The Washington Regional Office received a completed Stormwater Renewal and Name Change Application
for the subject project on June 28, 2007. Staff review of the files and an on site inspection has determined that the
project will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit
No. SW7980513 dated November 1, 2007 to Currituck Commercial Center Property Owners' Association, Inc. for a
wet detention pond to serve the Currituck Commercial Center located in Moyock, NC.
This permit shall be effective from the date of issuance until November 1, 2017 and shall be subject to the
conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance
requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater
management system will result in future compliance problems. The issuance of this permit does not resolve any
previous violations of the stormwater rules or permit conditions.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This
request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes,
and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699.6714. Unless such
demands are made this permit shall be final and binding.

NCAC 2H.1000 (hereafter referred to as the "stormwater rules') and the approved stormwater management plans
and specifications and other supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit for a wet detention pond to serve the Currituck Commercial Center
located in Moyock, NC.
This permit shall be effective from the date of issuance until November 1, 2017 and shall be subject to the following
specified conditions and limitations:
DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the application
and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on page
2 of this permit, the Project Data Sheet.
3. A maximum of 16.4 acres of built upon area is allowed.
4. All stormwater collection and treatment systems must be located in either dedicated common areas or
recorded easements. The final plats for the project will be recorded showing all such required easements, in
accordance with approved plans.
5. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of
the permit.

6. No homeowner/lot owner/developer shall be allowed to fill in, after, or pipe any vegetative practices (such as
swales) shown on the approved plans as part of the stormwater management system without submitting a
revision to the permit and receiving approval from the Division.
The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size
b. Project name change
C. Transfer of ownership
d. Redesign or addition to the approved amount of built -upon area
e. Further subdivision of the project area.
In addition, the Director may determine that other revisions to the project should require a modification to the
permit.
8. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written
time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall
provide copies of revised plans and certification in writing to the Director that the changes have been made.
11. SCHEDULE OF COMPLIANCE
The permittee will comply. with the following schedule for construction and maintenance of the stormwater
management system.
a. The stormwater management system shall be constructed in its entirety, vegetated and operational
for its intended use prior to the construction of any built -upon surfaces except roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be
repaired immediately.
2. The facilities must be properly maintained and operated at all times. The approved Operation and
Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals.
3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency including, but not limited to:
a. Semiannual scheduled inspections (every 6 months)
b. Sediment removal
C. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved plans and specifications
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
4. Records of maintenance activities must be kept and made available upon request to authorized personnel of
DWQ. The records will indicate the date, activity, name of person performing the work and what actions were
taken.
5. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data.
6. Upon completion of construction and prior to operation of this permitted facility, a certification must be
received from an appropriate designer for the system installed certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other supporting
documentation. Mail the Certification to the Washington Regional Office, 943 Washington Square Mall,
Washington, North Carolina, 27889, attention Division of Water Quality.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the
project.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is
a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality
accompanied by an application fee, documentation from the parties involved, and other supporting materials
as may be appropriate. The approval of this request will be considered on its merits and may or may not be
approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-
215.6(a) to 143-215.6(c).
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)
which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, .including the creation of nuisance conditions, the
Permittee shall take immediate corrective action, including those as may be required by this Division, such as
the construction of additional or replacement stormwater management systems.
5. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a
permit modification, revocation and reissuance or termination does not stay any permit condition.
6. The Permittee, at least six (6) months prior to the expiration of this permit, shall submit in writing a request for
an extension along with appropriate application fee.

WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT�tjg,p g
Maintenance activities shall be performed as follows: JUN 2 8 2007

vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is reduced to
75% of the original design depth (see diagram below). Removed sediment shall be disposed of in an
appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e.
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads feet in the main pond, the sediment shall be removed.
When the permanent pool depth reads' feet in the forebay, the sediment shall be removed.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
6. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through
the emergency drain shall be minimized to the maximum extent practical.
7. All components of the wet detention basin system shall be maintained in good working order.
8. Remove all trees and heavy woody vegetation from the basins and dike walls.

This office received a Coastal Stormwater permit renewal and name change application for the subject
project on June 28, 2007. A preliminary review of your project indicates that before a Stele Stormwater permit can
be issued the following additional information Is needed:
Please submit an engineers certification that the wet detention pond serving this project has been
built according to the approved plans. This certification is required by Part II. 6. of permit SW7980513
issued October 30, 108.
The above requested information must be received in this office prior to October 10, 2007 or your
application will be returned as incomplete. The return of this project will nece 3itate resubmittal of all required
items including the application fee. If you need additional time to submit the required information, please mail or
fax your request for time extension to this office at the Letterhead address.
You should also be aware that a Stormwater permit is required for continued operation of the treatment
system. Operation without a permit is a violation of 15A NCAG 2H,1000 and North Carolina General Statute 143-
215.1 and may result in civil penalties of up to $25,000 per day.

Seven Hundred Dollars, and through the ten months free work of David Cross, Realtor, has been brought in
FULL compliance with ALL State and County rules, requirements and regulations; the North Carolina
Department of Transportation has assumed control and management of all the roads in Currituck Commercial
Center, ALL without any expense to the members of Currituck Commercial Center Property Owners
Association, Inc.
What needs to be done NOW is to call/reconvene the annual meeting by the officers; each property owner
should attend or be represented by proxy, elect new officers, who are willing to serve; continue the contract with
Sanders Grading and Excavation to maintain the retention pond and ditch, at an annual cost of approximately
$3,600.00; each tract owner is responsible for the ditch on its property; file the annual report with the Secretary
of State and collect the annual dues, which now should be reduced to $300.00 per tract. In 2004, CCCPOA, Inc.
assumed the management/control of CCC. All of the records/files of CCCPOA, Inc. (we have a copy) are now
in the possession of President Thomas 0. Vinick, D.C.
THANK YOU FOR YOUR COURTESY AND COOPERATION. We have done EVERYTHING
required/requested and we are now completely through with any further obligation/responsibility. Due to recent
spinal surgery, Rosabelle is unable to travel. All of the tracts in CCC since their formation, have more than

We have performed an as -built survey at Currituck Commercial Center for the purpose
of determining whether the drainage system, including swaies, culverts and conveyance
systems to the off -site drainage facilities, has been constructed in substantial
conformance with the construction plans and/or within a tolerance of 0.2 feet of proper
grades, In accordance with standards promulgated by NCDOT for the purpose of
accepting roads into the state system for maintenance.
The as -built survey showed that a number of culvert pipes had been laid at improper
grades, and several sections of swale (both roadway and collection swales) needed to
be regraded.
Specifications were prepared for corrective action to these drainage facilities. After the
corrective action plan was implemented; an additional as -built survey was performed to
demonstrate compliance with the plan.
Based on this final survey, it Is our opinlon that the drainage facilities serving Currituck
Commercial Center have now been Installed to proper grades within the tolerance
specified by NCDOT, and should therefore be eligible for assumption into the state
roadway system for maintenance. A copy of the as -built survey is included for your
record.

Currituck Commercial Center for the second time, at an additional cost to us in excess of Forty -Three Thousand
Seven Hundred Dollars, and through the ten months free work of David Cross, Realtor, has been brought in
FULL compliance with ALL State and County rules, requirements and regulations; the North Carolina
Department of Transportation has assumed control and management of all the roads in Currituck Commercial
Center, ALL without any expense to the members of Currituck Commercial Center Property Owners
Association, Inc.
What needs to be done NOW isyo calUreconvene the annual meeting by the officers, each property owner
should attend or be represented by proxy, elect new officers, who are willing to serve; continue the contract with
Sanders Grading and Excavation to maintain the retention pond and ditch, at an annual cost of approximately
$3,600.00; each tract owner is responsible for the ditch on its property; file the annual report with the Secretary
of State and collect the annual dues, which now should be reduced to $100.00 per tract. In 2004, CCCPOA, Inc,
assumed the management/control of CCC. All of the records/tiles of CCCPOA, Inc. (we have a copy) are now
in the possession of President Thomas O. Viniek, D.C.
THANK YOU FOR YOUR COURTESY AND COOPERATION. We have done LVERYTHING
required/requested and we are now completely through with any further obligation/responsibility. Due to recent
spinal surgery. Rosabelle is unable to travel. Ali of the tracts in CCC since their formation, have more than
doubled in value and with a little combined effort by all the members, will continue to increase. Many hands
make for light work; no ship will sucessfully sail by itself.

management system serving Currituck Commercial Center, regulated under the referenced
DWQ permit. Following our investigation, corrective actions were implemented by the
developer last year to bring the stormwater management system into compliance with both
the DWQ permit and the NCDOT roadway drainage standards. Following corrective actions,
we performed a verification survey and engineering review of the Improved facilities this past
December.
Based on that review, the stormwater management system serving Currituok Commercial
Center appears to be In substantial conformance with the plans and specifications that were
approved under Permit SW7980513 Issued October 30. 1998.

for permit renewal and name change.

application will be returned as incomplete. The return of this project will necessitate resubmittal of all required
Items including the application fee. If you need additional time to submit the required Information, please mail or
fax your request for time extension to this office at the Letterhead address.

This office received a Coastal Stormwater permit renewal and anaa_apWja iWilfor the subject
project on June 28, 2007. A preliminary review of your project indicates that before a Stale Stormwater permit can
be Issued the following additional information is needed:
1. Please submit an engineers Certification that the wet detention pond serving this project has been
built according to the,approved plans. This certification is required by Part It. 6. of permit SW7980513
issued October 30, 1998.
The above requested information must be received in this office prior to October 10, 2007 or your
application will be returned as incomplete. The return of this project will necessitate resubmittal of all required
items including the application fee. If you need additional time to submit the required information, please mail or
fax your request for time extension to this office at the Letterhead address.
You should also be aware that a Stormwater permit is required for continued operation of the treatment
system. Operation without a permit is a violation of 15A NCAC 21-1.1000 and North Carolina General Statute 143-
215.1 and may result in civil penalties of up to $25,000 per day.

Here is an update on my efforts to get CCC's roads accepted into the State Highway System
The grading work lids been completed per the engineer's plan and approved by the engineer. We
made several adjustments per NCDOT's requests. The disturbed soil will be hydro-aceded very
soon and as soon as the grass begins to grow. I can take the engineer's certification letter to
NCDOT to get the roads accepted. We are getting close.
I have received a price from Sanders Excavating & Clearing for t1Le maimenwice of the retention
pond. He will clean and mow the banks and gel the retention pond in shape for $2,400.00. He
further proposes to mow/clean the pond area four times per year for an annual cost of S 1,200.00.
If additional repairs to the pond or ditches are needed, he will provide an estimate at that time. 11
the individual lot owners properly maintain their lots and ditches, there should be little to no
additional work needed year in/year out. Properly owners should regularly police their lots and
pick up all trash, eliminate/avoid piles of grass clippings/leaves/trash in the bottoms of ditches.
These obstructions contribute over time to change the grade of the ditches. At some point in the
Apure, depending on the amount of sed menat/trash accutttulation, the pund will have to be
drained and dredged. I have been told this typically occurs about every 10 to 15 years
Pleaso let me know if Mr. Sander's bid is acceptable and I will advise him to continence work at
his earliest opportunity. 1 will lot you know when I get the certification and D07" approval.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW7980513
for Currituck Commercial Center on October:30, 1998. This permit expires on October 30, 2008.
Section .1003(h) of 15 A NCAC 2H .1000'(the stormwater rules) requires that applications for petmit
renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a
processing fee, which is currently set at $420.00. If this is still an active project please complete and
submit the enclosed renewal application in a timely manner. If this project has not been constructed
and a permit is no longer needed, please submit a request to have the permit rescinded. If you have
sold the project, or are no longer the permittee, please provide the name, mailing address and phone
number of the person or entity that is now responsible for this permit. Enclosed is a form for change of
ownership, which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000 per day.

This project consists ofthe construction ofa wastewater utility area with associated gravel drive
and parking, and asphalt roadway construction with drainage infrastructure to serve the future
development ofa 16-tract commercial subdivision.
The site is located near the intersection of NC Rte.168 & Six 1215 in Moyock, Currituck County,
North Carolina. Site soils are composed of Roanoke line sandy loams described as being nearly
level, poorly drained soils on broad flats in slightly depressed drainageways. The site contains an
average seasonal high water table depth of 24" below the ground surface at an elevation of
approximately 6.5' msl.
The site has been divided into (4) drainage basins to clearly define the path of the stormwater
runoff: The location of these basins are generally located in the following sequence; Basin # 1
(south), Basin #2 (east), Basin #3 (west), Basin #4 (north). (Basins # 1-4 can be referenced on
sheet 34270st2)
Basin #1
The area delineated as Basin # 1 consists of the following: the east half of Currituck Commercial
Dr., the north 'h of Commerce Dr., approximately '/2 of the southern portion of Tract 1, and the
entire areas within Tracts 2-6. Development in the aforementioned areas consist of the
construction of asphalt drives with associated drainage infrastructure, with the exception ofthe
undeveloped Tracts 1-6, (these are part of future development and will be assumed that 80% will
contain impervious coverage).
Southern '/2 of Tract 1
To manage stormwater runoff from Tract 1, rainfall will sheet flow from all future
impervious surfaces and green areas to swales that will be constructed along the northern
and southern property lines. Runoff will be conveyed from east to west along the property
line swales to the roadway swale located along Currituck Commercial Drive, (the Swale
along the northern property line is delineated as Basin 83 and runoff and will be detailed in
the corresponding section). Once the stormwater flows into the roadway swale, it will
travel south along Currituck Commercial Drive, to the roadway culvert. This culvert will
then transport the runoff west across Currituck Commercial Drive to a ditch (See Ditch
Section A), located along the southern property line of "Tract 11. Runoff will then be
conveyed from the property line ditch of Tract I I to a ditch that runs parallel to the wet
detention basin, (See Ditch Section B). Stormwater will flow from south to north,
approximately 350', until it connects with a ditch (See Ditch Section A) that serves as the
inlet to the wet detention basin.

Currituck Commercial Drive. Once the stormwater flows into the adjoining roadway
swale, it will travel to the north along Currituck Commercial Drive to the roadway culvert.
This culvert will then transport the runoff west across Currituck Commercial Drive to a
ditch (See Ditch Section A), located along the southern property line of Tract 11. Runoff
will then be conveyed from the property line ditch of Tract I I to a ditch that runs parallel
to the wet detention basin (See Ditch Section B). Stormwater will flow from south to
north, approximately 350', until it connects with a ditch (See Ditch Section A) that serves
as the inlet to the wet detention basin.

drainage arrows on sheet 34270st2 for flow direction), to the roadway culvert located to
the west of Tract 5. This culvert will then transport the runoff west across Currituck
Commercial Drive to a ditch (See Ditch Section A), located along the southern property
line of Tract 11. Runoff will then be conveyed from the property line ditch of Tract 1 I to a
ditch that runs parallel to the wet detention basin, (See Ditch Section B). Stormwater will
flow from south to north, approximately 350', until it connects with a ditch (See Ditch
Section A) that serves as the inlet to the wet detention basin.
Basin #2
The area delineated as Basin 92 consists of the following: the west '/ of Currituck Commercial
Dr. including the cul-de-sac (up to Tract 12), the south '/z of Commerce Dr., approximately'/ of
the southem portion of Tract 9, the wastewater utility area, and the entire areas within Tracts 7 &
8. Development in the aforementioned areas consist of, the construction of a gravel drive and
parking, asphalt drives with associated drainage infrastructure, and the construction of a wetland
forebay and lagoon within the wastewater utility area. Items that are excluded from this proposed
development are the undeveloped Tracts 7-9, (these are part of future development and will be
assumed that 80% will contain impervious coverage).
Tract 7
To manage stormwater runoff from Tract 7, rainfall will sheet Flow, from all future
impervious surfaces and green areas, into the roadway swales along Commerce and
Currituck Commercial Drives. Runoff will then travel west, around the cul-de-sac to the
north along Currituck Commercial Drive. The roadway swale connects with a ditch
located along the southern property line of Tract I I (See Ditch Section A). Runoff will
then be conveyed from the property line ditch of Tract I I to a ditch that runs parallel to the
wet detention basin (See Ditch Section B). Stormwater will flow from south to north,
approximately 350', until it connects with a ditch (See Ditch Section A) that serves as the
inlet to the wet detention basin.
Tract 8
To manage stormwater runoff from "Tract 8, rainfall will sheet flow, from all future
impervious surfaces and green areas, into the roadway swales along Currituck Commercial
Drives. Runoff will then travel west, around the cul-de-sac to the north along Currituck
Commercial Drive. The roadway swale connects with a ditch located along the southern
property line of Tract I I (See Ditch Section A). Runoff will then be conveyed from the
property line ditch of Tract I 1 to a ditch that runs parallel to the wet detention basin (See
Ditch Section B). Stormwater will flow from south to north, approximately 350', until it
connects with a ditch (See Ditch Section A) that serves as the inlet to the wet detention

Wastewater Utility Area
To manage stormwater runoff from Wastewater Utility Area, rainfall will sheet flow, t'rom
all impervious surfaces and green areas, into the roadway Swale along Currituck
Commercial Drive and the southern property line swale along Tract 9 (the area,,, within the
lagoon and wetland forebay are self-contained and designed for a storage capacity ofa 10-
yr-24-hour storm event). Stormwater will be transferred from the property line swalc to the
intersecting roadway swale along the cul-de-sac. Runoff will then travel around the cul-dc-
sac to the north along Currituck Commercial Drive. The roadway Swale connects with a
ditch located along the southern property line of'Tract I I (See Ditch Section A). Runoff
will then be conveyed from the property line ditch of Tract I I to a ditch that runs parallel
to the wet detention basin (See Ditch Section B). Stormwater will flow from south to
north, approximately 350', until it connects with a ditch (See Ditch Section A) that serves
as the inlet to the wet detention basin.
Southern '/2 of Tract 9
To manage stormwater runoff from southern % of Tract 9, rainfall will sheet flow, from all
future impervious surfaces and green areas, into the southern property line Swale.
Stormwater will be transferred from the property line swale to the intersecting roadway
swale along the cul-de-sac. Runoff will then travel around the cul-de-sac to the north along
Currituck Commercial Drive. The roadway swale connects with a ditch located along the
southern property line of Tract 11 (See Ditch Section A). Runoff will then be conveyed
from the property line ditch of Tract I I to a ditch that runs parallel to the wet detention
basin (See Ditch Section B). Stormwater will flow from south to north, approximately
350', until it connects with a ditch (See Ditch Section A) that serves as the inlet to the wet

Western %2 of Currituck Commercial Drive
To manage Stormwater runoff from western '/z of Currituck Commercial Dr. (up to the
Tract 12 property line), rainfall will sheet flow from all impervious surfaces and green
areas into the roadway swale along Currituck Commercial Drive. Runoff will flow north or
south, (please refer to drainage arrows on sheet 34270st2 for flow direction), until it
connects with a ditch located along the southern property line of Tract 11, (See Ditch

Northern '/2 of Tract 9
To manage stormwater runoff from southern '/z of Tract 9, rainfall will sheet flow, from all
future impervious surfaces and green areas, into the northern property line Swale.
Stormwater will be transferred from the property line Swale to a ditch that runs parallel to
the wet detention basin (See Ditch Section B). Stormwater will flow from south to north,
approximately 500', until it connects with a ditch (See Ditch Section A) that serves as the
inlet to the wet detention basin.
Tract 10
To manage stormwater runoff from Tract 10 rainfall will sheet flow, from all future
impervious surfaces and green areas, into the southern (swale) and northern (ditch)
property line vegetative filters. Stormwater will be transferred from the property line

Tract 11
To manage stormwater runoff from Tract 11, rainfall will sheet flow, from all future
impervious surfaces and green areas, into the northern (swale) and southern (ditch)
property line vegetative filters. Stormwater will be transferred from the property line
swales to a ditch that runs parallel to the wet detention basin (See Ditch Section B).
Stormwater will flow from south to north, approximately 275', until it connects with a
ditch (See Ditch Section A) that serves as the inlet to the wet detention basin.
Tract 12
To manage stormwater runoff from Tract 12 , will sheet flow, from all future impervious
surfaces and green areas, into the northern (ditch) and southern (swale) property line
vegetative filters. Runoff from the south '/z of the tract will be transferred from the
property line swale to a ditch that runs parallel to the wet detention basin (See Ditch
Section B). Stormwater will flow from south to north, approximately 100', until it
connects with a ditch (See Ditch Section A) that serves as the inlet to the wet detention
basin. Runoff from the north '/z of the tract flows into the ditch located on the northern
property line (See Ditch Section A). This ditch serves as an inlet into the wet detention
basin.

aforementioned areas consists of the construction of an asphalt drive with associated drainage
infrastructure. Items that are excluded from this proposed development are the undeveloped
Tracts 13,15 & 16, (these are part of future development and will be assumed that 80% will
contain impervious coverage).
Northeastern Portion of Tract 13
To manage stormwater runoff from the northeastern portion of Tract 13, rainfall will sheet
flow, from all future impervious surfaces and green areas, to the roadway Swale along
Currituck Commercial Dr.. Runoff will be conveyed from north to south, along the
roadway swale, to the intersecting ditch along the northern property line of Tract 12,
Stormwater will flow west along this ditch that serves as an inlet into the wet detention
basin.
Eastern '% of Tract 15
To manage stormwater runoff from the eastern portion of Tract 15, rainfall will sheet flow,

Southeastern Portion of Tract 16

Commercial Dr.. Runoff will be conveyed from north to south, along the roadway wale,
to the intersecting ditch along the northern property line of Tract 12. Stormwater will flow
west along this ditch that serves as an inlet into the wet detention basin.
Western %: of Currituck Commercial Dr. (from Tract 12 Northward)
To manage stormwater runoff from the western 'h of Currituck Commercial Dr., rainfall
will sheet flow, from all impervious surfaces to the roadway swale, along Currituck
Commercial Dr.. Runoff will be conveyed from north or south, (please refer to drainage
arrows on sheet 34270st2 for flow direction), along the roadway swale, to the intersecting
ditch along the northern property line of Tract 12. Stormwater will flow west along this
ditch that serves as an inlet into the wet detention basin.
Stormwater Management Narrative (con't):
The proposed ;wales consist mainly of broad, shallow, vegetative filters constructed with
approximately 3:1 side slopes. Longitudinal slopes are kept relatively flat, (0.1 % - 0.2% slope), to
provide for low velocity flow, thereby aiding infiltration and sediment removal.
Stormwater runoff is conveyed to the pond through (1) inlet swale located at the north end of the
detention basin. At the inlet, erosion control will be required as a baffle to minimize turbulence. A
sediment forebay has been designed at each inlet to enhance sedimentation and to account for
sufficient sediment storage for proper operation and maintenance. The forebay serves the pond
inlet with a storage area equivalent to approximately 20% of the total storage capacity of the pond.
The stormwater detention basin is designed to handle stormwater runoff in the amount of 1" of
rainfall over all impervious surfaces and proposed impervious surfaces over the entire 25.96-acre
tract. It is assumed that the undeveloped tracts will be calculated with a proposed 80% impervious
coverage on each tract. With the permanent pool elevation located at approximately 6.5' msl,
stormwater will be stored to an elevation of a 7.81'. A storm event that exceeds the volume from a
1" runoff over all impervious surfaces will be released through a 30-foot erosion control stone
lined overflow swale at an invert of 8.0' msl.
An outlet device will be provided to draw down from the design storage elevation of 7.81' msl to
the permanent pool elevation of 6.5' msl in the span of 4 days. This will be accomplished through
the use of a 3" orifice in the draw down device, which will be located at an invert of 5.5' msl,
(reference draw down detail on sheet 34270stl). When runoff from the storm event exceeds an
elevation of 7.81' msl in the detention pond, stormwater will overflow into an 8" dia. PVC pipe
and transported to the ditch located along the western boundary line.
The overflow swale and drawdown device discharge into an improved existing ditch along the
western boundary line. The western boundary line ditch connects with another improved existing
ditch that is located along the southern boundary line (reference detail of ditch improvement on
sheet 34270st2). Located at the entrance to the U.S. Hwy.168 roadway culvert at the southeast
comer of Currituck Commercial Center, a stormwater pump will be installed to regulate the
stormwater flow into the adjoining outfall ditch. The ditch on the east side of U.S. Hwy.168 serves
as an eventual outlet to the Northwest River approximately a'/4 mile to the east of the proposed
site. Northwest River is classified as having SC waters.

II. Stormwater Management Narrative:
This project consists of the construction of a 18 tract subdivision with associated
roadway and drainage infrastructure improvements. The site is located along
State road (N.C. 168) in Moyock Township, Currituck County, North Carolina.
Site soils are mainly composed of Roanoke fine sandy loams described as nearly
level poorly level drained surface soils over a dark clay loam layer.
The site contains an average seasonal water table depth of 18" below the ground
surface.
To manage stormwater runoff from the proposed paving, vegetative filters are to
be constructed along each property line and also along each roadway as indicated
on the drainage Plan (DR2). The overall flow direction is from the front of the
project (N.C. 168) to the rear perimeter ditch. This perimeter ditch shall serve as
an outfall to the Northwest River.

These swales are used in conjunction with the perimeter swales that Colk-

of 48" then sloping 2:1 to a depth that varies between 1'-2' msl. The soil at the
base of the these swales consists of sandy soils with relatively flat longitudinal
slopes provide for low velocity flow, thereby aiding infiltration and sediment
removal.

Areas disturbed by construction activities should be inspected after each
significant
rainfall event and /or bi-weekly until disturbed areas are fully stabilized. Rills and
gullies must be repaired, reseeded and mulched as soon as possible.
B. Mowing:
The pond side slopes and the vegetative filter swales should be removed regularly
to prevent woody growth and control weeds. Cut vegetation should be removed
from the basin and disposed of. Floating debris and litter should be removed from
the pond surface as part of periodic mowing operations. Vegetation growth within
the stone silt dams should be removed regularly,
C. Inspections:
The vegetative filter swales should be inspected on a semi-annual basis, Attentior
should be given to evidence of sediment accumulation, erosion, cracking and tree
growth. The overflow culvert should be inspected for debris and general
condition. The stone silt dams should be inspected for sediment buildup and
conformance with the original plans.
D. Maintenance:
Grassed Areas: Rills and gullies must be repaired, re -seeded, and stabilized as
soon as possible. Bare spots must be re -limed, fertilized, mulched, and re -seeded
as soon as possible. Temporary diversions may be required until new plants
develop.
Stone Silt Dams: Sediment accumulation should be removed once the depth
reaches ''/< of the total height of the silt dam. The silt dam will require
replacement when sediment accumulation within the dam renders it ineffective
(5-10 years).

ATTACHMENT A
1. Deed Restriction Language
The following statements must be recorded for all low density projects and for all projects that involve the
subdivision and selling of lots or outparcels:
1. No more than square feet of any lot, including that portion of file right-of-way between the
edge of pavement and the front lot line, shall be covered by impervious structures including
asphalt, gravel, concrete, brick, stone, slate or similar material but not including wood decking or
the surface of swimming pools. This covenant is intended to insure continued compliance with the
stormwater permit issued by the State of North Carolina. The covenant may not be changed or
deleted without tire 'consent of file State.
2. No one may fill in, pipe, or alter any roadside swale except as necessary to provide a minimum
driveway crossing.
NOTE: If lot sizes vary significantly, the owner/developer must provide an attachment listing each lot
number, size and the allowable built -upon area for each lot.
For commercial projects that have outparcels or future development the following statements must also be
recorded:
3. Tire connection from the outparcel or future area into the stormwater system must be made into the
forebay such that short-circuiting of the system does not occur.
4. All built -upon area from the outparcel or future development must be directed into the permitted
stormwater control system.
5. Built -upon area in excess of the permitted amount will require a permit modification prior to
