Radford Environmental Affairs Department Marine Corps Air Station Cherry Point PSC Box 6006 Cherry Point, NC 28533 Subject: NOTICE OF VIOLATION Stormwater Project SW7970117 MCAS Cherry Point Commissary Expansion Craven County Dear Mr. Radford: This letter is to notify you of a violation of State Stormwater permit SW7970117. This permit issued May 5, 1997 required the construction of a stormwater treatment system prior to the expansion of the Commissary located off Roosevelt Boulevard at Cherry Point. On February 9, 2007 Mr. Roger Thorpe of this office inspected the site for the purpose of renewing the stormwater permit. This inspection revealed that the wetland detention system permitted under SW7970117 had not been completed as shown on the approved plans. It appeared that the overflow structure had never been constructed. Also the stormwater treatment system has grown up in trees and there is an erosion problem at the inlet end of the treatment system. Part II 1.a. of permit SW7970117 issued May 5, 1997 requires that the stormwater management system be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surfaces except roads. Please be advised that this is a violation of Permit SW7970117 and may subject you to appropriate enforcement actions in accordance with North Carolina General Statute 143-215.6A which provides that a civil penalty of not more than twenty-five thousand dollars ($25,000.00) per violation may be assessed against a person who fails to comply with permit conditions. Please submit to this office within 10 working days after receipt of this Notice a written response that includes a schedule for achieving compliance with permit SW7970117. This schedule should include dates for completing construction of the stormwater treatment system and submitting an engineers certification that the system has been built according to approved plans. Your explanation will be reviewed and considered when making a determination whether to proceed with an enforcement action.
