Proposing using approx. 500 sq ft of limited use buffer for patio space with retaining walls (max 3 ft due to grade) as walk out area for lower level. Our intention is to keep all major use to the first ten feet of the buffer and the rest of the limited use buffer would be simply for walking, maybe some gardening landscaping additions and natural paths to get to dog area and to walk around home. No intense use is envisioned. 2. The usable potion of this lot is long and narrow and is limited by a 60' setback in the deed and by a maximum width of 50 feet outside of the buffer which both undisturbed and limited use occupy 2/3 of total lot. VVe have worked hard to configure the structure to stay entirely out of the buffer but to use the site and topography we need to use some of the buffer to accommodate walk out areas from the lower level and for patio spaces. 3. All run off from any new patios will be controlled and planting areas will surround all impervious surfaces. 4. (1) Our goal here is to design a home that will be a credit to the Rosemont Ave azea and to avoid if possible having the only element facing the street being a two car garage door. The topography of the lot dictates a walk out lower level and to do that we need some walking space outside, if all this had to be done outside the limited use buffer the house would have to hug the side property line and present a very limited face to Rosemont Ave. (2) At the 60 foot setback line (by deed restriction) the lot is 160 feet wide yet 100 feet of that id in buffer and 7.5 in side setback leaving only 52.5 feet for the proposed home also the lot has a substantial slope that limits the design options for the new home if we desire to be an addition rather than a distraction to the neighborhood. Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation far project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Perimt/40i CertificatiodCAMA permit within this lime frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule anci policies listed at www.nceep.net. If the regulatory agencies require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of Bnvironment and Natural Resources and the U. S.
