Scott looked up the permit (SW7970115) that belongs to the shopping center and saw 3 drop inlets located at the back of the store, I was able to confirm this by pictures. He said that so long as the water was being sent to the nearby pond he would not have a problem with us surface draining the roof. After a conversation with Gordon, we will not proceed with this change until further notice. If anyone has any questions, please feel free to contact me. Enterprises, LLC., BPG submits for your review the proposed corrective action plan for the maintenance of the existing drainage infrastructure servicing the Hatteras Island Plaza commercial site located in Avon, Dare County, NC. As per your suggestions in recent telephone conversations we have had regarding the current violation, our client, Mr. Brantley Tillman of O.T. Enterprises, LLC, is in the process of addressing the items as described in the Notice of Violation issued March 13, 2007. Corrective measures will be as follows: Obtaining a 15' wide maintenance easement around the perimeter of Pond #1 with an associative access easement (wet detention ponds shown in the Stormwater Management Site Plan)., Pond #1 has approximately 3.705 acres of surface area and approximately 2.436 acres of the pond is located on the adjoining property to the west that is currently owned by Outer Banks/Ktnnakeet Associates, LLC. Obtaining a 15' wide maintenance casement around the perimeter of Pond #2 with in associative access casement. Pond #2 has approximately 0.154 acres of surface area with approximately 0.144 acres of the pond located on the adjoining property to the south that is currently owned by ADARE, Inc. The remaining +- 0.010 acres of Pond #2 reside on adjoining property owned by Outer Banks/Kinnakeet Associates, LLC. The intent is of this plan is to provide corrective action on the existing Stormwater basins to ensure continued operation and maintenance of the overall drainage network that currently serves the existing Hatteras Island Plaza Commercial development. These corrective action items include, but are not limited to, identifying all existing trees located along the eastern periphery of the existing basins, in excess of a six inch base diameter or those trees observed to be leaning over the water surface and prohibiting proper function of the basin. Areas of excessive sediment accumulation at the various basin inlet points will also be identified for removal. It is intended that this process will be completed 30 days from the date of signature of this document with an additional 60 clay allowance for implementation of the identified corrective action measures. Director Division of Water Quality Qz- e Ve-A % This letter is to notify you that staff of the Washington Regional Office of the Division of Water Quality conducted a compliance inspection at the stonnwater treatment facilities serving Hatteras Island Plaza on March 1, 2007. A copy of the inspection report is included for your review. Please note the concerns indicated under the comments section of the report. This inspection was conducted in connection with your request for renewal of permit SW7970115. This inspection revealed that the permitted wet detention pond has not been satisfactorily maintained which is a violation of permit SW7970115. Specifically, the inspection revealed that there is excessive large stemmed growth and vegetation around the pond. Part 11 2., 3., and 4 of permit SW7970115 issued April 10, 1997 addresses the operation and maintenance requirements for the, wet detention ponds. These conditions require that the facilities be properly maintained and operated at all times and that records of the maintenance activities must be kept and made available upon request. Please submit a proposed list of maintenance activities and schedule within 30 days of receipt of this letter for cleaning and returning the wet detention ponds to their original design. All work should be completed no later than May 31, 2007. Please be advised that any violation of the conditions contained in permit SW7970115 may subject you to appropriate enforcement actions in accordance with North Carolina General Statute 143-215.6A which provides that a civil penalty of not more than twenty-five thousand dollars ($25,000.00) per violation may be assessed against a person who fails to comply with permit conditions. This permit expires on April 10, 2007. Section .1003(h) of 15 A NCAC 2H .1000 (the stormwaterrules) requires that applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $420.00. SW7950808 dated December 27, 1995, and permit no. SW7970115 dated April 10, 1997, and complied with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. The intent of this permit modification is to retain best management practices for all previous permitted and non - permitted developmental activities. The 9.467 ac. subject property is located on the west side of NC State Route 12 approximately 700 feet south of the roadway intersection of Kinnakeet Boulevard and NC 12, in Avon Township of Dare County, North Carolina. The most recent developmental activities that have been completed but were not included in the previous permit, designated as Phases H-E and II-F, consist of (2) retail commercial buildings with a total of 4,968 sq.ft. within the existing development plaza. These additional buildings were completed in 1999. No additional drainage systems, nor parking or access areas were created. Subsequently, the site was subdivided and the 3.5 ac. Parcel III -A was conveyed (2000), after which the remainder of the site (9.467 ac.) was twice conveyed, with the final conveyance to O.T. Enterprises, LLC. on 12-01-2004. Eastern portions of the site near NC 12 slope towards existing catch basins, with Drainage Area #1 draining to Pond #1, and Drainage Area #2 draining to Pond #2. Western portions of the impervious areas slope to adjoining "404" Jurisdictional wetlands to the west that also drain to Pond #1. The Ponds #1 and #2 do not contain drainage outlets, but are hydraulically linked through a thin strip of wetlands to the 21.2 ac. lake as shown on STORMWATER MANAGEMENT SITE PLAN. There are approximately 0.352 acres of "404" Jurisdictional wetlands currently existing on -site. The receiving Pamlico Sound has a classification of "SA". All developmental activities were designed in conformity with the requirements for application and issuance of pennits for stonnwater management systems in pursuant with rules .1003 and .1005 in accordance with G.S. 143-215.1 and 15A NCAC 2H .0200 as set forth. These requirements are designed to control pollutants associated with somrwater runoff applicable to development of land for residential, commercial, industrial, or institutional uses. The developmental activities described herein were designed in compliance with the requirements as set forth for stonnwater management within coastal counties Rule .1005, section 3, subparagraph 13: (i) Control systems must be infiltration systems, wet retention ponds, or alternative stonnwater management control systems designed in accordance with Rule .1008; (ii) Control systems must be designed to control runoff over the entire drainage area generated by 1.5 inches of rainfall. Design of the active stormwater management measures are based on the design criteria indicated in .1008(e) Wet Detention Pond Requirements, under the NCDENR Division of Water Quality Administrative Code for Stormwater Management, 15A NCAC 2H.1000. The site had been previously permitted with (1) drainage area. An As -Built survey of the site conducted in 2003 (details included within the site plan) indicated a stormwater conveyance and detention system that was not indicated in the two previous stormwater permits. The limits and impermeable areas of this second watershed (delineated as Drainage Area #2 in the site plan) appear to have been included within the previously permitted drainage area, permit no. SW7970115 (1997). The Drainage Area #2 watershed appears to have been constructed with Phase H-D. (Please reference Stonnwater Management Site Plan for Drainage Area Delineations). The most recent developmental activities consisted of the construction of (2) commercial buildings (Phases II-E and lI- F) totaling 4,968 sq.ft. without any additional parking, access drives, or drainage systems. The newer buildings add to the rainfall runoff within Drainage Area #1 only. Drainage Area #1 This drainage watershed encompasses nearly 93% of the entire developments impervious coverage, including all existing buildings and 90% of the parking, drives and walk ways. The previously permitted (4-11-97) total impervious coverage was 312,771 s.f. (7.18 ac.). With this application's Drainage Area 41 delineation, the impervious coverage of this watershed was 286,062 sq.ft. (6.567 ac.) before the additions of Phases fl-E and 11-F. With the addition of the two commercial buildings within Drainage Area #1, the impervious coverage was increased to 290,979 sq.ft. (6.680 ac.), an increase of nearly 1.72% . Compared to the total impermeable surface area indicated in the permit, this is an increase of 0.16%. The associative runoff continues to have a control system in the form of an existing pond (designated as Pond #1) that has been serving as a forebay to an adjacent 21.2 acre lake. Rainfall runoff from all existing buildings and 90% of the parking & drive surfaces are collected and directed by curb & gutter to various curb inlets connected to a network of drainage pipes that ultimately discharge to Pond #1 located along the project's western boundary. Within the middle eastern portion of the parking area, flow is collected in an existing adjoining vegetative swale that outlets to the pipe network via a drop inlet located near the right of way of NC 12. The rooftop runoff from the buildings is collected by a perimeter gutter system that discharge to the adjacent pavement to the west of the buildings. Rip -rap inlet protection is in place at the pond's wetland area inlets for velocity dissipation and to aid in infiltration and sediment removal. The pond does not contain a drainage outlet, but is hydraulically connected through a thin strip of wetlands to the 21.2 acre lake as shown on the site plan. The hydraulic linking provides water level control in Pond #1 and prevents sediments and pollutants from reaching the lake, allowing the pond to act passively as a large forebay to the lake. Pond #1 has the physical attributes required to remove 90% of total suspended solids from the associative design storm runoff of 1.5 inches rain. The pond has the detention capacity to contain the initial 4.51 inches of storm runoff, assuming no infiltration and including the rain that falls within the pond's shoreline. The pond has a detention capacity factor of 4.75 of the required volume for a 1.5 inch rain event. Pond #1 and conveyances for Drainage Area # 1 do not have drainage easements associated with them. Drainage Area #2 As indicated above, Drainage Area #2 was not defined in the last issued permit, but available records indicate that the conveyance system of Drainage Area #2 was constructed with Phase 11-D. Rainfall runoff from the parking & drive surfaces sheet flow over the parking areas and are collected and directed by curb & gutter to one curb inlet connected to an existing 18" RCP stormwater conveyance that is discharged to Pond #2 located approximately 133 ft. south of the site's south boundary. Part of the conveyance and Pond #2 are on an adjoining property (Parcel III -A). Parcel III -A had been a part of the site in the last permit, but was conveyed in 2000. The conveyance was given a drainage easement, but no drainage easement exists for Pond #2. It should be noted that the additions of Phases II-E and H-F are not tributary to Drainage Area #2 Based on the overall design of this development, stonnwater runoff from the existing impervious surfaces receive treatment, to the maximum extent possible, in the form of existing ponds that act passively as forebays to the large lake further to the west of the project. The intent of this existing design was to provide adequate pollutant filtration measures to stormwater runoff resulting from the high -density pocket created with this commercial center. Measures were designed to treat runoff from the associated development in accordance with best management practices at the time of the last stormwater management plan permit application (1997). Existing impervious surface areas were utilized to compute the required storage volume from the associated 1.5 inch rainfall storm event, (please reference Attachment A for stormwater management calculations). It is expected that the existing system will continue to provide pollutant removal efficiency and provide sufficient protection to the adjoining surface waters. Redesign or addition to the approved amount of built -upon area e. Further subdivision of the project area. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 6. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system. a. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surfaces except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 5 f k. 2. The facilities must be properly maintained and operated at all times. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency including, but not limited to: a. Semiannual scheduled inspections (every 6 months) b. Sediment removal C. Mowing and revegetation of side slopes d. Immediate repair of eroded areas e. Maintenance of side slopes in accordance with approved plans and specifications f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Mail the Certification to the Washington Regional Office, 943 Washington Square Mall, Washington, North Carolina, 27889, attention Division of Water Quality. 7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of five years from the date of the completion of construction. III. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 6 s 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c). 3. The issuance of this permit does not preclude the. Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, 'including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permit may be modified, revoked and reissued or terminated for cause.
