.
SLUDGE DISPOSAL:
Sludge is removed by Robert's Septic Tank Service, Inc., of Maiden, N.C. and disposal is
at the City of Newton Clarks Creek WWTP.
SEWER OVERFLOW:
Please be advised that pursuant to Part II, Section E of your NPDES permit, and North
Carolina Administrative Code (NCAC) 15A 2B .0506 (a)(2), any failure of a collection system,
pumping station or treatment facility resulting in a bypass without treatment of all or any portion of
the wastewater shall be reported to the central office or the appropriate regional office (Mooresville
Regional Office 704-663-1699) as soon as possible but no later than 24 hours from the time the
permittee became aware of the bypass. Overflows and spills occurring outside normal business hours
may also be reported to the Division's Emergency Response personnel at 800-662-7956, 800-858-
0368, or 919-733-3300. A written report shall also be provided within five (5) days of the time of
the incident. The report shall contain a description of the bypass, and its cause; the period of the
bypass, including exact dates and times, and if the bypass has not been corrected, the anticipated time
it is expected to continue; and steps taken (or planned) to reduce, eliminate, and prevent recurrence
of the similar events. Any spill that reaches surface waters (i.e. any spill that reaches any water
already present in a conveyance, stream, ditch, etc...) or any spill greater than 1,000 gallons on the
ground that does not reach surface waters must be reported.
An adequate spill response for those spills reaching surface waters should include an
evaluation downstream of the point at which the spill entered surface waters to determine if a fish
kill occurred. The evaluation should also include the collection of upstream dissolved oxygen and
pH measurements for background information and dissolved oxygen and pH measurements at
multiple points downstream of the entry point to document any negative impact. Failure to report
the bypass of collection system, pumping station or treatment facility subjects violators to penalties
of up to $25,000.00 per day per violation.
